Historique

Malaysia is located between several resource rich maritime regions, in the Indian Ocean and South China Sea, connected by the Straits of Malacca and beyond to the Pacific Ocean. Malaysia has large hydrocarbon reserves and maintain several offshore oilfields. Economic growth factors in Malaysia is dependent on international trade which is primarily    dependent on secure sea lanes of communication. While the maritime region is resource rich it is also plagued with rampant illicit activity at sea. 

The Andaman sea off the western coastline is known for methamphetamine trafficking suspected to originate from northerly regions close to Myanmar. In addition, the flow of human smuggling activity also seems prevalent in the Anderman sea region. The Straits of Malacca has had a prolonged issue relating to armed robbery at sea. The efforts of Malaysia and neighbouring states of Indonesia and Singapore have resulted in an improved situation but it still remains a concern. In the Sarawak and Sabah regions, illicit logging and maritime transportation of wildlife and forestry products remain a serious concern.  In the Eastern coastal regions off the Sulu and Celebes Seas significant criminal enterprise remains active including maritime logistics in support of terrorism and kidnap for ransom. 

The UNODC GMCP has a strong reputation of delivering high quality and practical programming to improve the criminal justice response to maritime crime. UNODC GMCP provides capacity building and technical assistance along the criminal justice chain, from interdiction by maritime police, through investigation to the courts and prisons. GMCP advises on legislative frameworks, policies and facilitates national, regional and international cooperation. The Programme has developed expertise, tools and best practices including in the areas proposed in this project. 

The Malaysian Maritime Enforcement Agency (MMEA) is designated to conduct maritime law enforcement activities in the ocean space of Malaysia. The agency established in 2005 was strengthened with human resource and expertise from the Royal Malaysian Navy. As the MMEA develops into a fully-fledged enforcement agency there is a need to develop capacity and expertise within the agency and retain the manpower resources. 

Devoirs et responsabilités

The purpose of this assignment is work in close partnership with the Ministry of Home Affairs Malaysia and Malaysian Maritime Enforcement Agency (MMEA) and support the development of a Strategic Plan for MMEA towards policy guidance for future interventions by UNODC GMCP. The effort will be guided through consultative meetings on the development of the framework for the Strategic Plan, contrasting the current Strategic Plan available with MMEA. The conduct of a comprehensive threat assessment on maritime criminality across Malaysian waters covering Straits of Malacca, South China Sea and Sulu Celebes Sea. In light of the involvement of the Ministry of Home Affairs in this project, the assignment will also entail multi law enforcement agency consultative discussions within the ambit of the Ministry and maritime stakeholders to provide a holistic view of the Strategic Plan for MMEA. The Strategic Plan is to address interventions on organizational structures of the MMEA and examine the emerging maritime crime trends to determine best use of resources to effectively provide maritime law enforcement in Malaysia.  The assignment will further entail study visits to compare and contrast regional and International Coast Guards conducting such Strategic planning in light of future emerging trends. The necessary Secretariat and editorial support is to be managed in collating the multiple reports on the Strategic Plan to a comprehensive Report and is to be submitted to the Ministry of Home Affairs and MMEA. Based on the assignment, provide capacity building programmes and consultative discussions towards realising the Strategic Plan. 

Under the direct supervision of the GMCP Programme Coordinator (Southeast Asia and the Pacific) based in Bangkok, the Senior consultant will implement the following task:

Deliverable A : Prepare an Overall Plan of Action for the Drafting and Development of a White-paper on the Vision and Strategic Plan for MMEA for the next 10 years.

The MMEA which was established reflecting naval structures is required to conduct constabulary responsibilities. There is a need for a paradigm shift to fully incorporate the roles and responsibilities of a constabulary function shedding some of the naval ethos and character. This will require a vision and a planned approach of the core mission and responsibilities. The Senior consultant is expected to present the framework for the development of the Strategic Plan to provide a better understanding on time lines, human resource planning and operational requirements that will entail througout the assignment. The Senior consultant will provide a report to Ministry of Home Affairs and MMEA comprising of requests for timelines, staff and acsess to establishments.

The Senior consultant will also support the establishment and lead a Team of Experts with experience and expertise in maritime security and law enforcement that can support the consultative process and bring multiple perspectives for the future vision of MMEA. 

Deliverable B : Overal Suppervision and Guidence of the Study Realting to Mapping Maritime Criminality within the Waters of Malaysia

Provide overall supervision and guidance and to the Research Consultant contracted o conduct a study relating to mapping maritime criminality within waters of Malaysia, as a document that can feed to the discussion on the role and responsibilities of MMEA in the next 10 years. The understanding of the types of maritime criminality in Malaysia and future trends in maritime crime will be essential to develop the overall vision and mission of the MMEA. The senior consultant will support the research consultant to facilitate two consultative meetings that will bring together MMEA personnel, maritime stakeholder agencies, maritime law enforcement experts, academics, legal experts to discuss current and future trends in maritime crime in Malaysia.

Travel;

All envisaged travel costs must be included in the financial proposal. This includes all travel to join duty station/repatriation travel.  In general, UNDP should not accept travel costs exceeding those of an economy class ticket. Should the IC wish to travel on a higher class he/she should do so using their own resources.

In the case of unforeseeable travel, payment of travel costs including tickets, lodging and terminal expenses should be agreed upon, between the respective business unit and Individual Consultant, prior to travel and will be reimbursed

Compétences

• Planning and organisation skills is desirable. 
• Fluency in English and Malay is required.  

Qualifications et expériences requises

1. Academic Qualifications:

• A Master's degree in maritime law enforcement, international relations, or law, international maritime law, or project management, business management or relevant disciplines is required. A Bachelor’s degree in the same areas with four years of relevant professional experience may be accepted in lieu of the Master’s degree.

2. Years of experience:

• Minimum of ten (10) years of work experience as a senior officer in maritime law enforcement, coast guard, navy, or as a programme manager is required.
• Experience in the conduct of maritime operations, maritime interdictions at sea and regional maritime engagement is required
• Solid experience in the area of the conducting research on maritime issues and regional maritime topics are  desirable.
• Proven experience in engaging with counterparts will be an asset. 
• Experience in formulating development strategies and policies.
