Purpose
The purpose of this consultancy is to provide technical advice and guidance in the design of the Methodology for Development Planning in the Federation of Bosnia and Herzegovina (FBiH), including entity, cantonal and local government levels. The Methodology is seen as a by-law document of the draft Law on Development Planning and Management in the FBiH. For this purpose, a Strategic Planning Methodological Guidelines Consultant (hereinafter the Consultant) will be engaged.

Objective
The main objective of the consultancy will be to design the Methodology for Development Planning in the FBiH, which will explain the processes of design of development strategies at the FBH, cantonal and local levels. The Methodology, as part of the package of by-law documents to reinforce the application of the draft Law on Development Planning and Management in the FBiH, will serve as the standardised methodological framework for strategic planning in the FBiH.

Background Information
The consultancy is planned within the 2nd phase of the Integrated Local Development Project (ILDP), which aims to support the further consolidation of the local strategic planning system in Bosnia and Herzegovina, by enhancing its vertical integration within the higher government strategic and financial planning frameworks and supporting a critical mass of local governments to apply a harmonised approach to strategic planning and effectively manage local development processes in partnership with their communities. Planned activities are designed around two inter-connected components, as follows:

  • support to vertical integration of the local strategic planning system into the strategic planning frameworks of higher government levels;
  • support to integrated and participatory local strategic planning and management and strengthening of development partnerships.


Project support was launched in 2008. By 2010, based on intensive participatory process engaging policy-makers from state, entity, cantonal and local levels of government, the ILDP succeeded to design a standardised methodology for integrated and participatory creation of local development strategies. The Methodology was adopted by both entity Governments and recommended for application by all local governments in Bosnia and Herzegovina. In the absence of any legal, institutional or methodological framework in this area, this methodology served as a blueprint for local strategic planning country-wide. By applying a harmonised approach for local planning within nearly 50% of local governments country-wide, the ILDP has set in place the foundations for a modernized local planning system.
Furthermore, in 2012 the ILDP launched first attempts to facilitate the design of a harmonised approach to cantonal development planning. This methodology has been subsequently transferred at the cantonal level, with 9 (out of 10 cantons) having their integrated cantonal strategies adopted.
Moreover, the project continued to facilitate policy dialogue towards further consolidation and vertical harmonisation of strategic planning efforts, respectively in each entity. Within the FBiH, the formally designated Policy Working Group developed and agreed on the general vision and elements of a future entity strategic planning system, considering entity, cantonal and local government levels. Importantly, having in mind the lack of relevant legal framework regulating strategic planning, this process gave an impetus to the initiative of creating a principal law at the level of the FBiH to govern the future development planning and management system. The draft Law on Development Planning and Management in the FBiH  is now in the final process of discussion, expected to be enforced by the end of 2016. It envisages, among other relevant by-laws, the creation of standardised methodological guidelines for strategic planning at FBiH, cantonal and local levels, in line with the general principles embedded in the draft Law. In relation to that, this consultancy is expected to provide substantive assistance in the process of drafting of the Methodological guidelines, based on the existing methodological instructions for the local and cantonal government levels, and as per the principal requirements of the draft Law on Development Planning and Management in the FBiH.
The ILDP is a joint initiative of the Government of Switzerland and UNDP in BiH, implemented in partnership with the BiH Ministry of Human Rights and Refugees, the FBiH Ministry of Justice, the RS Ministry of Administration and Local Self-Government and both Associations of Municipalities and Cities.

