UN Women, the UN Entity for Gender Equality and the Empowerment of Women has been created to accelerate up the process of meeting the needs of women and girls across the world. As a part of the UN reform agenda, it brings together resources and mandates which will subsequently have a lasting impact on the whole community. UN Women is working with different Government and civil society partners and with the UN agencies in support to addressing the national gender equality priorities and addressing stereotypes and patriarchal norms leading to women’s vulnerability and unequal position in the society.

UN Women has a great experience in implementing projects to support women living with HIV (WLWH), who struggle with stigma and exclusion, aggravated by their lack of rights. Non-discrimination of women living with HIV and women from the affected populations is one of the priorities of the country agenda today. The issues of non-discrimination, the growing number of HIV infections and the vulnerability of women and girls to this disease are also closely monitored by the community as part of the SDGs.

It must be noted that, gender inequalities pose a major obstacle to effective HIV responses and has been identified as a key driver influencing the vulnerability of women and girls to HIV infection. Women and girls with HIV infection are culturally, socially, biologically, and economically more vulnerable than men. The lack of knowledge on legislation, stigma, and discrimination lead to the fact that HIV-positive women face many problems. UN Women woks a lot in promoting changes in discriminatory laws and policies for women living with HIV through national and international mechanisms.

In 2020 a comprehensive analysis of the existing legislation and draft Law on Protection from Discrimination was conducted by UN Women to identify statements and clauses discriminatory from the gender and WLWH rights viewpoint. In particular, the Law of the Republic of Tajikistan on State Guarantees of Equality Between Men and Women and Equal Opportunities for their Implementation, the Criminal Procedure and Criminal Codes, the Civil Procedure Code, the Healthcare Code, and the Code of Administrative Offenses have been reviewed using Human Rights and Gender Based Approach. The analysis of the Draft Law on Protection from Discrimination applied the best international practices of adopting anti-discrimination laws (Moldova, Ukraine, Bosnia and Herzegovina, Georgia).

The results of the analysis have been validated with WLWH at public consultations organized by UN Women. At the public consultations women living with HIV stressed the importance of strengthening the capacities and knowledge of WLWH in policies and legislation to eliminate stigma, discrimination and violence related to HIV and promote access to HIV prevention, treatment and care; to be able to protect themselves in non-discriminatory access to education, health care, employment and social services; to have basic knowledge on legal protections for people affected by HIV, including inheritance rights and respect for privacy and confidentiality, to better promote and protect all human rights and fundamental freedoms with particular attention to all people vulnerable to and affected by HIV.

With this purpose, UN Women is planning to hire a National Consultant to support in designing and facilitation of a training for WLWH on HIV related legislation and policies.

Duties and Responsibilities

Under the direct supervision of the UN Women Country Programme Manager, the National Consultant will be responsible for the following: 


? Preparation of the detailed work plan, including the methodology of work in close coordination with UN Women Programme Office in Tajikistan.

? Review of all HIV related policies and legislation, as well as the conducted by UN Women analysis of legislation, Including the Law on Protection from discrimination focusing mainly on education, health care, employment, and social services.  

? To prepare the training module and all related material on HIV polices and legislation, considering a human rights-based approach and consequences of HIV/AIDS.

? To facilitate three-days training for women living with HIV to strengthen their capacities and knowledge on main consequences of HIV related policies and legislation to be able to promote, protect and preserve their rights, interests, and well-being through the use of legal framework to ensure that they live free from all forms of discrimination, violence, and abuse in the society.

? Preparation and submission of the detailed report along with the supporting documents for the review and approval of UN Women Country Programme Manager, further recommendations and follow up actions.

Required Skills and Experience


  • University degree in jurisprudence, human rights and law, legal framework, or an area relevant to the deliverables of this TOR;



  • A minimum of 5 years relevant work experience in analysis of legislation in gender and HIV/AIDS programming;
  • A minimum of 2 years of experience in facilitating trainings for WLWH;
  • Previous work and direct working relationships with UN agencies, either in consultation or in training service provision; considered an asset.


Knowledge of languages:

  • Proficiency in written and oral Russian, Knowledge of English is an advantage.
