Background
Many people in South Sudan have unmet justice needs countrywide for both everyday disputes and severe abuses. After decades of war, the country was left with a barely functioning justice and policing system, and institutions are unable to provide the coverage, accessibility and effectiveness of services people require. Where they are delivered, services are unequal, untimely and outcomes are often unfair. Despite security improvements, crime rates are high, SGBV remains prevalent; and human rights violations are regularly reported. The delays to implement the R-ARCCS widens the justice gap and human rights deficit, as the review of essential laws, security concerns, as well as conflict-related abuses of the past and root causes of conflict remain unaddressed in the absence of transitional justice, accountability, reconciliation, healing and other constitutional and security sector reforms
UNDP’s Access to Justice, Security and Human Rights Programme responds to this by supporting the Judiciary of South Sudan; the Ministry of Justice; and the Ministry of Interior, including the South Sudan National Police Service and the National Prisons Service of South Sudan, the Law Reform Commission and the South Sudan Human Rights Commission to increase access to justice,
strengthen security including law enforcement and promote human rights in South Sudan as enablers for sustaining peace and development. Using a sector wide approach, UNDP’s strategy in achieving this is twofold. Firstly, by providing support to the priorities of the rule of law institutions as articulated in their institutional strategic and/or action plans. This includes both infrastructural and institutional development support. Secondly, by promoting access to justice and safety by linking the rule of law institutions with community and civil society initiatives. Additionally, the Program accompanys the government to implement its rule of law related commitment in the Revitalised Agreement on the Resolution of the Conflict in the Republic of South Sudan, 2018.
The programme includes support for the renovation of existing facilities that have been damaged in the conflict or over time, as well as construction of new facilities that the Clerk of Works is expected to supervise.
Objectives of the ToR
The UNDP South Sudan through the Access to Justice, Security and Human Rights Programme intends to contract a national Clark of Works consultant with construction supervision background to conduct day-to-days site supervion, prepare site progress reports on weekly and monthly baisis, prepare bills of quantities (BOQ) and drawings (where needed), provide inspection report for completed works for payments as per miletones
Purpose of the Assignment
The main objective of this consultancy is to conduct site-specific supervision of ongoing construction activities, and provide report at the end of each milestone to facilitate the contractors’ payment.
Scope of work
The Clerk of Works is on a call-basis based in different field locations in South Sudan to provide required services ensuring smooth running of ongoing construction works. The Clerk of Works will work under the overall guidance and close supervision of the Project Engineer, she/he is required to carry out day-to-day site supervision of ongoing construction activities done by contractors and report accordingly to the Project Engineer. The Clerk of Works will be required from time to time change the site location on an as needed basis.
Clerk of Works will undertake following tasks/duties in geographically determined area of responsibility:
- Construction works supervision
- Quality Assurance
- Monitoring and progress controls
- Construction works supervision:
- Supervising day-to-day construction activities ensuring that contractors comply with approved drawings, bills of Quantities’, specifications and work plans.
- Providing regular updates on progress of construction activities on a weekly/monthly basis and immediately relay and record any deviation from the agreed work plan, clearly specifying work progress and arising issue
- Keeping detailed records of work; particularly paying attention to any variations at site.
- Ensure respect of Health and Safety procedures on the site and notify the Supervisor of any irregularities immediately after.
- Measuring and certifying the quantity and quality of the actual works done for each invoice/s of the contractor/s to make payment;
- Perform other duties as assigned in the agreed timeframe
- Quality Control:
- Verifying the quality of the construction materials delivered on site and collected prove documentation.
- Ensuring that the contractors adhere to the mix design as per the contract agreement.
- Verify and contribute to technical specifications of products, apparatus, services and associated quality material
- Ensuring that the contractors adhere to provided method statement during the execution of activities
- During the Defect Liability Period intervene as required and liaise with the contractor to fix in a timely manner issues that arise and covered by the defect notification period.
- Monitoring and progress controls
- Hold regular sites meetings attending to day-to-day site challenges likely to affect contractor’s progress, and provide minutes of meeting for further actions by management.
- Ensure adequate and timely supply of materials by contracted companies in order to minimize unnecessary delays or interruptions of the civil works work plan;
- Ensuring that variations/additional works identified get prior written approval and executed as per provide designs and Bills of Quantities
- Provide photographic (before, ongoing, after) and reports including lesson learned.

