Background

The European Neighbourhood Instrument set up to provide funding to the countries covered by the European Neighbourhood Policy, has as one of its primary objectives the promotion of human rights and fundamental freedoms, the rule of law, and principles of equality and non-discrimination, alongside the development of a thriving civil society in the region.

In line with the commitments in the field of human rights and democratization under the European Neighbourhood Policy and the Eastern Partnership, the Annual Action Programme 2014 under the European Neighbourhood Instrument (ENI) includes a programme aiming to strengthen civil society and increase citizens' participation in promoting human rights and fundamental freedoms to advance the democratic development of the country.

As part of this programme, UNDP was awarded a direct contract by EU with an overall objective to strengthen the role and capacities of civil society in Azerbaijan in the promotion and protection of human rights and fundamental freedoms. For this purpose, UNDP developed a project “Enabling civil society to play a greater role in advancing socio-economic rights of vulnerable populations“.

The overall objective of the project is to increase the role of the civil society in advancing socio-economic rights of vulnerable populations. The objectives of the project will be achieved through the delivery of the following Expected Results:

Estimated Result 1. Non-governmental organizations have been supported to utilize human-rights based approach in advancing the socio-economic rights of the vulnerable groups

Estimated Result 2: Community-based organizations have been supported to promote social inclusion of the vulnerable groups

Estimated Result 3: Non-governmental organizations have been supported to promote the issues of non-discrimination and equality.

The project targets non-governmental organizations working on the issues of socio-economic rights, non-discrimination and equality; and vulnerable groups (e.g. women, people with disabilities and other socially excluded groups, etc.). It will be implemented through the envisaged Activities under three inter-related Components:

Component 1:       Organisational Development Support to the Project partners

Component 2:      Support to viable models for advancing social inclusion and socio-economic rights of vulnerable groups

Component 3:       Non-discrimination and equality framework promotion

Duties and Responsibilities

HRBA Consultant will be responsible for providing a 2-day training to 12 local CSOs to deepen the participants’ practical understanding on human rights concepts at local, national and international levels, as well as enhance their ability to establish linkages between human rights issues and development and increase capacity to apply human rights based approach.

The training programme should be inter-active and combine theory with practical group exercise. Suggested topics to be covered in the training are the following:

-        Introduce participants to the rights-based approach to development;

-        Deepen participant’s understanding in the principles, practices and policies those underpin rights-based approach to development;

-        Provide information on international human rights sources, systems, standards and issues relevant to the work of the target group;

-        Expose participants to existing tools to facilitate the use of rights-based approaches in development planning, formulation, implementation, project/program monitoring evaluations; 

-        Increase partner understanding to engagement with rights holders;

-        Sensitize participants to their particular role in protecting and promoting human rights and their own potential for affecting human rights in their daily work;

Share the available guidelines on how to apply HRBA in the formulation, implementation, monitoring and assessment of programs.

Required Skills and Experience

Education:

- Master’s degree in Law, International Law or Human Rights Law or other relevant disciplines

Working experience:

·        Must have strong background in development with special focus on RBA;

·         At least 10 years of proven work experience on rule of law, justice, security and human rights related issues;

·        Must have conducted similar trainings previously;

·        Knowledge and understanding of UN(DP) work in human rights and democratic governance at large;

·        Experience in working as a consultant to the CSOs will be preferred;

·        Understanding the local context for operation of the CSOs in Azerbaijan will be an advantage;

Language requirements:

·        Proficiency (verbal and written) in the English language. Azerbaijani and/or Russian will be an advantage.

Individual consultant will be evaluated based on the following methodologies:

1.      Cumulative evaluation that takes into account both financial offer and the technical expertise of the potential candidates

A two-stage procedure will be utilized in evaluating the proposals, with evaluation of the technical component being completed prior to any price component being reviewed and compared.  The Price Component will be reviewed only for those individuals whose Technical Component meets the requirements for the assignment.  The total number of points which individual may obtain for both components is 100.

                                      A total possible value of the technical component is 100 points.

If the substantive presentation of a technical proposal achieves the minimum of 49 points, the competitiveness of the offered consultancy expenses will be taken into account in the following manner:               

The total amount of points for the fees component is 30. The maximum number of points shall be allotted to the lowest fees proposed that is compared among those invited individuals which obtain the threshold points in the evaluation of the technical proposal. All other proposals shall receive points in inverse proportion to the lowest fees; e.g;

                [30 Points] x [US$ lowest]/[US$ other] = points for other proposer’s fees

·        Master’s degree in Law, International Law or Human Rights Law or other relevant disciplines- 15 points

·        At least 10 years of proven work experience on rule of law, justice, security and human rights related issues – 15 points

·        Must have conducted similar trainings previously – 10 points

·        Knowledge and understanding of UN(DP) work in human rights and democratic governance at large – 10 points

·        Experience in working as a consultant to the CSOs will be preferred - 10 points

·        Approach to work10 points

The minimum threshold for technical part of the offers is 49 point.

TRAVEL

The assignment is planned to start on 12 December and continue for the end of February 2018, with up to 6 working days. The assignment will be combination of home -based work with one mission to Baku on 12th February and delivery of 2-day training planned on 14th and 15th of February. The payment will be a LUMP-SUM payment inclusive of consultancy fee, DSAs for in-country consultancy days, round-trip ticket and concomitant terminal expenses.

The consultant should take into consideration the DSA rates in the country based on UNDP rules (maximum 179 USD for Baku). Therefore, consultant can offer 179 or less for Baku where the assignment will take place.

Interested candidates, along with their technical proposal, will have to submit their financial proposal by taking into account those expected travels, and showing in their financial proposals breakdown of financial expenses.
