Organizational Context

Over the past four years UNDP has provided support for both the Government of Indonesia (GoI) and Indonesian civil society to undertake activities that strengthen access to justice (A2J) in multiple ways.  Through the Legal Empowerment and Assistance for the Disadvantaged Project (LEAD), UNDP facilitated the GoI’s formation of the National Strategy on Access to Justice (NSA2J), launched by BAPPENAS in October 2009, and provided grants for NGOs to undertake a range of A2J activities in a number of provinces.  In Aceh province, UNDP has also provided timely and comprehensive access to justice support in the post-tsunami and post-conflict context under the Aceh Justice Project (AJP) by strengthening the institutional capacity of the both the formal and informal justice systems. Both LEAD and AJP projects have been implemented since 2007.

In 2011,  LEAD and AJP were completed, and a new project called “Strengthening Access to Justice in Indonesia” (SAJI), was introduced.   The SAJI project presents the continuation and expansion of these two UNDP projects, and will be geared towards improved access to justice for Indonesian citizens, contributing to the alleviation of poverty, good governance practices, and empowerment of disadvantaged, vulnerable, and marginalized people. 

In accordance with the Jakarta Commitment and the principle of supporting national priorities and policies, the SAJI Project will use the GoI’s National Strategy on Access to Justice (NSA2J) and other relevant Indonesian policy instruments as their guiding framework, which will therefore directly link the policy and local interventions such as the National Action Plan on Human Rights. SAJI will help realize Indonesia’s 2005-2025 Long Term Development Plan, which emphasizes that, consistent with its vision of “A Just Indonesia,” development is to be carried out from the people, by the people and for the people.
The Project

The SAJI Project is developed based on experiences, best practices, and lessons learned from the LEAD and AJP Projects. SAJI consists of the following components:

  • Institutional mechanisms, legal and regulatory framework, and capacities of government institutions strengthened to implement the recommendations and Action Plans of the National Strategy on Access to Justice. 
  • Improved public complaint and grievance handling mechanisms (PCMs) in government institutions at both national and subnational levels.
  • Improve people’s access to state-funded legal aid, particularly for women and vulnerable groups.
  • Improve people’s access to fair and accountable justice services in the community-based justice system.
  • Knowledge management to inform policies and initiatives to effectively strengthen access to justice and to contribute to Indonesian reporting on the implementation of human rights instruments

Portion of the first component will be implemented mainly through the extension of the LEAD Project the umbrella of the SAJI Project. While originally set to expire at the end of December 2011, both UNDP and BAPPENAS have agreed to extend the duration of the LEAD Project until the end of June 2013. This extension is aimed to ensure uninterrupted provision of support for the implementation of the National Strategy on Access to Justice, which was launched at the end of 2009.

Under the direct supervision of the Project Manager, and the close coordination with the National Project Director (NPD), National Strategy Mainstreaming Analyst assumes the responsibility to ensure accomplishment of all project actions/activities under this first component and strategic partnership with different stakeholders, including non government agencies and donors which have strategic links to accomplishment of goals stipulated under the National Strategy on Access to Justice (NSAJ).

Summary of Key Functions and Results Expected:

  • Ensure strategic direction of mainstreaming of the National Strategy on Access to Justice (NSAJ) both at the national (by ministries/agencies) and subnational levels.
  • Ensures effective implementation of all Project activities including those of implemented with the Access to Justice Secretariat as BAPPENAS’ vehicle to mobilize supports from and coordinate with the government and non-government institutions working on access to justice related issues.
  • Support the provision of top quality policy advice services to the ggovernment and facilitation of knowledge building that can inform innovative approaches towards effective implementation of the NSA2J and monitor the implementation progress of the National Strategy. 
  • Perform other related duties as required by the Project Manager  

As part of SAJI Project team, the NSAJ Mainstreaming Analyst  ensures the strategic direction ofthe mainstreaming of the NSAJ focusing on achievement of the following results:

  • Building and maintainance of close cooperative relationship with relevant stakeholders and partners at National and subNational levels including government and non government agencies, and other development partners.
  • Monitoring and analysis of current initiatives/activities being implemented by those relevant stakeholders which have strategic links to accomplishment of the NSAJ goals. 
  • Review on progress and/or possible gaps within the current initiatives.

Ensures effective implementation of Project activities under the NSAJ mainstreaming component focusing on achievement of the following results:

  • Solid analysis on the activities achievements, timely readjustment of activities as necessary to maximize impact of the SAJI’s supports towards the mainstreaming of the NSAJ into the ministries and sub-national agencies’ development plans.
  • Draft/revise Term of Reference (TOR) of all project activities implemented under the first project components.
  • Coordination and facilitation supports for the Access to Justice Secretariat that can increase their capacity to advocate relevant government agencies and ministries and coordinate on ongoing basis different stakeholders, including government ministries and agencies and selected local governments and non government agencies, and donors which have strategic links to accomplishment of the NSA2J goalsfor the NSA2J implementation.

Support the provision of top quality policy advice services to the government and facilitation of knowledge building focusing on achievement of the following results:

  • Strategic advice on roles and actions that BAPPENAS’ Directorate of Law and Human Rights, particularly the Access to Justice Secretariat should play to enhance the efforts of the NSAJ mainstreaming both at National and Sub-national levels. 
  • Identification and synthesis of best practices and lessons learnt directly linked to SAJI’s initiatives in supporting national and sub-national Governments in the mainstreaming of NSAJ into their development plans.
  • Sound contributions to knowledge networks and communities of practice on Access to Justice.
  • Substantial contribution into the UNDP Programme Team in producing reporting required under the UNDP internal Monitoring & Reporting (M&R) frameworks, and agreements with donor agencies and other key UNDP partners; and

Perform other related duties as required by the Project Manager that may involve other aspects of project work.

Impact of Results:

The key results have an impact on the overall performance to ensure the project achieves the intended objectives, and thereby contributes into outcomes prescribed under the Country Programme Action Plan (CPAP) which have mutually been agreed on between UNDP and the Government of Indonesia. The timely and quality of activities implementation with strong analysis on key achievements and lesson learned from the NSAJ mainstreaming efforts have direct impact on the success of the project, and the successful candidate will therefore be required to demonstrate their ability to support the Project planning, budgeting, implementation, monitoring, and reporting.

Qualifications et expériences requises

Education: 

  • Bachelor, or preferably Master Degree or equivalent in public policy, political science, public administration, economics, international relations, regional planning, law, other relevant discipline, or its equivalent

Experience: 

  • Minimum 6 years for Bachelor, or 2 years for Master Degree of progressive working experiences with Government agencies on justice related issues.
  • Research in human rights/justice and governance issues is an advantage
  • A network of contacts and familiarity in working with the government of Indonesia at the national and local levels is an advantage.
  • Experience using computers and office software packages and knowledge of spreadsheet and database packages.
  • Knowledge of the UNDP mandate and its program of activities is an advantage.
