Background

The Office of the Attorney General was established under the repealed Constitution of 1968 and Law Officers Act of 1966 as the principal legal advisor to the Government of the Kingdom of Eswatini. The Constitution Act of 2005 further consolidates its power and functions which are; to draft and review legislation, to assist Ministers to pilot Bills in Parliament, draw or peruse agreements, contracts, international instruments and documents to which Government is party or has an interest, litigate in court or other legal proceedings on behalf of the Government and adds the new mandate of litigating on behalf of Chiefs in their official capacity.

The mandate and the need to implement the Constitution accelerated the momentous establishment of the Law Reform Unit under the Office of the Attorney General. This was to pave way towards an independent Law Reform Commission. The Law Reform Unit has commenced operations to advance the reform, develop and alignment of the laws of Eswatini with the Constitution.  Key challenges remain for the Office of Attorney General to fully realize its mandate in coordination with key partners, such as the Police Service, Judiciary, Public Service Sector bodies such as the Human Rights and Anti-corruption Commissions, Government Ministries and Departments, Traditional Authorities, University of Eswatini, Law Society and Civil Society Organizations.

A long-term strategy for the Office of the Attorney General has become necessary to align with modern legal developments and advance the common framework with an objective to -

  • Strengthen capacity, efficiency, and inter-institutional collaboration of the Office;
  •  Strengthen the independence of the Office of the Attorney General in performing its mandate;
  • Align the resource base of the Office of the Attorney General with the Strategic Plan, including developing staff capacities and streamlining financial resources towards its implementation.

Duties and Responsibilities

The consultant will be tasked with the following:

  • Assess and analyze the Office of the Attorney General’s internal and external environment, stakeholders and partnerships and synthesis of results and identify strategic opportunities.
  • Conduct a review of organizational documents, relating to the structure, staff, management, history, activities, projects and policies of the Office of Attorney General.
  • Undertake an evaluation of the Office of the Attorney General to determine whether the structures, systems and staffing are adequate to deliver on strategies and core functions.
  • Determine methodology for modernizing the legal service by improving productivity using IT systems, records management and performance management to contribute to enhanced service delivery.
  • Develop a Strategic Plan consisting of the following main sections:
    1. SWOT analysis (Visioning Exercise)
    2. Organizational structure
    3. Partnership and communication strategy
  • Develop an action plan as part of the strategy to facilitate implementation.
  • Develop a monitoring and evaluation plan to accompany the strategy to track its successful implementation.
  • Prepare a results framework with indicators and multi-year work plan with resource needs and estimated implementation budget that will be required to implement the strategy.
  • Facilitate two workshops (Planning and Validation) as part of the process of the development of the strategy.

The Consultant will be expected to deliver the following deliverables:

An inception report to include execution plan, by end of the 1st week of assignment

DURATION OF ASSIGNMENT, DUTY STATION AND EXPECTED PLACES OF TRAVEL

  • Duration:     30 working days spread over three months
  • Duty Station: Mbabane, Eswatini.  The Consultant will be expected to work under the guidance of the Office of the Attorney General on terms as may be authorised by the latter.
  • Travel: The Consultant will be expected to travel within the area or the duty station.

?PROVISION OF MONITORING AND PROGRESS CONTROLS

The Consultant will work under the authority and leadership of the Office of the Attorney General, report to the Ministry of Justice and Constitutional Affairs and will in turn periodically report to UNDP.

Required Skills and Experience

Education:

  • Master’s degree in Development Economics, or a Management, Business Administration; Human Resource Management Option, Law, Sociology or any other relevant development area.

Experience:

  • At least 10 years of relevant development experience especially in development planning, poverty reduction strategies/programmes, formulation and preparation and review of strategies.
  • Regional, continental and global experience will be an added advantage.

Language Requirement:

  • Proficiency in written and spoken English.
  • Proficiency in written and spoken SiSwati is an added advantage.
