Purpose
The UNDP requires technical expertise for the development of the draft Law on heat energy of the Federation of BiH, in agreement with representatives of the Ministry of Energy, Mining and Industry of the Federation of Bosnia and Herzegovina. Consultant will also manage communication with all key stakeholders, who will be equally able to express their views and expert opinions, share lessons learned and direct the different thematic areas of the project towards successful and efficient implementation of Project activities.

Objective
Expected result of the assignment is fully developed draft Law on heat energy in the Federation of Bosnia and Herzegovina. The Assignment will be delivered through coordinated and participative approach which will include close cooperation with institutions that are members of the project working group, and other relevant partners.

Background Information
The key objective of the project “Biomass Energy for Employment and Energy Security – Follow Up Project”, directly implemented by UNDP BiH, is contribution to the improvement of local population living standard by long term reduction of the CO2 emissions. Domestic benefits, among other things, include employment generation, GHG emission reduction, economic development of micro regions, contribution to BiH’s EU accession.

Since 2009, UNDP Energy and Environment portfolio in BiH includes a number of projects that contribute to environmentally sustainable development and use of natural resources. This project is, among others, aimed at increasing the wood biomass demand, improving biomass supply, overcoming technical, legislative and awareness barriers and enhancing research on these issues throughout BiH.

Project activities are designed in order to lead to stronger partnerships, networking and supporting schemes within the private, public and government sectors.

Devoirs et responsabilités

National Consultant for development of draft Law on heat energy in the Federation of Bosnia and Herzegovina will work under direct supervision of the Project Manager and under coordination of the representatives of the Ministry of Energy, Mining and Industry of the Federation of Bosnia and Herzegovina (who will approve and confirm the quality of outputs) to complete all activities specified in this Terms of Reference.

The Consultant will be responsible for following:

  • Desk review of existing policies and plans for national, FBiH and sectoral development, related to heat energy, heat energy production and energy efficiency, and gather data as required. This exercise is aimed at examining the existing policy framework, relevant for the development of draft Law on heat energy.
  • The Consultant will meet with institutions that are members of the project working group (relevant Federal and Cantonal ministries, municipalities and other relevant stakeholders) to discuss the implementation plan, to get relevant feedbacks crucial for the development of the Law (minimum: Initial meeting, the draft of the document and the final document).
  • Develop a draft document. Based on the tasks given above, the Consultant will develop a draft document of Law on heat energy. This should be a consultative process from start to end; with representatives of responsible institutions from the level of FBiH that are members of the project working group. The draft Law on heat energy will be subjected to stakeholder consultations and will be adjusted based on inputs and comments received.
  • Finalize document;
  • Participate in Public Hearing and adjust the final document based on inputs and comments received.

It is envisaged that the level of effort for these tasks will not exceed 40 expert days including potential field visits to relevant institutions across FBiH, as needed. The assignment will not require presence in the UNDP premises. The assignment will include regular consultation/clarification meetings in the UNDP Sarajevo office or premises of Ministry of Energy, Mining and Industry of the Federation of Bosnia and Herzegovina.

Qualifications et expériences requises


Academic Qualifications/Education

  • Minimum of a Masters’ degree in technical sciences, preferably a combination of academic experience in both Mechanical engineering and Law fields.

Experience

  • Minimum 10 years of professional experience;
  • At least 7 years of experience in conducting research and providing consultancy services related to institutional, legislative and strategic frameworks (experience in development of relevant studies, reports, strategic documents in the segment of energy market would be an asset);
  • Experience in data collection and thorough identification of documents for at least 4 different projects (experience from B&H preferred);
  • Senior energy expert working experience and references;
  • Prior work experience with UNDP/UN Agencies would be an advantage;
  • Working experience with public authorities and international institutions in BiH;

Languages Requirements

  • • Knowledge of B/H/S languages is a must;
  • • Knowledge of English language is a must.

Other Requirements

  • Excellent organizational, time management and facilitation skills;
  • Excellent communication with stakeholders;


Technical evaluation criteria

Final Evaluation

The final evaluation score will be based on Combined Scoring Method where technical evaluation will be weighted a maximum of 70% and combined with the financial offer which will be weighted a maximum of 30%.

Evaluation

Individual consultants will be evaluated based on the following methodology:
Only candidates obtaining a minimum of 60 points would be considered for the Technical Evaluation
Cumulative analysis

When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:
a) responsive/compliant/acceptable, and
b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

Applicants are required to submit an application including:

  • Proposal:

- Explaining why they are the most suitable for the work;
- Provide a brief methodology on how they will approach and conduct the work; or sample of previous document/strategy/paper done by the consultant

 

Lump sum contracts
The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in installments or upon completion of the entire contract). Payments are based upon output, i.e. upon delivery of the services specified in the TOR.  In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount (including travel, per diem, and number of anticipated working days).

Travel;
All envisaged travel costs must be included in the financial proposal.