Scope of work
This consultancy will contribute to the successful implementation of the first Project component, namely – „Support to vertical integration of the local strategic planning system into the strategic planning frameworks of higher government levels”.
The lead institutional partner in the process of participatory design of the Methodology for Development Planning – the FBiH Development Planning Institute - will form and steer an inter-institutional Working Group (comprising representatives from entity, cantonal and local government levels) mandated to contribute to the design of the Methodology for Development Planning. Therefore, the Consultant is expected to support the work of the Working Group, transform the ideas and guidance into the draft Methodology for Development Planning. In other words, the Consultant will draft the Methodology based on conceptual inputs by the Working Group. Moreover, the Consultant will support the substantive preparation of the working sessions of the Working Group, including transfer of good strategic planning methodological practices and examples. In doing so, the Consultant will bring relevant experiences from the European Union planning practice. It is expected that the Working Group will have 2 –3 meetings during the period September – November, 2016; during these meetings members will discuss and agree on the concept and details of the Methodology, supported and guided by the Consultant.
Against the previously described background and scope of work, the Consultant needs to take into consideration the following key documents, seen as the backbone for the final deliverable of this consultancy. Specifically, these are:

  • the draft Law on Development Planning and Management in the FBiH;
  • the standardised Methodology for Local Development Planning in Bosnia and Herzegovina;
  • the standardised methodology for cantonal development planning;
  • the general roadmap for the Working Group which is the intra-institutional structure steering the process and eventually provide comments and suggestions for its improvement.

Ultimately, the Consultant is expected to draft a single document, in a form of a by-law document (decree, methodological guidelines or similar), which describes the purpose, principles, terminology, approach, process, structure and timeframe of development strategies, including integrated and sectoral strategies at entity and cantonal levels, as well as integrated local development strategies, as posted by the draft Law on Development Planning and Management in the FBiH.
 
More specifically, the consultancy will comprise the following main tasks:
Task 1: Conduct desk review of relevant materials and propose a structure for the by-law document
Under this task, the Consultant will:

  • Review and get acquainted with all relevant materials (to be provided by the project team);
  • Based on briefing and inputs from the project team and lead institutional partners, the Consultant will design a general structure for the by-law document, including brief explanatory note for each building block. This general draft will be presented and discussed during the first meeting of the Working Group.

It is envisaged that this task will be delivered by early September 2016 and the level of effort will not exceed 4 expert days.

Task 2: Provide guidance and expert inputs to the work of the Working Group
Once the broader policy-discussion process is launched under the auspices of the FBiH Development Planning Institute (in September, 2016), the Consultant is expected to take part in the generally envisaged up to 3 workshop/events in Bosnia and Herzegovina (Sarajevo), contribute to preparing the subject matters to be presented and discussed during the meetings; present to stakeholders applicable best practices from European Union context; present the emerging sections of the Methodology; offer expert guidance to the Working Group and have a back-stopping role within the design process. 
It is envisaged that this task will be delivered by the end of November 2016 and the level of effort will not exceed 8 expert days.

Task 3: Based on inputs of the Working Group, design the Methodology for Development Planning in the FBiH
Under this task, the Consultant will design the Methodology for Development planning in the FBiH in the form of a by-law. In general terms, the content of the by-law document will cover (but may not be limited to): 

