Background

The maritime sector is rapidly increasing in the past years, as a source for further economic development and international cooperation. The Government of Albania has made progress in maintenance and infrastructure of port facilities in line with the Sector Strategy, priorities stipulated in the Government Program, the National Transport Plan, the National Strategy for Development and Integration and the Medium-Term Budget Plan.

Supporting data from INSTAT show that in 2017 compared to 2016, the volume of freight loading and unloading in Albanian ports has increasing by 7.1 %, the number of passengers travelling by sea line is increasing by 16.9%, the goods exported by sea represent 62.8 % of the total transport as well as goods imported by sea represent 48.6 %.

Maritime transport is primarily concerned with the transport of freight and passengers by sea. The sector is associated with many other activities such as ship agency, chartering and brokering, maritime labour and education, multimodal and intermodal transport and related services.

Cooperation on various services notably those linked to the capacity building in the public sector and better coordination of planning activities is needed for preparing the ground for better marine and maritime governance and services.

The “Enhancing the Development of Albanian Maritime Sector through Technical Assistance and Increased Partnership” project, aims to enhance the integration of Albanian Maritime Standards in line with the EU requirements, by developing and implementing maritime transport policy framework, improve capacities in the field and encourage the development of a Maritime Clusters in Albania with the relevant stakeholders.

The Republic of Albania by the law No. 103/2015 has ratified the Maritime Labour Convention (MLC 2006) and as part of this conventions has obligations for its implementation.

The Maritime Labour Convention, 2006 or MLC, 2006 is an international labour Convention adopted by the International Labour Organization (ILO) and International Maritime Organization (IMO).
It aims both to achieve decent work for seafarers and to secure economic interests through fair competition for quality ship owners. The Convention is comprehensive and sets out seafarers' rights to decent working conditions. It covers almost every aspect of their work and life on board.

Duties and Responsibilities

In this field, it is necessary establishing a Technical Assistance with the tasks:

Drafting of the first report in cooperation with MIE and ministries responsible for implementation of MLC 2006.
Assisting MIE for reporting it to ILO.
Drafting the legal framework for implementing of MLC 2006 in English and Albanian language in related fields:
Minimum requirements for seafarers to work on ship;
Conditions of employment;
Accommodation, recreational facilities, food and catering;
Health protection, medical care, welfare and social security protection;
Port & Flag state responsibilities
Maritime labour certificate and declaration of maritime labour compliance.
Inspection and enforcement
on-board complaint procedures
on inspections in port
- Coordinate the work for drafting of the regulations with the ministry/institutions responsible for health protection and security protection.
- Make close contacts with the Albanian shipowner and seafarers associations. Under MLC 2006 the member states have to consult the drafted legislation before approval, with Shipowner and Seafarers Associations within the country.
- Assisting the Ministry of Infrastructure and Energy in completing the legal framework.

Deliverables:

30%- September 30th, 2021- Develop the draft legal acts and consult them with MIE.

70%- December 10th,2021 – Develop the MLC 2006 report for Albania, and finalize the comments of relevant stakeholders for the legal acts developed.

Required Skills and Experience

Education

Advanced University degree in maritime policy, maritime management or related field.

Work Experience

At least 7 years of work experience in maritime sector, transport sector and related field of expertise;
Excellent knowledge on Maritime Governance related to acquis communitaire and IMO requirements.
Demonstrable experience in training and capacity building of stakeholders and institutions.
Previous experience with IMO/UN Conventions related approximation in Albania will be an advantage.
Demonstrated knowledge of the Albanian policies related to the maritime sector, maritime training and relevant areas;
Familiarity with key beneficiary institutions from maritime domain;

Language

Excellent oral and written communication skills in Albanian and English.

Technical Criteria - 70% of total evaluation – max points: 70

Criteria A: Relevant work experience – max 30 points

Criteria B: Excellent knowledge on Maritime Governance related to acquis communitaire and IMO requirements and demonstrated knowledge of the Albanian policies related to the maritime sector, maritime training and relevant areas – max 20 points

Criteria C: Education Background - max 20 points

Financial Criteria - 30% of total evaluation – max 30 points
