Background

The Sawasya II programme: Promoting the Rule of Law in Palestine represents the primary programmatic vehicle of the United Nations for advancing the rule of law, integrity, gender justice and human rights in Palestine for the period 2018-2022. Bringing together the main UN entities mandated and invested in these areas in an integrated programme framework (three years, with provision for a further two optional years), Sawasya II seeks to elevate the state building enterprise for a progressively functioning and increasingly inclusive State of Palestine that respects, protects and fulfils human rights and gender equality, and promotes development, peace and security. The programme has a dedicated output (2.1.) which aims at improving the quality and efficiency of security and justice services. Under this output, the Programme provides support to the public prosecution, through its human rights unit, in monitoring places of detention.

The public prosecution plays an important role in implementing the human rights obligations of the State of Palestine as per the human right treaties it has acceded to. The Human Rights Unit (HRU) at the Attorney General’s Office (AGO) was activated in January 2017, with the overall mandate to mainstream human rights principles into the work of the Public Prosecution. As stipulated by the Reform & Rehabilitation Centers Law and the Criminal Procedures Code, the public prosecution (as well as the Presidents of the first instance courts and the appeal courts) has the right and is obliged to inspect the rehabilitation and detention centers and temporary detention cells which exist in their districts to ensure that no prisoner is detained without legal status. Furthermore, they have the right to inspect all the documents and the prisons files, detention orders and court decisions, take copies of these documents, and hear prisoner’s complaints. To that end, Sawasya II is seeking a national/ international consultant specialised on monitoring places of detention, particularly monitoring women in detention (Gender-sensitive monitoring) based on Bangkok Rules. The over all of this assignment is to build the capacity of members of the human right unit in AGO in monitoring women in detention.

The expert will perform his/her tasks under the supervision of the Sawasya II Human Rights Coordinator and Program Specialist on Access to Justice and in close collaboration with human right unit team in public prosecution.

Duties and Responsibilities

FUNCTIONS/ DUTIES, KEY RESULTS EXPECTED

  • Drawing on document review on HRU mandate and it functions in general and prison monitoring function in particular  including the the Prison Monitoring software system data,  as well the interviews with the head of human right unit, the head of the gender unit, the incumbent will be expected to support the Human Right Unit in the following:
  • design the agenda of the training on monitoring women in detention based on Bangkok rule.
  • Develop the training materials for the participants, taking in consideration the the following subjects.

 

  • Risk factors and measures to reduce risk        
    • Certain contexts which are heighten risk, social context, Legislative context, Certain times that heighten risk. Police custody and pre-trial detention          
    • Certain policies and practices that heighten risk or cause physical or mental suffering. Inadequate safeguards and assessments on admission  
      • The nature and scope of medical examinations          
      • Not separating male and female prisoners   
      • Supervision by male staff/ mixed gender staffing         
      • Searching policies and practices      
      • Solitary confinement/ disciplinary segregation          
      • The inappropriate and unjustified use of restraints
      • Inadequate provision for gender specific hygiene, sexual and reproductive healthcare          
      • Inadequate provision for family contact      
      • Inappropriate decisions to separate dependent children from their mothers in prison          
      • Detention for protection       
    • Certain categories of women who are at heightened risk ( Girls)    
      • Victims of human trafficking and sex workers          
      • Women with mental healthcare needs        
      • Other groups that are at heightened risk     
  • Conducted 3 days training workshop for prosecutors with clear guidance of implementing Bangkok rule.
  • Final report on the workshop recommendations and enhancement of the prison monitoring software to be -gender sensitive.

DELIVERABLES

The consultant will be expected to complete the following deliverables and report to the Programme Management Specialist and the Human Rights Coordinator:

  • Agenda for the training
  • Training materials based on Bangkok rules
  • Conducting three days training workshop
  • Final report and recommendations of the workshop as well recommendations on enhancement of the PM system on gender sensitivity.

Education

At least Master University degree in the field of Law, criminal law , human right law or any other related fields.

Experience

  • At least 10 years of experience working in rule of law and human right locally or internationally.
  • At least 5 years of experience in monitoring places of detention  
  • At least two-year experience training in the field of prison monitoring based on Nelson Mandela Rules.
  • At least two-year experience training in prison monitoring especially in the field of female inmates’ places of detention based on Bangkok rules.
  • Experience working with large UN rule of law programmes is an asset.

Languages

  • Fluency English and Arabic is essential.
  • Highly skilled in professional English writing

UNDP/PAPP seeks technical proposals from qualified individual consultants to build the capacity of public prosecution – human right unit in monitoring women in detention.

 

  1. Documents comprising the Technical and Financial Proposals

Interested individual consultant must submit the following documents/information, which comprises the Technical& Financial Proposals:

 

  1. Provide Curriculum vitae including past experience in the field of rule of law, human rights and reforming justice sector institutions.
  2. Proposed methodology to achieve the tasks included in the ToR (not more than 5 pages) 
  3. Sample of training reports from the same field.
  4. Completed financial proposal form, found under Annex III: the financial proposal is all-inclusive and shall take into account various expenses incurred by the consultant while fulfilling its mission (e.g. transportation cost…). 

 

  1. Evaluation

Preliminary examination

 

UNDP/PAPP will examine the Proposals to determine whether they are complete, and whether they are substantially responsive to the qualification and experience minimum requirements. A Proposal determined as not substantially responsive will be rejected by UNDP/PAPP and may not subsequently be made responsive by the Applicant by correction of the non-conformity.

 

Detailed examination

 

Individual consultants will be evaluated based on a cumulative analysis taking into consideration the combination of the applicants’ qualifications and financial proposal. 

 

Only those candidates who will obtain min. 70 points for the technical evaluation will be assessed for the financial proposal evaluation.

  1. Award of Individual Contract

 

The procuring UNDP entity reserves the right to accept or reject any Proposal, and to annul the solicitation process and reject all Proposals at any time prior to award of contract, without incurring any liability to the affected applicant or any obligation to inform the affected applicant or applicants of the ground for the UNDP’s action.

The award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:

a) responsive/compliant/acceptable, and

b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

Highest score / combined score calculation methodology:

100 points shall be allocated to the lowest total fees proposed among those invited candidates which were successful in the evaluation of the technical proposal (i.e. obtained a technical score of 70 or more).  All other fees proposals shall receive points in inverse proportion to the lowest total fees; e.g. [100 Points] x [US$ lowest total fees] / [US$ other] = points for other proposer’s fees.

The General mark or combined score for each proposal will be arrived as follows:

FINANCIAL PROPOSAL FORM

Your financial offer in USD shall specify a lump sum figure all-inclusive and shall take into account various expenses incurred during the contract period and shall form the amount of the resulted contract between the winning Consultant/Contractor and UNDP. No other entitlements will be considered after submission of financial proposals.

The financial proposal shall include a breakdown of this lump sum amount (number of anticipated working days, all envisaged travel (such as but not limited to all travel to join duty station/repatriation travel), per diems/daily allowances). Fee Breakdown should be attached under a separate sheet.
