Antecedentes

The objective of the “Removing Barriers to increase investment in Energy Efficiency in Public Buildings in Ukraine” (EEPB) Project is to enable transformation of market for investments in EE in public buildings in the country, by  using Energy Service Company (ESCO) modality, utilizing Energy Performance Contract (EPC),  facilitated by introducing a single nationwide energy management information systems (EMIS) for Ukraine.

The Technical Advisor on Energy Management and Energy Monitoring (TA) will assist the project team to ensure that Ukrainian legislation and policies are updated and improved with regards to energy efficiency in public buildings, focusing on support for the introduction of minimum energy performance standards (MEPs) and on a multi-year budgeting for energy efficiency in public buildings. The advisor will also assist with designing, developing, and implementing a nationwide energy management system for energy management in public buildings in Ukraine. The system is expected to provide support for the development of a national buildings database for all public buildings in Ukraine, as well as design and implementation of a comprehensive nationwide energy management information system (EMIS), possibly building upon the highly successful UNDP experience in introducing and EMIS in other countries in the region, e.g. Croatia on an earlier UNDP GEF project. The main point to note is that Ukraine currently does not have any institutionalized nationwide system for collection of data, related to energy consumption in public buildings, and there is neither a nationwide national buildings database for energy consumption nor nationwide energy management information systems.

The TA shall work with the UNDP GEF EEPB project team to raise awareness of the Ukrainian government on the importance of energy management as a tool for improvement of energy efficiency in public buildings. In other countries, UNDP has successfully lobbied for the appointment (and training) of regional energy managers which is a positive step forward in the direction of improved energy management in public buildings. Similarly, in Ukraine this project can and should lobby the government and work with the UNDP project manager and project team to support governmental decisions regarding the fully responsible and capacitated state agency, responsible for monitoring and enforcement of the energy savings and CO2 emission reductions in public buildings through EMIS with an approved annual budget to carry out this function. This state agency will then be responsible for developing, maintaining, and updating the national buildings database and the nationwide energy management information system.

The EEPB project has four main outcomes, which are as follows:

Component 1: Formulation and introduction of a streamlined and comprehensive legal/regulatory, and policy framework for promoting energy efficiency in public buildings.

Component 2: Promotion of private investment in energy efficiency in public buildings through appropriate catalytic financial incentives.

Component 3: Demonstration of the implementation of EPC modality for energy efficiency initiatives in public buildings in different cities/municipalities.

Component 4: Establishment and operationalization of a National Energy Management and Information (NEMIS) and a NEMIS Database.

The Technical Advisor to be hired under this ToR will be responsible for the support on component 1 and component 4 of the project. Additional support will be required for the Technical Working Group (TWG) – a governmental consultative platform aimed at developing and implementation of strategy of introducing a nation-wide EMIS (NEMIS).

The Technical Advisor on energy management and energy monitoring in public buildings in Ukraine will be responsible for providing technical inputs for the smooth implementation of the Project activities, focusing primarily on full support for activities under component 1 and component 4 of the project. In addition, under component 2 and component 3, which involve the establishment of a financial support mechanism and implementation of pilot demonstration projects using the ESCO modality and through the signing of EPC contracts, the TA on energy management and energy monitoring should be available and willing to review and provide comments on work in this area if and as requested by the Project Manager.  

Deberes y responsabilidades

Under the supervision of the project manager and under the guidance of the Chief Technical Advisor of Energy and Environment portfolio CTA, the TA on energy management and energy monitoring will have the following duties and outputs to be achieved:

Outcome 1 Consistent effective enforcement of a streamlined and comprehensive policy, legal and regulatory frameworks to promote and support energy efficiency in public buildings. .

• Support the preparation and adoption of a draft law or a government decree, such as “On energy-efficiency in buildings” to include mandatory energy management reporting in all public buildings.
• Support the development of an inventory & database and energy monitoring and management system put in place for all public buildings in Ukraine. This may include support for the transfer of the energy management information system (EMIS) developed by UNDP in Croatia to Russia, if found feasible.
• Support the preparation of Terms of Reference to make sure that there are at least 20 completed automatic energy monitoring systems in public buildings carried out under the project within 12 months of the assignment (working with advisor on ESCO).
• Prepare and complete a review and cost-efficiency analysis of all energy audits and automatic and manual energy monitoring systems carried out by the project shortly after the completion.

Outcome 2: Outcome 2: Increased availability of, and access to, financing for EE and EM initiatives in public buildings in cities and municipalities.

• Advise on best international practices applicable in Ukraine on sustainable financing for regular monitoring of energy efficiency in public buildings through adoption and implementation of a National Energy Management and Information System (NEMIS)

Outcome 3: Demonstration of the implementation of EPC modality for energy efficiency initiatives in public buildings in different cities/municipalities.

