Background

Description of the assignment:

The purpose of the assignment is to provide support to the implementation of the UNODC Global Programme against Trafficking in Persons (GLOT59) in Bosnia and Herzegovina (BiH) in order to strengthen the capacity of national law enforcement authorities and criminal justice practitioners to better identify, investigate, prosecute and adjudicate cases of trafficking in persons (TIP), to protect and assist TIP victims, and to enhance cross-border criminal justice cooperation in the South Eastern Europe (SEE).

a. Purpose

The purpose of the assignment is to provide support to the implementation of the UNODC Global Programme against Trafficking in Persons (GLOT59) in Bosnia and Herzegovina (BiH) in order to strengthen the capacity of national law enforcement authorities and criminal justice practitioners to better identify, investigate, prosecute and adjudicate cases of trafficking in persons (TIP), to protect and assist TIP victims, and to enhance cross-border criminal justice cooperation in the South Eastern Europe (SEE).


b. Objective

To reach out to all relevant authorities and conduct inquiries, surveys, interviews, on what works and what are the challenges facing practitioners in BiH, also in terms of regional cooperation, in each of the topics included in the plan for TIP activities in the SEE and covered in the five multidisciplinary workshops in SEE for the period 2020-2021 (see below). The consultant is expected to be in regular contact with the stakeholders in BiH and prepare five periodical reports, as per the work plan 2020-2021, describing the results of the work undertaken. The consultant will support preparing, organizing and reporting of the regional workshops (RW) as per the plan for TIP activities in the SEE for the period 2020-2021. The consultant will provide ongoing support to GLOT59 programming and project development through country-specific inputs on TIP, as requested.


c. Background Information

As the guardian of the United Nations Convention against Transnational Organized Crime (UNTOC) and its supplementing Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children (TIP Protocol), the United Nations Office on Drugs and Crime (UNODC) primary goal with respect to addressing trafficking in persons, is to promote global adherence to the TIP Protocol, which to date counts 178 States Parties, and assist States in their efforts to effectively implement it.

Within the context of the UNODC Global Programme against Trafficking in Persons (GLOT59) implemented in BiH, UNODC will develop and deliver five (5) multi-disciplinary regional workshops for SEE on TIP, on different thematic issues, namely: a) TIP for the purpose of forced criminality; b) TIP for labour exploitation in particular children; c) access to effective remedies to victims of TIP; d) addressing demand side of TIP; and e) addressing TIP in prostitution through international cooperation. Until epidemiological situation caused by COVID-19 pandemic allows for in person RWs, the regional workshops will be organized through online format, as per dynamic described in the deliverables for the present consultancy contract. Customized regional workshop materials will be developed and made available for multi-disciplinary target groups of practitioners from the criminal justice and protection sectors, including specific brief country reports for BiH related to the topics of the RWs.

 


Duties and Responsibilities

Under the overall guidance of the Team Leader for Technical Cooperation of UNODC Global Programme against the Trafficking in Persons and supervision by the designated staff of HTMSS, the consultant will:

  • Plan, prepare and support delivery, as national expert for BiH, of five (5) multi-disciplinary regional workshops for SEE on TIP, on different thematic issues, namely: a) TIP for the purpose of forced criminality; b) TIP for labour exploitation in particular children; c) access to effective remedies to victims of TIP; d) addressing demand side of TIP; and e) addressing TIP in prostitution through international cooperation.
  • Provide ongoing support to GLOT59 programming and project development through country-specific inputs on TIP, as requested.
  • Expected tangible and measurable output(s)/deliverable(s):

All the outputs should meet the satisfaction of the relevant staff of the HTMSS Team according to the following criteria:

  • Timelines of the delivery

Under these terms of reference, the consultant shall deliver the following outputs:

A. Provide inputs to draft agenda and corresponding materials related to BiH for five (5) multi-disciplinary regional workshops for SEE on TIP, on different thematic issues, namely: a) TIP for the purpose of forced criminality; b) TIP for labour exploitation in particular children; c) access to effective remedies to victims of TIP; d) addressing demand side of TIP; and e) addressing TIP in prostitution through international cooperation, including specific brief country reports for BiH related to the topics of the RWs and submit to HTMSS for clearance.

