Historique

Human rights and development are inextricably linked and they both aim at promoting well-being and freedom, based on the inherent dignity and equality of all people. The 2030 Agenda for Sustainable Development, and its implementation framework the Sustainable Development Goals (SDGs) represent a transformative and comprehensive framework for development that also gives priority to democratic governance, rule of law and access to justice, in addition to a whole range of social, economic and environmental objectives. The SDGs cover human rights issues related to both economic, social and cultural rights as well as civil and political rights. More than 90 % of the SDG targets are linked to international human rights and labour standards[1]. Malaysia has shown a high degree of commitment to achieving the 2030 Agenda and SDGs, as evidenced in the 11th Malaysia Plan (11 MP) and the Mid-term Review of the 11 MP.

The United Nations in Malaysia plans to embark on a project to map human rights related recommendations coming out of the various human rights mechanisms that Malaysia is engaged with - to SDG goals, targets and indicators and assist Government in developing a suitable and effective matrix for monitoring purposes. This is anticipated to create a more coordinated approach in the fulfilment of the Malaysia’s human rights obligations through a developmental lens. This developmental approach would make human rights more relatable to the different development-centric ministries and agencies that are also focal points for the implementation of the recommendations coming out of the various human rights mechanisms. 

The recommendations will be derived primarily for Malaysia’s 3rd Universal Periodic Review and where relevant it could also be derived from treaty bodies and special procedures mechanisms further to discussion with relevant Government ministries.

The main objective of this project is to support the government to put in place a structured mechanism that could more effectively and systematically manage and monitor the progress of implementation of the recommendations emerging from the Universal Periodic Review and where relevant from other human rights mechanisms in tandem with the SDGs and national priorities.

The project will see the involvement of the Ministry of Foreign Affairs (as the lead agency) in close cooperation with relevant ministries, UN agencies and other key stakeholders such as the Human Rights Commission of Malaysia (SUHAKAM), civil society and private sector organisations.

Devoirs et responsabilités

The role and responsibilities of the consultant engaged will be as follows:

 

 

 

 

 

 

  1. To further develop a matrix (a preliminary draft template has already been developed)  containing recommendations from Malaysia’s 3rd Universal Periodic Review and other relevant human rights mechanisms and treaties – to be thematically clustered, and mapped in detail to SDG goals, targets and indicators as well as to other human rights related indicators (to be developed), with clear responsibilities linked to the agencies and stakeholders involved in the implementation of the recommendations in line with Government’s international commitments and national priorities as outlined in the Mid-term Review of the Eleventh Malaysia Plan: New Priorities and Emphases and Malaysia’s SDG Roadmap.
  2. To develop a clear workplan and timeline consisting of phases for the project in consultation with the RCO, UNCT and the Ministry of Foreign Affairs (MFA) - that will constitute the Inception Report for this project.
  3. To consult relevant stakeholders and to obtain their inputs through a series of workshops, consultative sessions and/or questionnaires; and to present the concept and periodically update on the progress of the project to Government, the United Nations Country Team and other stakeholders as needed.
  4. To review relevant international best practices and to work together with the Office of the UN High Commissioner for Human Rights (OHCHR) in developing suitable human rights indicators for a more effective monitoring, evaluation and reporting process.
  5. To prepare a Strategy Paper on Human Rights and Development (of not more than 20-pages) by 15 July 2019 for the 12th Malaysia Plan.
  6. To facilitate the development of action plans for the implementation of recommendations based on thematic human rights and development areas, with a clear timeline and corresponding human rights indicators.
  7. To develop an implementation, monitoring and evaluation/follow-up mechanism based on international best practices, including the establishment of a multi-stakeholder oversight team to promote inclusivity for an effective implementation of the recommendations.
  8. To work closely with the Ministry of Foreign Affairs and the UN Resident Coordinator’s Office in undertaking the aforesaid tasks.

 

 

Deliverables:  

  • A matrix containing recommendations of human rights mechanisms based on clusters, the agencies and stakeholders involved in the implementation of the recommendations and mapping of the recommendations vis-à-vis the SDG goals, targets and indicators and relevant national efforts and/or programmes.
  • A Strategy Paper for the 12th Malaysia Plan, based on the matrix developed above (no more than 20-pages)
  • Indicators to benchmark the implementation of respective human rights recommendations.
  • A proposed implementation, monitoring and evaluation/foolow-up mechanism for the implementation of the human rights recommendations.
  • Organisation of a series of workshops/briefings as deemed necessary by the Ministry of Foreign Affairs of Malaysia and UNCT involving the participation of government agencies and relevant civil society organisations (CSOs).
  • Communications materials, including taking points to disseminate information about the project to the public.

 

Duration:

The assignment is expected to be carried out from 1 July 2019 to  30 June 2020.

Price Proposal and Schedule of Payments:

The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables. The financial proposal should include a breakdown of this lump sum amount (including all related costs such as travel costs, per diem etc.).   Payments are subject to submission of deliverables duly approved by the Head of the UN Resident Coordinator’s Office.

Note: The Consultant will not be responsible for the cost of workshops as it relates to venue and refreshments and therefore, need not be added in the financial proposal.

Qualifications et expériences requises

  • At least a master’s degree and/or a minimum of 7 years’ experience in a relevant field(s) such as in the area of public policy, advocacy, development studies, international law, human rights, development or other related fields.

When using this weighted scoring method, the award of the contract should be made to the individuals whose offer has been evaluated and determined as:

a) responsive/compliant/acceptable, and

b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.
