UN Women, grounded on the vision of equality enshrined in the Charter of the United Nations, works for the elimination of discrimination against women and girls; the empowerment of women; and the achievement of equality between women and men as partners and beneficiaries of development, human rights, humanitarian action and peace and security. Placing women's rights at the centre of all its efforts, UN Women leads and coordinates United Nations system efforts to ensure that commitments on gender equality and gender mainstreaming translate into action throughout the world. It provides strong and coherent leadership in support of Member States' priorities and efforts, building effective partnerships with civil society and other relevant actors.

Albanian has made important steps in the area of gender equality and end of violence against women. The country is party to key human rights treaties including the Convention for the Elimination of all Forms of Discrimination against Women (CEDAW) and the Council of Europe Convention on preventing and combating violence against women and domestic violence (Istanbul Convention).

International treaties and recommendations of human rights mechanisms play a key role in guiding Albania and other states in their efforts to ensure gender equality and fight all forms of violence against women. In this context, CEDAW is one of the key instruments, which requires all states parties to periodically submit reports on the steps that have taken to implement its provisions - a procedure which promotes compliance with the obligations contained in the Convention. Albania submitted its latest report in 2016 and the Committee issued its Concluding Observations in July 2016.  An important part of any periodic report is reporting back to the Committee on concrete measures taken to implement the Concluding Observations of the previous report. While the Concluding Observations of July 2016 have set the due date for the fifth periodic report in 2020, four recommendations were selected by the Committee requiring follow-up information within two years (2018). All these four recommendations relate to ending violence against women and girl and discrimination against women. (13/b, 13/d,23/a, 23/d). 

In addition, in 2014, Albania underwent the second cycle of the Universal Periodical Review (UPR) - a process that involves a review, every 4 years, of the human rights records of all UN Member States by the UN Human Rights Council. Many of the UPR recommendations addressed to Albania relate to gender equality and violence against women. In this context, the Ministry of Foreign Affairs of Albania with the support of UN Women, and UNFPA developed a Human Rights Action Plan and Tracking Mechanism to facilitate the monitoring process of the implementation of the UPR recommendations by relevant State authorities, including those related to discrimination and violence against women. Albania is expected to undergo its third UPR review cycle in 2019 and a national report will be submitted to the UN Human Rights Council in February 2019 while submissions/contributions by civil society, national human rights institutions (NHRIs) and the UN are expected starting from September 2018. The national report on UPR will be developed with the support of other UN Agencies, including UN Women.

The purpose of this consultancy is to provide technical support to the Ministry for Europe and Foreign Affairs (MEFA) - the institution in charge of preparing and reporting to human rights bodies, on the drafting process of the CEDAW follow-up report. In addition, the consultant is expected to provide feedback and contribution to the drafting process of UPR National Report with regards to areas related to gender equality and ending violence against women as well as to prepare gender-related inputs to the UN Country Team report for the 3rd periodic review

Devoirs et responsabilités

Under the overall supervision of UN Women Albania and in close collaboration with the Ministry for Europe and Foreign Affairs, with respect to the first task the consultant will be responsible to: 

  • Prepare a consultancy workplan (in Albanian and English) to be agreed with MEFA and UN Women including the final methodology for preparing the CEDAW follow up report;
  • Desk review of existing reports prepared by the government, independent institutions, international organisations and CSOs on the areas related to the four recommendations of the CEDAW committee to which Albania is required to report;
  • Conduct interviews and support the MEFA to organize consultative meetings with key informants in government institutions, the parliament as well as with relevant civil society organisations and groups of interest to inform the reporting process to CEDAW;
  • Review, analyse and summarise the written information to be provided by the state institutions as well as the independent institutions;
  • Prepare the draft report in English and Albanian for review by UN Women and MEFA;
  • Prepare the final report based on comments and feedback from UN Women and MSWY (in English and Albanian);
  • Submit a consultancy report and time-sheet (in English) on the overall work conducted.

Under direct supervision of UN Women and collaboration with the UN Gender Thematic Result Group (GTRG) with respect to the second task, the consultant will be responsible to:

  • Prepare a workplan (in English) to be agreed with UN Women for preparing the gender-related inputs to the UNCT report;
  • Desk review of existing reports prepared by the UN Agencies on the areas related to the four recommendations of the CEDAW committee to which Albania is required to report;
  • Prepare the draft inputs as per the UNCT report format in English for review by UN Women and the GTRG;
  • Conduct interviews and joint meeting with GRTG members to get in-depth information and validate the draft inputs;  
  • Prepare the final report based on comments and feedback from UN Women and GTRG (in English);
  • Submit a time-sheet and final deliverables for the work conducted under this task.

