Historique

The Kosovo Judicial Council (KJC) and the Kosovo Prosecutorial Council (KPC) are responsible for ensuring the independence and impartiality of the judiciary. In 2018, the satisfaction level with the work Kosovo’s key judicial institutions has decreased (UNDP Public Pulse 2018). Moreover, there is slow progress in implementing the council’s strategic and action plans. The European Commission has noted that Kosovo lacks a comprehensive strategy for the justice sector reforms and a proper mechanism for interinstitutional coordination.
The UNDP’s “Enhanced Access to Justice and RoL Reform in Kosovo” project aims to support the justice sector reform and improve the functioning of judiciary, and people’s access to justice, by strengthening the capacities of justice institutions to deliver on their objectives and priorities. For this reason, UNDP seeks to support KJC and KPC in the development of secondary legislation, implementation of its Strategic Plans to maximize the accountability, professionalism and efficiency of the judiciary.

Objectives of Assignment
Support the improvement of administration of justice through technical/legal support and legal framework of justice and functioning of the judiciary.

Devoirs et responsabilités

Under the overall supervision by the Project Manager, and direct supervisor of the KPC and KJC, the legal consultants are required to:

  • Provide Advisory support to KJC/KPC in identifying challenges and priorities, and draft concrete measures to address them;
  • Provide advisory support to the KJC’s and KPC’s Secretariats to initiate the drafting of the secondary legislation deriving from the amended Law on KJC, Law on KPC, and Law on Courts;
  • Provide advisory support to the KJC/KPC on the implementation of the regulations and action plans related to enhancing the performance of the judiciary;
  • Analyze the extent to which alternative judicial procedures are being applied by Basic Courts and Prosecution Offices based on data from KPC/KJC, and draft concrete measure for improvement (where necessary);
  • Provide substantive inputs to the working group on drafting the new Strategic Plan and Action Plan;
  • Provide advice to the KJC/KPC senior management on obligations derived from the European Integration agenda;
  • Support the coordination of activities and identification of synergies among justice institutions.

Expected Deliverables/ Outputs

  • Report on challenge and priorities of KJC and KPC with associated recommendations
  • Secondary legislation (4 regulations) identified and drafted
  • Report highlighting the application of alternative judicial procedures and recommendation for improvement
  • Draft Strategic Plans developed
  • Draft Action Plans developed
  • Final assignment progress report

Remuneration - Lump Sum Amount

The budget for the assignment will be presented as a lump sum.
Payment is made upon confirmation of deliverables by the Rule of Law Project Manager:
15% by the delivery, and approval of the first deliverable;
15% by the delivery, and approval of the second deliverable;
20% by the delivery, and approval of the third deliverable;
20% by the delivery, and approval of the fourth deliverable;
15% by the delivery, and approval of the fifth deliverable;
15% by the delivery, and approval of the final deliverable

Recommended Presentation of Offer

The following documents are required to be submitted:

  • Letter of Confirmation of Interest and Availability;
  • P.11 and personal CV, indicating all past experiences from similar projects, as well as the contact details (email and telephone number) of the Candidate and at least three (3) professional references;
  • Brief description of why the individual considers him/herself as the most suitable for the assignment
  • Financial Proposal that indicates the all-inclusive fixed total contract price supported by a breakdown of costs per deliverables.

Criteria for Selection of the Best Offer
Combined Scoring method – where the qualifications and the interview scoring will be weighted a max. of 70%, and combined with the price offer which will be weighted a max of 30%;

Qualifications et expériences requises

Education:

  • Master’s Degree in Law.

Experience:

  • Minimum of five (5) years of professional experience in the justice and rule of law sector;
  • Experience in developing strategic plans for central institutions, development partners and donors, and other stakeholders;
  • Practical experience in legal drafting;
  • Excellent reporting and writing skills;
  • Ability to advocate and provide policy advice.

Language:

  • Excellent Albanian and English language skills (both written and oral). Good knowledge of Serbian will be an asset.
