The UNDP Access to Justice and Rule of Law project (A2J/RoL) aims to support national priorities in line with the UN country team Interim Cooperation Framework (ICF). Aligned to the ICF is the UNDP Country Programme Document (CPD) Outcome 3, Peace and Governance strengthened. This outcome emanates from the Output supporting the strengthening of rule of law institutions to deliver accountable, effective and equitable justice services. In this regard, the project supports the priorities of the rule of law institutions (Judiciary of South Sudan, Ministry of Justice and Constitutional Affairs, South Sudan National Police Service, National Prison Service of South Sudan, and Local Government Board).

The strategic objectives of the project are to (i) increase access to justice through coordinated institutional presence at state and county levels; (ii) reduce case backlog; (iii) support mechanisms to address prolonged and arbitrary detention; (iv) support policy framework for the harmonization of the administration of traditional justice mechanisms with the formal justice sector and (v) support capacity development and institutional strengthening.

On 17 and 26 August 2015, the leadership of the ruling Sudan People's Liberation Movement (SPLM) party and Sudan People's Liberation Movement-in-Opposition (SPLM-IO) signed the Agreement on the Resolution of Conflict in the Republic of South Sudan (ARCSS), signaling an attempt to bring an end to a conflict which erupted on 15 December 2013. Chapter V of the ARCSS provides for transitional justice, accountability, reconciliation and healing. The agreement provides for the establishment of a Hybrid Court for South Sudan (HCSS); Commission for Truth Reconciliation and Healing (CTRH) and Compensation and Reparations Authority (CRA). Due consideration is given to the use of traditional mechanisms of conflict resolution. However, implementation of the ARCSS remains largely stalled, and the Inter-Governmental Agency on Development (IGAD) has instituted a High Level Revitalization Forum (HLRF) to ensure that the peace process regains traction.
The UNDP Access to Justice and Rule of Law project provides support for transitional justice initiatives in South Sudan. This includes supporting civil society organizations (CSOs) to conduct advocacy, awareness raising and support the implementation of the ARCSS and transitional justice process at national and state level. To strengthen its support, the project intends to partner with a consultant to conduct a comprehensive mapping of civil society organizations transitional justice and peace building initiatives in South Sudan at the national and state level to document experiences, categorize them; assess capabilities and identify capacity-building and training needs.

The overall purpose of the consultancy is to provide a proper on-site documentation of transitional justice and peace building initiatives conducted by UNDP supported and other CSOs, at the national and state level and to document experiences, categorize them; assess capabilities; and identify capacity-building and training needs. This is intended to strengthen transitional justice initiatives of CSOs and other institutions in order to promote peace and reconciliation mechanisms in accordance with the peace agreement and acceptable international standards.

Objectives
The main objective of the consultancy is to map civil society organizations transitional justice and peace building initiatives for strengthening the agreed transitional justice mechanisms and promote peace and reconciliation in keeping with the ARCSS.
More particularly, the consultancy will:

• Provide a clear mapping of CSOs at the national and state levels;
• Provide a comprehensive assessment of CSOs and their capabilities;
• Document the experiences gathered from CSOs transitional justice and peace building initiatives;
• Categorize CSOs according to their transitional justice initiatives and experiences gathered;
• Identify capacity-building and training needs.

Devoirs et responsabilités

Scope of Service:
The consultant will work in close cooperation with civil society organizations and UNDP.
To achieve the objectives of the consultancy, the consultant will:

  • Develop an inception report containing a detailed work plan, detail the firm/consultant’s understanding of the assignment and present a detailed methodology;
  • Develop a work plan to guide the conduct and implementation of the assignment;
  • Conduct inception meetings with civil society organizations;
  • Conduct regular field visits and monitor civil society organizations transitional justice and peace building initiatives in Juba, Aweil, Aweil East, and Lol states;
  • Conduct assessment meetings, workshops, discussions, etc. with CSOs;
  • Organize a validation workshop to present outcome of activities to the relevant stake holders;
  • Produce deliverables in accordance with the requirements and timeframes of the Terms of Reference;

Deliverables:

The consultant will produce the following deliverables:

Total 45 days

 Inception report:

  • The inception report should detail the consultant’s understanding of the assignment, and present a detailed methodology. This should also include a refined work plan with clear timelines, detailing key deliverables. The inception report will be submitted to UNDP and the consultant will receive feedback and hold consultations with CSOs;
  • Mapping of civil society organizations Transitional Justice initiatives;
  • Map available civil society organizations transitional justice initiatives Juba, Aweil, Aweil East and Lol states. The mapping should also include a comprehensive information on the locations of each civil society organization and the specific initiatives each is undertaking.

Assessing civil society organizations capabilities:

  • The consultant should conduct thorough assessment of each civil society organization to determine their capabilities to perform the anticipated tasks. This should also include assessing successes, gaps and challenges;
  • Identifying capacity-building and training needs;
  • The consultant should identify capacity-building and training needs of civil society organizations or other relevant actors involve in transitional justice initiatives. This should include specific needs of each civil society organization and specific needs of each location where transitional justice initiatives are ongoing.

Finalization of consultancy report

  • The consultant should submit a final report of the consultancy in detailed and good quality;
  • Contracts will be output-based and payment issued only upon approval of satisfactory deliverables.

Qualifications et expériences requises

Education:

  • Degree in social sciences, human rights or law.

Experience:

  • Practical experience of not less than 7 years documenting transitional justice or human rights;
  • In-depth knowledge of civil society organizations and community consultations, awareness-raising, truth-telling processes and truth commissions;
  • Demonstrated practical experiences in development of guidance notes, training manuals and/or toolkits;
  • Demonstrated experience in working with a variety of stakeholders;
  • Basic gender understanding, skills, experience and commitment;
  • Experience working in a hardship and conflict/post-conflict environment an asset;
  • Previous experience of human rights documentation in South Sudan will be an advantage;

Language:

  • Fluency in spoken and writing English;
  • Knowledge of Arabic language is an advantage.
