Purpose
The purpose of the consultancy is to provide facilitation, analytical support and process guidance of the vision-setting consultation process related to the participatory defining and reaching consensus on the new role, status and functions of local communities / mjesne zajednice (MZs) in Bosnia and Herzegovina. In this regard, three Facilitators for Training of Trainers in Local Communities (hereinafter the Consultants) will be engaged.

Objective
The main objective of the consultancy will be to offer moderation support, overall guidance within the series of public consultations throughout Bosnia and Herzegovina, as well as concrete inputs to formulating the new vision for MZs in the country, based on the discussions’ outcomes and suggestions by participants.

Background Information
The Strengthening the Role of Local Communities (Mjesne Zajednice/MZs) in Bosnia and Herzegovina Project (2015 – 2019) is a joint initiative of the Government of Switzerland and the Government of Sweden, implemented by the United Nations Development Programme (UNDP) in Bosnia and Herzegovina.
The overall project objective is contribute to better quality of life of BiH citizens through increased democratic participation and accountability, enhanced local services and infrastructure and social inclusion. The chosen means to achieve this goal is through encouraging community-led local development and revitalising community government by MZs, as the places where government comes closest to the people and as grass-roots organisations that serve communities of around 1,000 people, with the possibility for real participation and joint action. The three specific project outcomes are:

  • Citizens and governments are committed to realise the jointly agreed upon new inclusive and gender-sensitive vision of MZs, as foundation for more participatory and accountable local governance in the country;
  • Pro-active, capacitated and inter-connected MZs contribute to downward responsiveness of local governments and improved service delivery;
  • A new regulatory framework for functional MZs developed by governments enables more inclusive, gender-sensitive and accountable local governance in Bosnia and Herzegovina.

The Project will work directly with approximately 120 MZs country-wide and 20 local governments.

 

Devoirs et responsabilités

This consultancy will contribute to achieving the first Project outcome, namely – „Citizens and governments are committed to realise the jointly agreed upon new inclusive and gender-sensitive vision of MZs in Bosnia and Herzegovina, as foundation for more participatory and accountable local governance in the country”.
The assignment needs to take into consideration that that there are 2,587 MZs in Bosnia and Herzegovina today, defined as areas within local governments. They vary greatly in their size and level of activity. In general, having in mind the varying legal status and functions prescribed by the relevant legal framework at both entities and Brcko District, MZs can be classified as semi-formal governance structures, existing and operating neither wholly in the public realm, nor fully in the informal. Hence, MZs in Bosnia and Herzegovina are not a formal tier of local government, and the closest they get to a formal decision-making role in government processes is in the Federation of Bosnia and Herzegovina, through the obligation to consult MZs in the development and adoption of zoning plans and in general issues of local matters of importance to the citizens. Therefore, MZs have the character of a community organisation which provides space and forums where citizens can come together to discuss issues, decide on strategies and formulate proposals on issues of local significance.
Also, the assignment needs to recognise that the prevailing types of MZs’ roles and functions include: i) providing liaison between citizens, local government and providers of public services such as roads, water, sewage, street lighting, waste collection, etc.; ii) functioning as a consultation mechanism between the local government and citizens, particularly in consultations related to budgets, spatial plans, capital investment plans, development strategies; iii) implementing local projects and initiatives funded by local government funds, local contributions, donor/non-governmental funding; iv) providing support to needy members of the community, through a combination of volunteering and cooperation with responsible services; v) organising social, cultural and sporting events with the local community.
However, while holding a strong potential to contribute to inclusive local development, MZs country-wide face numerous challenges – from limiting regulatory framework, to insufficient human, technical and operational capacity, or citizens’ fatigue and unwillingness to engage in community initiatives. These challenges were identified and analysed within two major studies conducted in the past 2 years, which shed a light and provided more in-depth information on the situation, role, challenges and potentials of MZs in Bosnia and Herzegovina: “Local Communities (MZs) in Bosnia and Herzegovina: Challenges and Prospects for Institutional Development”  and “Comparative Review and Assessment of Community Governance Models and Practices In Croatia, Serbia, Sweden and Switzerland with Bosnia And Herzegovina”.
Against this general background, the Project will launch a wide participatory process, which will aim to:

  • Encourage wide participatory discussion and debates on the future role of MZs in the country;
  • Present and jointly discuss current situation, good practices and challenges of MZs in the country;
  • Discuss, define and agree upon a common vision on MZs’ future role and functions.

The MZ assessments mentioned previously will serve as the main analytical inputs in the vision-setting process, offering rich information, practices and recommendations for the role, functions and the overall vision of contemporary MZs in Bosnia and Herzegovina.
The vision-setting process will be launched in May, 2016 and will last until late 2017. For its first stage planned for 2016, the process will initiate a series of discussion at MZ, local government and regional levels. It is expected that the key stakeholders to be engaged in this stage of the public discussion process are MZ representatives (MZ council members, MZ secretaries and representatives); local government representatives (councils/assemblies; mayors; municipal staff); citizens; civil society organisations and think-tanks; both entity Associations of Municipalities and Cities; academia and media.
Based on the results of this process, in 2017 the Project will further engage with relevant policy-makers and seek to jointly identify and agree upon concrete steps (a roadmap) necessary for gradual transformation of the vision into reality, including regulatory, educational, promotional and civic actions.
In this context, the scope of work for this consultancy will include solid facilitative and process-guidance support, including moderation of the public debates, summarising suggestions and embedding them into the emerging MZ vision, providing guidance on constructing the agenda and approach to leading the discussions and presenting relevant information and practices, all of which ultimately enables constructive, participatory and realistic shaping up of a new vision for the role, functions and responsibilities of MZs in the country.