  • Main definitions (terminology, particularly with regard to planning levels in strategies);
  • Overall review of the planning system in the FBiH;
  • Main principles of the development planning at all government levels in the FBiH;
  • Overview of the broader strategic development directions of BiH and of the EU for the programming period;
  • Design of the FBiH development strategy (preparation for the planning process: timeline, steps, responsibilities, etc.; description of the strategy structure and the planning process, including design of the situation analysis, SWOT, vision, strategic objectives, priorities; responsibilities, steps, timeline; horizontal and vertical alignment and coordination; participatory process and public consultations; linkage with spatial documentation; indicative financial framework; linkage with the budget and public investment planning process; adoption of the strategy, etc.);
  • Design of the FBiH sectoral strategies (preparation for the planning process: timeline, steps, responsibilities, etc.; description of the strategy structure and planning process, including design of the situation analysis, SWOT, vision, strategic objectives, priorities; responsibilities, steps, timeline; horizontal and vertical alignment and coordination; participatory process and public consultations; linkage with spatial documentation; indicative financial framework; monitoring and evaluation; 3-year implementation plan; linkage with the budget and public investment planning process; adoption of the strategy, etc.);
  • Design of the cantonal development strategies (preparation for the planning process: timeline, steps, responsibilities, etc.; description of the strategy structure and the planning process, including design of the situation analysis, SWOT, vision, strategic objectives, priorities; responsibilities, steps, timeline; horizontal and vertical alignment and coordination; participatory process and public consultations; linkage with spatial documentation; indicative financial framework; monitoring and evaluation; 3-year implementation plan; linkage with the budget and public investment planning process; adoption of the strategy, etc.);
  • Design of the cantonal sectoral strategies (preparation for the planning process: timeline, steps, responsibilities, etc.; description of the strategy structure and planning process, including design of the situation analysis, SWOT, vision, strategic objectives, priorities; responsibilities, steps, timeline; horizontal and vertical alignment and coordination; participatory process and public consultations; linkage with spatial documentation; indicative financial framework; monitoring and evaluation; 3-year implementation plan; linkage with the budget and public investment planning process; adoption of the strategy, etc.);
  • Design of the local development strategies (preparation for the planning process: timeline, steps, responsibilities, etc.; description of the strategy structure and the planning process, including design of the situation analysis, SWOT, vision, strategic objectives, priorities; responsibilities, steps, timeline; horizontal and vertical alignment and coordination; participatory process and public consultations; linkage with spatial documentation; indicative financial framework; monitoring and evaluation; 3-year implementation plan; linkage with the budget and public investment planning process; adoption of the strategy, etc.).
  • Annexes

In the course of conducting the assessment, the Consultant is expected to work in close cooperation and interaction with the ILDP team, as well as with lead relevant institutions engaged in the process. The main trends, principles and experiences from the strategic planning principles and frameworks within the European Union will be considered and embedded in the Methodology to the maximum extent possible.
It is envisaged that this task will be delivered during the period August - end of November 2016 and the level of effort will not exceed 14 expert days.

Deliverables and timelines
The Consultant is responsible for the following deliverables:

Task 1: Conduct desk review of relevant materials and propose a structure for the by-law document

  • A proposed draft structure for the by-law is designed by the Consultant and approved by the project team and key institutions. By early September, 2016 (4 expert days);

Task 2: Provide guidance and expert inputs to the work of the Working Group

  • Expert guidance and back-stopping is provided in the process of conceptual preparation of approximately 3 meetings of the Working Group tasked to contribute to the development of the Methodology for Development Planning in the FBiH. By the end of November, 2016 (8 expert days);

Task 3: Based on inputs of the Working Group, design the Methodology for Development Planning in the FBiH

  • A comprehensive Methodology for Development Planning in the FBiH in the form of a by-law is developed by the Consultant and approved by the Project team and the Working Group. By the end of November, 2016 (14 expert days).

Qualifications et expériences requises

Education

  • Advanced university degree in public administration, economics, law, political sciences, social sciences or related field;

Experience

  • At least 7 years of relevant experience in the field of development planning in European Union countries; knowledge of the planning practices in Bosnia and Herzegovina is considered an asset;
  • Previous experience in drafting methodologies and instructions in the area of development planning, in a technical assistance context, is required;
  • Previous experience in design of legal/by-law documents is an asset;
  • Proven analytical skills and ability to conceptualise and write concisely and clearly.

Language requirements

  • Fluency in the official languages in Bosnia and Herzegovina is required;

Other

  • Excellent computer skills (MS Office applications) and ability to use information technologies as a tool and resource;

Award Criteria

  • Desk review process. The award will be based on the highest qualified consultant;

Payments modality

  • Payments will be made only upon confirmation of UNDP on delivering on the contract obligations in a satisfactory manner;

  • Financial proposal indicating lump sum for the assignment (lump sum includes fee as well as all other costs that might occur such as international travel, stationary, accommodation and other similar costs.

Note

  • For an assignment requiring travel, consultants of 62 years or more require full medical examination and statement of fitness to  work to engage in the consultancy;
