Background

UN Women, the UN Entity for Gender Equality and the Empowerment of Women has been created to accelerate up the process of meeting the needs of women and girls across the world. As a part of the UN reform agenda, it brings together resources and mandates which will subsequently have a lasting impact on the whole community. UN Women is working with different Government and civil society partners and with the UN agencies in support to addressing the national gender equality priorities and addressing stereotypes and patriarchal norms leading to women’s vulnerability and unequal position in the society.

UN Women has a great experience in implementing projects to support women living with HIV (WLWH), who struggle with stigma and exclusion, aggravated by lack of respect of their human rights. It must be noted that, stigmatization and discrimination trigger a wide range of human rights abuses for which the great majority of women living with HIV have not sought justice. In particular: discrimination on the basis of real or perceived HIV status; violations of the right to medical privacy; forced HIV testing; barriers to employment on the basis of HIV status, denial of education and child adaption on the basis of HIV status or having HIV in the family; discrimination in gaining access to medical care; and lack of access to justice. Women widowed by AIDS or living with HIV face property disputes with in-laws, complicated by limited access to justice to uphold their rights.

Access to justice for all of these abuses is hindered not only by the lack of a supportive legal framework and standard mechanisms for redress, but also by context-based factors such as limited knowledge of rights among people with HIV and those at risk, inability to identify perpetrators, limited access to and affordability of legal aid services, and the stigmatization, discrimination and powerlessness that stem from being a member of a socially marginalized group.

Due to a huge demand in access of WLWH to HIV-related legal services, there is a need to create a Network of Professional Lawyers specialized on human rights and trained on consequences of HIV and AIDS.,

With this purpose, UN Women is planning to hire a National Consultant to support in the establishment of the Network of Lawyers on HIV and AIDS.

 

 

Duties and Responsibilities

Under the direct supervision of the UN Women Country Programme Manager, the National Consultant will be responsible for the following:

  • To develop the selection criteria for the selection of the most active advocates/lawyers specialized in human rights and HIV/AIDS for including them in the Network of Lawyers, in close coordination with UN Women Program Coordinator HIV/AIDS.
  • Considering the fact that in a society as our, women feel better to communicate with women lawyers than with men, especially when it comes to the issues of violence, family disputes, disclosure of confidential information about the disease and personal life, preference should be given to a women-lawyers.
  • In close cooperation with Tajik Bar Associations and Attorney Offices, identify and select 8 lawyers from all four regions of Tajikistan to join the rank of professional lawyers for support of women living with HIV.
  • To prepare the training material on gender mainstreaming in justice sector, criminal and civil cases, considering a human rights-based approach and consequences of HIV/AIDS with the participation of women living with HIV.
  • To facilitate a series of trainings on gender mainstreaming in justice sector, criminal and civil cases, considering a human rights-based approach and consequences of HIV/AIDS with the participation of women living with HIV.
  • To assist the members of the established Network of Lawyers in developing a constituent documentation- the Network Strategy, regulations, as well as an Action Plan.
  • Selection of the best practices of similar professional networks to defend the rights of WLWH for the experience exchange purposes.
  • To prepare the documentation for the possibility of introducing the institute of internship through the Network of lawyers, for the young girls’ lawyers.

Required Skills and Experience

Education:          

  • Advanced degree in jurisprudence, human rights and law, legal framework, or an area relevant to the deliverables of this TOR;

Experience:

  • A minimum of 5 years relevant work experience in analysis of legislation gender and HIV/AIDS programming;
  • A minimum of 2 years of experience in facilitating trainings on gender mainstreaming and HIV and AIDS;
  • Previous work and direct working relationships with UN agencies, either in consultation or in training service provision; considered an asset.

Knowledge of languages:

  • Proficiency in written and oral Russian, Knowledge of English is an advantage.