Under direct supervision of UN Women and collaboration with MEFA and other UN agencies with respect to the third task, the consultant will be responsible to:

  • Provide advice on the areas/issues related to gender equality and gender based violence to be included in the UPR National Report;
  • Desk review of existing reports prepared by the government, independent institutions, international organisations and CSOs on the areas related to the areas/issues identified to be included in the UPR report.
  • Support the MEFA and collaborate with other experts engaged by other UN agencies to organize consultative meetings with key informants in government institutions as well as with relevant civil society organisations and groups of interest to inform the reporting process on the UPR;
  • Review, analyse and summarise the written information to be provided by the state institutions as well as the independent institutions;
  • Contribute to the drafting sections on gender equality and violence against women in the draft report in English and Albanian for review by UN Women and MEFA;
  • Submit a consultancy report and time-sheet (in English) on the overall work conducted.

Accountability Deliverables

First Task (CEDAW follow up report):

  • Workplan for carrying out the work, including for the two following tasks agreed with MEFA and UN Women (1 working day)
  • Minuts of meetings with stakeholders and consultative sessions (3 working days)
  • First draft follow-up report and final report in English and Albanian (10 working days)

Second Task (Gender inputs for the UNCT report for the UPR):

  • Minutes of meetings with GTRG members and other UN Agencies staff (3 working days)
  • First draft and final inputs in English to the UNCT report for the UPR (5 working days)

Third Task (National UPR Report):

  • Minutes of meetings with stakeholders and consultative sessions ( 1 working day)
  • First draft and final contribution to the UPR Report on sessions related to gender equality and ending violence against women  (6 working days);
  • Final consultancy report for both tasks  in English (1 working day)

Duration of the Work

The consultant will be contracted for a maximum of 30 (thirty) working days during 11 June 2018 until December 7th, 2018.

Qualifications et expériences requises

Qualifications/Education

Master’s Degree in Law, Human Rights, Gender Equality, International Development

Work Experience

  • At least 10 years of experience as a legal, human rights expert in the areas of gender-based violence, gender discrimination at the national and international levels;
  • Proved experience in writing research reports, legal analyses and assessments;
  • Proved experience in engaging with international human rights treaty bodies with a focus on women’s rights and gender equality.
  • Previous professional experience with the United Nations or other international organizations is an asset.

Language requirement

  • Proficiency in written and spoken English and Albanian, including gender and policy terminology; and excellent drafting and presentation skills.

Scope of Price Proposal and Schedule of Payments:

Financial proposal specifying the total monthly lumpsum in Albanian Lek for the tasks (30 working days).

Please note that the financial proposal is all-inclusive and shall take into account various expenses incurred by the consultant/contractor during the contract period (e.g. fee and any other relevant expenses related to the performance of services). Other travel costs different from the above will be covered by UN Women separately.

Payment will be made as per the payment schedule in the contract upon (i) satisfactory completion of tasks; (ii) provision of deliverables specified in the ToRs; (iii) submission of and approval of final draft; and (iv) submission of the respective invoice.

Evaluation of applicants:

Candidates will be evaluated using a cumulative analysis method taking into consideration the combination of the applicants’ qualifications and financial proposal. Contract will be awarded to the individual consultant whose offer has been evaluated and determined as:

Responsive/compliant/acceptable; and

Having received the highest score out of below defined technical and financial criteria.

Applications will be assessed according to the following Technical Criteria:                      

  • Master’s Degree in Law, Human Rights, Gender Equality, International Development (10 points);
  • 10 (Ten) years of experience as a legal, human rights expert in the areas of gender-based violence, gender discrimination at the national and international levels (25 points);
  • Experience in writing research reports, legal analyses and assessments (15 points);
  • Experience in engaging with international human rights treaty bodies with a focus on women’s rights and gender equality (15 points);
  • Previous professional experience with the United Nations or other international organizations (5 points)

Only candidates obtaining a minimum of 70% (49 points) in the technical evaluation would be considered for financial evaluation.

The maximum number of points assigned to the financial proposal is 30 %, 30 points are allocated to the lowest price proposal. All other price proposals receive points in inverse proportion. The calculation formula applied is as follow:

p = 30 (µ/z); where: p = points for the financial proposal being evaluated; µ = price of the lowest priced proposal; z = price of the proposal being evaluated.
