BACKGROUND AND CONTEXT


The Sawasya II programme: Promoting the Rule of Law in Palestine represents the primary programmatic vehicle of the United Nations for advancing the rule of law, integrity, gender justice and human rights in Palestine for the period 2018-2022. Bringing together the main UN entities mandated and invested in these areas in an integrated programme framework (three years, with provision for a further two optional years), Sawasya II seeks to elevate the state building enterprise for a progressively functioning and increasingly inclusive State of Palestine that respects, protects and fulfils human rights and gender equality, and promotes development, peace and security.
The programme has a dedicated output (2.1) which aims to improve the quality and efficiency of security and justice services provided to the Palestinian citizens. Under this output, the Programme provides support to the public prosecution, through its human rights unit.
The public prosecution plays an important role in implementing the human rights obligations of the State of Palestine as per the human right treaties it has acceded to. The Human Rights Unit (HRU) at the Attorney General’s Office (AGO) was activated in January 2017, with the overall mandate to mainstream human rights principles into the work of the Public Prosecution. One of its main functions is receiving and resolving public grievances and accepts, all complaints on human rights violations by the judiciary police, security forces and members of the Public Prosecution, initiates investigations into those violations, and tracks them within a certain timeframe, as well as follows up on the complaints submitted by detainees. HRU team is receiving annually complaints against Palestinian security forces for committing ill-treatment and torture actions toward citizens and accused persons during pre-detention stage of investigations
To that end, Sawasya II is seeking a national legal analyst expert specialized on data analysis resulted from investigation and documentation of torture and other cruel, Inhuman, or degrading treatment of punishment complaints as well as prison monitoring visits report uploaded on the prison monitoring software system.
The overall objective of this assignment is to build the capacity of members of the Human Right Unit in data gathering, analysis and reporting and documentation on the ill-treatment and torture complaints and on improving the monitoring and oversight of the places of detentions to enhance best practices by AGO as per the international human rights standards.
Legal data analyst’ responsibilities include conducting full lifecycle analysis to include requirements, activities, and design. Legal data analysts will develop analysis and reporting capabilities. They will also monitor performance and quality control plans to identify improvements. The expert will perform his/her tasks under the supervision of the Sawasya II Human Rights Coordinator and the Technical Specialist and in close collaboration with Human Rights Unit team in public prosecution.

FUNCTIONS/KEY TASKS

Focus on reviewing data collection, analyses, reporting and documentation

  • Work with head of the Human Rights Unit to prioritize business and information needs
  • Build the capacities of the human right unit in Interpret data, analyze results using legal analytical and statistical techniques and provide legal reports on prisons monitoring function and investigation of ill-treatment and torture complaints, through:
  • Using existing databases, data collection systems, data analysis (Mizan case management system and the court monitoring system) and other strategies that optimize statistical efficiency and quality.
  • Acquiring data from primary or secondary data sources and maintain for further legal analysis.
  • Identify, analyze, and interpret trends or patterns in complex data sets in relation to the above indicated subjects.
  • Filtering and “cleaning” data by reviewing computer reports, databases systems, printouts, case files and performance indicators to locate and correct code problems.

Identify gaps in relation to data collection of ill treatment and torture complaints through Mizan and recommend ways for the efficient collection of data on these cases.

  • Locate and define new process improvement opportunities.
  • Conduct research on public prosecution legal practice in relation to International Human Rights standards in one selected area

Focus on capacity building of members of Human Rights Unit members

  • Build the capacity of members of the Human Rights Unit in data gathering, analysis and reporting and documentation on the ill-treatment and torture complaints and on improving the monitoring and oversight of the places of detentions to enhance best practices by AGO as per the international human rights standards.
  • Capacity building should be taken place in facilitating of training as well as continuous on-the-job training.
  • Provide ongoing legal technical support and advice to the head of the Human Right Unit

  1. REQUIREMENTS FOR THE SUCCESSFUL COMPLETION OF THE ASSIGNMENT

The legal analyst should work in close coordination with AGO Human Right Unit, the Human Rights Coordinator as well as the Technical Specialist of Sawasya II. He/ She should comply with the working hours of the AGO and ensure attendance. The expert is expected to accomplish the following:

  • Draft needed reports requested by the Human Right Unit.
  • Visit public prosecution offices in the districts attend meetings and provide support as instructed by the head of the human right unit.
  • Develop and draft qualitative indicators related to the mentioned subjects and train staff on implementation.
  • Provide support to during documentation of ill-treatment and torture.  
  • Define challenges and gaps related to the defined subjects by close coordination with human right units and other related department staff in AGO.
  • Development and workflow design documentation.

Education

The applicant must have a bachelor’s degree in law. Advanced degree is an asset  

Experience

  • At least 3 years of relevant experience as practitioner lawyer
  •  At least 2 years’ experience in longitudinal data modeling and analysis.
  • Strong background in research and analysis in the areas of human rights, skills in capacity building.
  • Understanding of data innovation methodologies and designing data-based experiments preferred.
  • Proven and strong capacity building skills.
  • Flexibility to adapt expectations and project outputs to field-level realities
  • Specific experience in legal analysis
  • Experience in the usage of computers and software packages (MS Word, Excel, etc.). Knowledge of spreadsheet and database packages, experience in handling of web-based management system.

Evaluation

Preliminary examination

UNDP/PAPP will examine the Proposals to determine whether they are complete, and whether they are substantially responsive to the qualification and experience minimum requirements. A Proposal determined as not substantially responsive will be rejected by UNDP/PAPP and may not subsequently be made responsive by the Applicant by correction of the non-conformity.

Detailed examination

Individual consultants will be evaluated based on lowest price and technically compliant offer method.

The award of a contract should be made to the individual consultant whose offer has been evaluated and determined as both:

a) responsive/compliant/acceptable, and

b) Offering the lowest price/cost

Award of Individual Contract

The procuring UNDP entity reserves the right to accept or reject any Proposal, and to annul the solicitation process and reject all Proposals at any time prior to award of contract, without incurring any liability to the affected applicant or any obligation to inform the affected applicant or applicants of the ground for the UNDP’s action.

The UNDP procuring entity will award the Individual Contract to the First Lowest Cost and Technically Responsive Candidate.

Your financial offer in USD shall specify a lump sum figure all-inclusive and shall take into account various expenses incurred during the contract period and shall form the amount of the resulted contract between the winning Consultant/Contractor and UNDP. No other entitlements will be considered after submission of financial proposals.

The financial proposal shall include a breakdown of this lump sum amount (number of anticipated working days, all envisaged travel (such as but not limited to all travel to join duty station/repatriation travel), per diems/daily allowances).
