UNDP is the development arm of the United Nations system, with offices in 180 countries. Globally, the organization employs 17,000 people and manages a budget of USD 5 billion each year.

The UNDP office in Skopje employs a team of 65 and currently manages a portfolio of projects in environmental protection, good governance and social inclusion worth USD 15 million per year.

UNDP is seeking a national consultant specialized in Criminal Law and treatment of inmates within the penitentiary-correctional institutions to conduct an assessment of current state of activities related to the training and educational opportunities offered to people serving prison sentences in the country and provide recommendations, based on the existing practices and country context on the sustainable models to be of use to country’s policy makers.

Prison system remains week, despite progress made in the area with number of measures adopted on re-socialization of convicted persons. A Risk Assessment Manual was produced with EU funded project’s support, identifying risks and the needs of prison inmates. Numerous training activities for prison staff took place also. The implementation of a large-scale project to rebuild prisons continues after the successful completion of the prison Kumanovo which is up to EU standards. Comprehensive national strategy for the prison system was developed and adopted. However, the administrative capacity of the Directorate for Execution of Sanctions (DES) and the penitentiary institutions remains weak. Specialized treatment programmes for vulnerable groups have yet to be put into practice, as well as vocational, educational and other rehabilitation activities for inmates which are currently inadequate.

Cooperation with Ministry of Education and Science (MES) and Directorate for Execution of Sanction (DES) and UNDP started in 2014 and foresees provision of technical assistance for introduction of vocation trainings to inmates for faster re-socialization and their better inclusion at the labor market. In addition, creation of educational opportunities for completion of the primary education were also part of the initiative.

Vocational trainings started in 2016 with constant increase of the number of involved inmates, but also penitentiary-correctional institutions where trainings were delivered. Currently the fourth cycle of trainings was finalized, with 95 inmates involved from 4 prisons- Prison Ship, Prison Kumanovo, Prison Skopje, Prison Idrizovo- Male and Female Ward. So far 233 inmates (40 of which female inmates) complete vocational trainings and obtained certificates for “baker”, “cook”, “locksmith”, “hairdresser”, “carpenter”, “auto-machination” and “argon welder”.

UNDP believes in actions that will break the vicious cycle of low educational levels and social exclusion and will increase the equity and accessibility of the labour market. By drawing policy recommendations and/or guidance notes on the key inmates’ treatment -related principles, as well as principles of re-socialization and integration in society, better conditions and results can be ensured.

Objective of the Assignment

The overall aim of this consultancy is to support the UNDP in analyzing undertaken activities and introduced vocational trainings in penitentiary-correctional institutions and how these activities contributed to the ex-inmates’ re-socialization and integration in society. In addition, as part of the assignment its will be required to propose further actions so to secured and organized, if not improve, the existing system and approach of the involved institution. The consultant is expected to review the current policy setting, and by exploring, provide recommendation on possible models for education and trainings of inmates, as well as post-penalty assistance. In doing so, the bottlenecks in the related field will be identified and policy recommendations and/or guidance notes on the issues will be drawn. Also, researching the current situation with the VET trainings provide to inmates, can bring up challenges faced by the all involved parties, including training providers, prison managements and ex-inmates.

Scope of Work

The methodology of work will consist of desk review of relevant project documentation and direct consultations with the project team and other key local stakeholders involved during the assignment. Guidance material will be provided by UNDP and will include, but not be limited to the following:

• Project Document “Creating Job Opportunities for All-III”
• Internal analysis of the undertaken trainings and achieved results

The consultant should take the following elements into account for the gathering and analysis of data:

• Desk review of relevant documents for this assignment
• Discussion with the following focus groups:

(1) focus group of prison management staff (app. 10 people)

(2) focus group of training providers, and

(3) focus groups of inmates that have undergone trainings subdivided on (a) ex-inmates and their families (b) inmates still serving their sentences and c) employers of ex-inmates, if available.

EXPECTED OUTPUTS AND DELIVERABLES:

The consultancy is expected to deliver the following outputs:

Institutional arrangment

The consultant will work under direct supervision by the UNDP Social Inclusion Unit Staff. He/she will be in regular communication with the supervisor through e-mail and will provide regular progress reports on bi-weekly basis. All communication and reports will need to be prepared in English language. UNDP Social Inclusion Unit Staff estimated lead time to review outputs, give comments, certify approval/acceptance of outputs, etc. shall be within 5 working days

In course of performing his/her job, the consultant will need to meet with the Ministry of Education and Science, Ministry of Labour and Social Policy and Directorate for Execution of Sanction. The list of institutions can be expended upon the agreement of both parties i.e. the Consultant and UNDP. The UNDP office will assist with scheduling these meetings.

Duration of the Work

The assignment shall commence on 10th of June 2019 and the tasks should be completed latest by 30th of July 2019.

Duty station and travel

Total estimated time for this assignment is 10 working days. At least three days will be used for the and discussions with national institutions and with focus groups.

If unforeseen travel is requested by UNDP and not required by the Terms of References (ToR), such travel shall be covered by UNDP in line with applicable rules and regulations and upon prior written agreement.

Qualifications et expériences requises

The selected candidates shall possess:

• Advanced university degree in law, social science, and related areas;
• Minimum 5 years of progressively responsible relevant experience in related fields of law, social science and related areas;
• Record of participation in at least 2 assignments of similar size and degree of complexity, such as participation in designing services for inmates, preparation and/or analysis of inmates’ treatment etc.;
• Experience in developing and implementation of projects/ programmes/activities in the area of law, social science, education or related topics;
• Record of involvement or/and participation in national/ international bodies or/ and associations dealing with the inmates’ rights and status shall be considered asset;
• Excellent writing and oral communication skills in English.

CRITERIA FOR SELECTION OF BEST OFFERR

The award of the contract shall be made to the offeror whose offer has been evaluated and determined using Cumulative analysis methodology. When using this weighted scoring method, the award of the contract will be made to the consultant whose offer has been evaluated and determined as:

a) Being responsive/compliant/acceptable, and

b) Having received the highest score based on the following weight of technical and financial criteria for solicitation as per the schedule below:

* Technical criteria weight: 70%

* Financial criteria weight: 30%

Only candidates obtaining a minimum of 49 points (70%) in the technical evaluation shall be considered for the financial evaluation.

For the considered offers in the financial evaluation only, the lowest price offer will receive 30 points. The other offers will receive points in relation to the lowest offer, based on the following formula: (Pn / Pl) * 30 where Pn is the financial offer being evaluated and Pl is the lowest financial offer received.