More concretely, each task is described below:
Task 1: Conduct desk review of relevant materials and familiarise with the process framework and objectives

Under this task, the Consultants will:

  • Review and get acquainted with the project document and with the MZ assessments conducted by the Strengthening Local Commmunities MZ project”;
  • Get acquainted with the broader concept for the vision-setting process developed by the Project team, which outlines its objectives, main milestones and building blocks, relevant stakeholders, timeline, necessary inputs, approaches and tools, as well as expected results. The Consultants can provide their inputs and comments on the concept, prior to the actual launch of the processes;
  • Take part in introductory meeting with the Project team, so as to discuss and agree on details related to the process ahead and concrete next tasks and interim deadlines.

It is envisaged that this task will be finalised by early May, 2016 and the level of effort will not exceed 3 expert days / Consultant.

Task 2: Provide guidance, expert inputs and facilitation in the vision-setting process aiming to discuss, seek suggestions and enable joint shaping-up of a new MZ vision
The concrete responsibility of the Consultants during the vision-setting discussions will be as follows:

  • Based on the general concept, prepare the draft agenda, necessary support presentations for each of the public meetings, respecting the specifics of the envisaged participants and stage of the participatory process, suggest participants to be invited to the meetings, as well as anticipate any potential risks affiliated to the process. In performing this assignment, the Consultants will also propose concrete facilitation approach and tools enabling most productive and participatory debates;
  • Facilitate the meetings, present to stakeholders key findings and good practices, encourage discussions and concrete inputs and recommendations by participants, take note of all suggestions and feedback provided, as well as have a back-stopping role within the broader consultation process;
  • Summarise in written suggestions and feedback provided by participants for each discussion meeting and suggest how these can be merged into a single MZ vision.

In this stage, the Consultants will be responsible for facilitating and back-stopping the following number of public meetings planned:

The workload will be split between the Consultants – i.e. each Consultant will be responsible for facilitation and back-stopping of approximately 8 public meetings. This figure should also be the base for the Consultants’ financial offer, including daily fee, anticipated transportation costs and other, as relevant.
In all times, the Consultants need to work closely together, so as to ensure streamlined approaches, agendas and inputs to the vision-setting process.
The Consultant should note that all preparatory work (booking venues, inviting participants, confirming their participation, printing materials and covering costs for the events as necessary) for the public meetings will be done by the Project team.
It is envisaged that this task will be delivered during the period May - December, 2016 and the level of effort / Consultant will not exceed 30 expert days.
The concrete responsibility of the Consultants during the vision-setting discussions will be as follows:

Task 3: Provide  TOT on Facilitation skills to selected MZ 26 community facilitators

  • In consultation with UNDP project staff, hold 1 TOT on facilitation skills for at least 26 community facilitators in one or several locations (this will be determined at a later stage), to ensure that the trained community facilitators would be fully equipped to carry out similar facilitation processes independently.

  • As per the requirements of Task 2, 13 public discussions with local governments and MZs conceptualised, successfully facilitated and conclusions and recommendations summarised and embedded into a single emerging MZ vision (submitted and approved by UNDP);
  • As per the requirements of Task 2, 8 regional public discussions conceptualised, successfully facilitated and conclusions and recommendations summarised and embedded into a single MZ vision (submitted and approved by UNDP).  By the end of December, 2016,(26 expert days - Consultant)

Task 3: Provide  TOT on Facilitation skills to selected MZ 26 community facilitators

  • In consultation with UNDP project staff, hold 1 TOT on facilitation skills for at least 26 community facilitators, by the end of July, 2016. (2 expert days)

Qualifications et expériences requises

  • University degree in public administration, economics, law, political sciences, social sciences or related field;
  • At least 5 years of relevant experience in delivering trainings and training of trainers (ToT) in skills of facilitation, moderation, etc. in Bosnia and Herzegovina;
  • Previous concrete work at MZ level in the country is considered an unique asset;
  • Proven skills and previous experience in facilitation of public consultative policy development processes in Bosnia and Herzegovina, engaging a diverse set of public, non-governmental and civic participants;
  • Proven communication and advocacy skills, and ability to work in an environment requiring liaison and collaboration with multiple actors including government representatives, donors and other stakeholders;
  • Proven analytical skills and ability to conceptualise and write concisely and clearly;
  • Facilitators’ certificate will be considered as asset;
  • Excellent expertise in the area of adult learning;
  • Excellent communication and group-facilitation skills;
  • Fluency in English and in the official languages in Bosnia and Herzegovina;
  • Excellent computer skills (MS Office applications) and ability to use information technologies as a tool and resource.