• Advise on capacity development of designated Energy Managers to monitor energy use in public buildings through EMIS and propose/implement necessary energy efficiency measures.
• Review and provide an expert opinion of the energy management and monitoring aspects of completed energy audits
• Contribute to formulation of task and programmes of capacity development workshops and seminars for energy managers.

Outcome 4: Improved capacity and capability of city/municipality governments in energy monitoring and reporting, energy management and energy efficiency in public buildings.

• Provide capacity building and expert support as well as lobbying for the governmental to ensure  that there is a fully responsible and capacitated state agency with a responsibility to monitor and enforce the energy savings and CO2 emission reductions in public buildings through EMIS and with approved annual budget to carry out this function. This includes support for writing the draft decision document and for preparing related supporting documentation, as required.
• Formulate and proposed recommendations on an approved national energy audit (EE certification) program for promoting larger number of energy audits of public buildings within approved governmental budgets.
• Develop and contribute to the publication of public awareness raising materials and completed nation-wide awareness and information campaign advocating the benefits of energy efficiency measures in public buildings (including contributions to the project website).
• Support the development of an agreed methodology and sustainable institutional arrangements for annual monitoring of energy efficiency in public buildings through adoption and implementation of a National Energy Management and Information System (NEMIS).
• Support and participate in national and international conferences on energy efficiency in public buildings in Ukraine.

General project assistance:  

• Assist the PM in the preparation of PIR report, Annual Work Plans (AWPs), Budgets as well as formalizing the activities s.

• Assist the PM in the designing of an appropriate Monitoring, Evaluation and Learning Framework; and develop suitable monitoring tools for the project activities (both baseline and incremental) that link to the log frame’s indicators, end of the year target, means of verification,  risks and assumptions, including advising on the implementation of such tools.
• Assist the PM in the designing and implementation of appropriate scheme to track the implementation of co-financed activities of the project and the amount of committed co-financing that have been realized.
• Provide annual evaluation of the  extent by which the barriers that the EEPB Project is supposed to remove have been achieved.

• Provide necessary technical inputs to the members of the team.
• Prepare and submit progress and analytical reports.

The Consultant shall conduct at least six missions (6 missions of minimum 5 working days) to Ukraine. The mission objective and duration can be discussed and agreed with the Project Manager and UNDP in Ukraine taking into the account COVID-19 situation.

Deliverables

The Technical Advisor shall prepare short bi-monthly reports (once per two months, e.g. six report annually) to summarize work carried out and outputs provided to fulfil abovementioned tasks by him/her during that 2-month period with suggestions about his/her activities for the following two-month period that should be considered by project managers. The major reports prepared by the TA should be attached to each of the bi-monthly reports. By the end of the assignment, she/he shall prepare a final report summarizing what has been achieved and what remains to be achieved over the lifetime of the project. In particular, the reports should cover the outcomes and recommendations on the following topics, but not limited to:

• Discussion document with recommendations on the development of an inventory and database for energy monitoring and management (Report #1 – Updated EMIS Strategy for Ukraine).
• Transfer of best international practices in establishing national energy monitoring and management system, including software and know-how’s (Report #2 – International Best Practice on Energy Management).
• Support of development, adaptation and improvement of EMIS software in close collaboration with IT Consultants, experts, officials, NGOs, as well as with designated IT company, if such will be selected  (Report #3 – Recommendations on Improvements to EMIS software).
• Preparation of draft government decision about Ukraine having a fully capacitated state agency (such as SAEE) responsible for monitoring and enforcement of the energy savings and CO2 emission reductions in public buildings through the development of a national database of energy consumption in all public buildings and EMIS with an approved annual budget to carry out this function (Report #4 – Draft Governmental Decision).
• Support for an approved plan and general timeframe and Road map for implementing energy management in Ukraine (Report #5 – Detailed Road Map for EMIS for Ukraine).
• Support for the development of a communication strategy and plan, which requires all involved employees to generate feedback and commit to the goals set in the energy policy (Report #6 – Communications Strategy for EMIS).

Monitoring/Reporting Requirements

All reports prepared by the Technical Advisor should be submitted to the UNDP Project Manager and to UNDP Ukraine.