Aweil, Torit, Yambio, and Bor. The COW submits the following documents at completion
of each milestone as deliverable for all the 4-site:
- Work progress reports
- Measurement sheet for actual works completed.
Payment:
Upon the submission of the above documents the contractors will be paid the
first milestones, and the COW will be paid the first deliverable.
2. Construction works supervision on the following sites: Aweil, Torit, Yambio, and Bor. Second delivarable expected in 48 - 96 working days
The COW submits the following documents at completion of each milestone as
deliverable for all the 4-site:
- Work progress reports
- Measured for actual works completed.
Payment:
Upon the submission of the above documents the contractors will be paid the
second milestones, and the COW will be paid the second deliverable.
3. Construction works supervision on the following sites: Third delivarable expected in 96 - 144 working days
Aweil, Torit, Yambio, and Bor. The COW submits the following documents
at completion of each milestone as
deliverable for all the 4-site:
- Work progress reports
- Measurement sheet for actual works completed.
Payment
Upon the submission of the above documents the contractors will be paid the
third milestones, and the COW will be paid the third deliverable.
Reporting for the Consultancy
The National Consultant to shall report to the UNDP Access to Justice, Security and Human Rights Programme Project Engineer.
Payments:
Payments shall be processed and paid after the submitted reports cleared and approved by the Project Engineer and Chief Technical advisor respectively. The reports shall be submitted at the time the milestones are due for payments.
Travel:
Domestic travel - travel to the selected locations, the payment of travel costs including tickets and living allowance will be paid by UNDP

Technical Skills:
- 4 years of contractor supervisory experience in construction/civil works.
- Knowledge of common recognized Civil Engineering Contract Conditions.

- Solid overall computer literacy, including proficiency in various MS Office and email/internet;
- Knowledge of AutoCAD and Arch Cad is an added advantage.
- Knowledge of MS project is an added advantage
- Accuracy and professionalism in document production and editing;
- Excellent interpersonal skills; culturally and socially sensitive; ability to work inclusively and collaboratively with a range of partners, including grassroots community members, religious and youth organizations, and authorities at different levels; familiarity with tools and approaches of communications for development;

Required Skills and Experience
Secondary Education, with an Ordinary diploma in civil engineering/Higher diploma in civil engineering/Bachelor degree in civil engineering is an added advantage or other related field.
Experience required:
- At least 5 years of practical field experience in construction works supervision for bachelor degree holders and 7 years’ experience for diploma holders. Experience in South Sudan is an added advantage.
- Ability to understand and clearly interpret construction/civil works specifications.
- Strong skills in maintain good relations with government counterparts.
- Excellent report writing skills.
- Ability and willingness to travel to selected States/Counties

Evaluation:
Applicants will be screened against qualifications and competencies specified below through a desk review or an interview process. Applicants will be evaluated based on: Cumulative analysis method that combines the results of technical and financial evaluation results
Technical Evaluation Criteria (maximum 70 points):
- A minimum of 5 years relevant professional experience construction engineering or other related field - 20 points
- Sound knowledge of practical field experience in construction works supervision of structures - 30 points
- Strong familiarity with the UN or UNDP rules and procedures - 5 points
- Strong skills in maintain good relations with government counterparts - 5 points
- Solid experience in the management of people and systems in high-pressure environments - 5 points
- Experience in the usage of computers and office software packages, MS project, and designing applications/ systems (AutoCAD and Arch CAD) - 5
Financial Evaluation Criteria (maximum 30 points):
