Financed by the Government of Switzerland and implemented by the United Nations Development Programme (UNDP), the Municipal Environmental and Economic Governance (MEG) Project is an intervention in the domain of local governance in Bosnia and Herzegovina. The Project’s overall goal is defined as follows: Local governments (LGs), assigned with appropriate competences and finances, have improved their democratic governance, apply sound public policy and performance management systems, and provide public services in an inclusive, effective and efficient manner, particularly those related to economic and environmental sectors. The expected concrete improvements the Project will contribute to are clustered in three outcomes, as follows:

  • Outcome 1: Supported local governments apply effective development management systems characterized by stronger oversight of the legislative and greater accountability towards the citizens.
  • Outcome 2: Citizens and businesses in target localities benefit from good quality services provided by LGs in the economic and environmental sectors.
  • Outcome 3: Improved regulatory framework at higher and local government levels and pro-active networking accelerate sector-specific reforms and enable more effective local public service delivery.

The Project’s territorial focus is on the North-West part of the country (including Una-Sana Canton and Prijedor region) and the North-East region (the wider Doboj-Tuzla area), covering 18 partner LGs: Bihac, Bosanska Krupa, Cazin, Doboj, Gracanica, Gradacac, Gradiška, Kalesija, Kostajnica, Kozarska Dubica, Prijedor, Prnjavor, Sanski Most, Tešanj, Teslic, Tuzla, Velika Kladuša and Žepce.

The Project is implemented in partnership with the Ministry of Foreign Trade and Economic Relations of Bosnia and Herzegovina, the Ministry of Development, Entrepreneurship and Crafts of the Federation of Bosnia and Herzegovina (FBiH), the FBiH Ministry of Agriculture, Water Management and Forestry, the Ministry for Administration and Local Self-Government of Republika Srpska (RS), the RS Ministry of Agriculture, Forestry and Water Management and both entity Associations of Municipalities and Cities (AMCs).

Although the Law on Tourism in Una-Sana Canton (the Law) was adopted in 2017, a need for its improvement has already emerged, especially after initiatives raised by local governments (LGs) on the territory of Una-Sana Canton (USC) and the USC Assembly. A practice of implementation of the Law has shown that this peace of legislation needs a significant improvement in order to meet great expectations from expanding tourism, as one of the most important strategic sectors in USC.       

Ministry of Economy of Una-Sana Canton (the Ministry) has started activities related to preparing amendments to the Law and addressed the MEG Project to provide technical assistance in this process. In order to provide support in these reform efforts that are very important for the USC Government, the MEG Project will engage a Consultant for strengthening legislation on tourism in Una-Sana Canton (the Consultant), who will provide expert assistance in the process of preparing and adoption of necessary legislative changes.

The purpose of this consultancy is to provide technical assistance and expert support to the Ministry in reforming the legislation governing matters in the sector of tourism in USC.      

The objective of this consultancy is to assist in preparation of a new Cantonal Law on tourism and accompanying by-laws, as well as to provide technical assistance in the process of its adoption.  

Devoirs et responsabilités

The Consultant will initially conduct an analysis of the existing regulations, problems in their practical implementation and provide full support in preparation of all necessary legislative amendments in the sector of tourism. After that, the Consultant will provide support to the Ministry in the process of adoption of the Law.  

The entire service will be delivered in the languages of BiH peoples. The expected timeframe for delivery of the service is September - December 2019.

More specifically, the Consultant will be expected to perform the following tasks:

Task 1 – Analysis, consultations and support in preparation of legislation

The Consultant will initially review current cantonal regulations in the field of tourism, as well as other relevant documents with the aim to examine affecting issues in practical application of these regulations. The Ministry will provide the Consultant with all the necessary documentation at the initial stage of analysis.

In order to gather as much information as possible about the problems in implementation of relevant legislation, the Consultant will also conduct interviews and consultations with all relevant stakeholders. These consultations will include interviews with at least representatives of the Ministry, LG representatives from USC and local business community. Before conducting interviews, the Consultant will determine the list of interviewees and discussion questions in cooperation with the Ministry and the MEG Project.

After the initial stage of analysis and consultations, the Consultant will provide expert support in the preparation of draft amendments to the Law (or a new law if decided so by the Ministry) and, if necessary, required secondary legislation (by-laws, rulebooks, statutes etc.) necessary for the immediate and effective application of the Law once adopted. This support will include work in close cooperation with representatives of the USC Government and a working group formed to prepare the draft Law. The Consultant will ensure that the support in legislative drafting is in line with the relevant rules governing the process and methods for developing rules and regulations.

Depending on the needs and procedures, expert support can include preparation of guidelines for drafting the Law, preparation of the first working version of the Law, participation at the meetings of the working group, incorporation of comments in the draft Law, etc.  

When needed, the Consultant is expected to travel to Bihac in order to attend meetings of the working group, other meetings where the draft Law is discussed, presentations, and the like. The Consultant will perform all activities and deliver required outputs in constant coordination with the MEG Project.

It is envisaged that this task will be delivered by the end of October 2019 and the level of effort will not exceed 15 expert days.

Task 2 – Support in the process of adoption   

Once the draft law is prepared, the Consultant will provide his/her professional support in the process of adoption by the USC Government and Assembly. As and when needed, the Consultant will be available for public hearings, presentations of proposed legal solutions to decision-makers, support in preparing answers to received comments, and other similar occasions and assignments during the process of adoption of the draft Law by the executive and legislative branch of power in USC.

It is envisaged that this task will be delivered by the mid-December 2019 and the level of effort will not exceed 10 expert days.

  • Professional experience in development and implementation of regulations/public policies in the field of tourism or related fields will be considered as an advantage;  
  • Experience and knowledge of public policies and relevant regulatory framework in BiH on local self-government and matters related to local economic development;
  • Proven analytical and presentation skills and ability to conceptualize and write concisely and clearly.

Languages Requirements:

  • Fluency in official Bosnia and Herzegovina languages, and in English.

Other Requirements:

Cumulative analysis