Experience and Qualifications Requirements

• Advanced (at least Master’s) degree in Engineering, Environmental Studies, Architecture, Economics, Business, Law or similar.
• Minimum 5 years of relevant experience of policy advisory level (advisory/development/professional/managerial services) and project implementation (expert work) with policy on energy efficiency building consultancy.
• Minimum 5 years of relevant experience of advisory/development/professional/managerial services or expert work with policy on energy management systems and/or experience in energy technologies, i.e., building sector including in energy efficiency in buildings, integrated building design approach, and energy management information systems experience. Experience with EMIS will be an advantage.
• Minimum 5 years of experience of advisory services to government and/or public/international organizations in program/project design for institutional strengthening and/or capacity building and/or needs assessment in the related regulations/policies/market mechanisms including EU regulations and familiarity with EU work in area of energy efficiency in buildings.
• Previous experience with energy efficiency related issues in the Europe & CIS region including relevant experience of drafting, editing, and producing written proposals as well as result-oriented reports in the past 5 years.
• Fluency in English, working level of Ukrainian or Russian would be an advantage.

•  Cover letter and confirmation of interest indicating clearly when, if selected, the consultant would be available to start work and including a brief description of approach to work/technical proposal of why the individual considers him/herself as the most suitable for the assignment, and a proposed methodology on how they will approach and complete the assignment (maximum 2-3 pages).
•  Financial Proposal that indicates the all-inclusive fixed total contract price and all other travel related costs (such as flight ticket, per diem, etc.), supported by a breakdown of costs, as per Annex I template attached to the Letter of Confirmation of Interest template.

Financial Proposal

 Lump Sum contract

The Consultant will be responsible for all personal administrative expenses incurred while implementing this assignment, including office accommodation, printing, stationary, telephone and electronic communications, as well as provision of the report copies.

Payment will be released in quarterly instalments each after presenting a report and a time-sheet and approval by Project Manager.

Evaluation

UNDP will use a two-stage procedure to assess applications with. Technical proposals will be assessed prior to any commercial proposals. The Technical proposals will be assessed based on compliance with the Terms of Reference. The following criteria will be rated as indicated below:

• Educational background (PhD related to Engineering/Environmental Studies/Architecture/  Economics/Business/Law = 9 points, PhD related to other relevant topic or Masters related to Engineering/Environmental Studies/Architecture/Economics/Business/Law = 8 points, Masters related to other relevant topic or Bachelor related to Engineering/Environmental Studies/Architecture/Economics/Business/Law  = 7  points. If specialization was specifically on energy efficiency in buildings, then +1 point (10 points max).
• Minimum 5 years of relevant experience of policy advisory (advisory/development/professional/managerial services) and project implementation (expert work) with policy on energy efficiency building consultancy (5 years = 8 points; 6 - 7 years = 9 points; 8 years and more = 10 points (10 points max).
• Minimum 5 years of relevant experience of advisory/development/professional/managerial services or expert work with policy on energy management systems  and/or experience in energy technologies, i.e., building sector including in energy efficiency in buildings, integrated building design approach, and energy management information systems experience (5 years = 8 points + 3 points if experience with EMIS; 6-7 years = 10 points + 3 points if experience with EMIS; 8 years and more  = 12 points + 3 points if experience with EMIS (15 points max).
• Minimum 5 years of experience of advisory services to government and/or public/international organizations in program/project design for institutional strengthening and/or capacity building and/or needs assessment in the related regulations/policies/market mechanisms including EU regulations and familiarity with EU work in area of energy efficiency in buildings (5 years =12 points; 6-8 years = 15 points (15 points max).
• Previous experience with energy efficiency related issues in the Europe & CIS region including relevant experience of drafting, editing, and producing written proposals as well as result-oriented reports in the past 5 years (more 5 years = 8 points; 6-7 years = 9 points; 8 years and more  = 10 points (10 points max).
• Language skills (10 points for fluency in English and Ukrainian or Russian; 7 points for fluency English and good knowledge of Ukrainian or Russian, and 6 points for fluent English and no Ukrainian/Russian) (10 points max).

Maximum available technical (education, experience and competencies) score – 70 points.

Maximum available financial score – 30 points.

Evaluation method:

Cumulative analysis

The Contract shall be awarded to the Applicant, whose offer has been evaluated and determined as:
A) responsive/compliant/acceptable, and
B) having received the cumulative highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.
* Technical Criteria weight: 70%
* Financial Criteria weight: 30%

Only the candidates received minimum 70% of maximum available technical score shall be admitted to the Financial Evaluation
The maximum number of points assigned to the financial proposal is allocated to the lowest price proposal and will equal to 30. All other price proposals will be evaluated and assigned points, as per below formula:
30 points [max points available for financial proposal] x [lowest of all evaluated offered prices among responsive offers] / [evaluated price].

The proposal obtaining the overall cumulatively highest score after adding the score of the technical proposal and the financial proposal will be considered as the most compliant offer and will be awarded a contract.