Related activities:

  • Provide inputs to draft agenda related to BiH for regional workshops
  • Provide draft materials for regional workshops, including five brief thematic reports on state of play in BiH with respect to each of the five thematic issues to addressed in the Regional Workshops
  • Liaise and coordinate with participants from BiH on RWs and participating experts’ speakers for regional workshops

B. Facilitate and support delivery of five (5) regional multidisciplinary workshops for SEE on: a) TIP for the purpose of forced criminality; b) TIP for labour exploitation in particular children; c) access to effective remedies to victims of TIP; d) addressing demand side of TIP; and e) addressing TIP in prostitution through international cooperation.  

Related activities:

  • Prepare and deliver presentations for regional workshops, including specific brief country reports for BiH related to the topics of the RWs, 
  • Moderate sessions, including work in groups, plenary discussion, and coordinate presentations of expert speakers and participants of regional workshops from BiH,
  • Provide inputs to reports after delivering regional workshops.

Payments for the deliverables will be made in 5 installments:

  • First installment upon completion of deliverable 1: 20% of the total budget of the consultancy, after submission and approval of inputs to draft agenda and corresponding materials, including brief thematic reports on BiH and final activity report, for regional workshop on TIP for the purpose of forced criminality in SEE, by UNODC Crime Prevention and Criminal Justice Officer HTMSS/OCB/DTA.
  • Second installment upon completion of deliverable 2: 20 % of the total budget of the consultancy, after submission and approval of inputs to draft agenda and corresponding materials, including brief thematic reports on BiH and final activity report, for regional workshop on TIP for labour exploitation and in particular children in SEE, by UNODC Crime Prevention and Criminal Justice Officer HTMSS/OCB/DTA.
  • Third installment upon completion of deliverable 3: 20 % of the total budget of the consultancy, after submission and approval of inputs to draft agenda and corresponding materials, including brief thematic reports on BiH and final activity report, for regional workshop on access to effective remedies to victims of TIP in SEE, by UNODC Crime Prevention and Criminal Justice Officer HTMSS/OCB/DTA.
  • Fourth installment upon completion of deliverable 4: 20 % of the total budget of the consultancy, after submission and approval of inputs to draft agenda and corresponding materials, including brief thematic reports on BiH and final activity report, for regional workshop on addressing demand side of TIP in SEE, by UNODC Crime Prevention and Criminal Justice Officer HTMSS/OCB/DTA.
  • Fifth installment upon completion of deliverable 5: 20 % of the total budget of the consultancy, after submission and approval of inputs to draft agenda and corresponding materials, including brief thematic reports on BiH and final activity report, for regional workshop on addressing TIP in prostitution through international cooperation in SEE, by UNODC Crime Prevention and Criminal Justice Officer HTMSS/OCB/DTA.
  • Agendas, workshop and corresponding materials have to be written in professional, clear and unambiguous English language.
  • Agendas, workshop and corresponding materials have to be complete, well structured, concise and clearly presented.

 

 


Competencies

  • Proven experience on legal and/or criminal justice research and analysis, with experience in developing and delivering technical assistance on TIP is an advantage;
  • Ability to draft clear and well-organized texts in English, including for translation in other languages, is essential;
  • Ability to work independently.
     


Required Skills and Experience

  • Advanced degree in law; International Law; Criminal Justice, Criminal Law;
  • Minimum 10 years of experience on legal and/or criminal justice research and analysis, with experience in developing and delivering technical assistance on TIP is an advantage;
  • Knowledge and/or previous experience working with the UN on TIP; organized crime and international criminal justice cooperation is an asset;
  • Knowledge of Bosnian language is essential;
  • Ability to draft clear and well-organized texts in English, including for translation in other languages, is essential;
  • Working knowledge of other UN Language is highly desirable. Other languages an asset;
  • Ability to work independently.

Interested individual consultants must submit the following documents/information to demonstrate their qualifications:

Individual consultants will be evaluated based on the following methodologies:

When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:

a) responsive/compliant/acceptable, and

b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.
