Antecedentes

The objective of this project is to accelerate implementation of energy efficiency measures in public buildings in Ukraine through the Energy Service Company (ESCO) modality, utilizing Energy Performance Contract (EPC), by leveraging over significant private sector investment over its five-year implementation period as well as by introducing a single nationwide energy management information systems (EMIS) for Ukraine. The project will be run by a Project Manager and supported by two part-time international Chief Technical Advisors, one focusing on ESCO related activities (which is the one in this ToR) and one focusing on energy management.

The part-time International Technical Advisors (ITAs) will be home based, but will be expected to travel to Ukraine a minimum of five times per year or once per two to three months. Each mission to Ukraine will consist of at least 5 full working days, not including travel days with the exception of one mission (most likely the first or second mission which will consist of 10 working days in Ukraine). The average time input is expected to be 6 man-days per month but for some months the amount of work required will be more and for some months it will be less. Therefore, the total estimated work input is 72 working days (6 x 12).

A major outcome of the project is intended to be support for improved ESCO market development in Ukraine, including through the signing of at least 10 EPC’s in 10 different cities in Ukraine.

The international advisor on ESCO in public buildings will have as his/her main goal to aim to help to ensure that Ukrainian legislation and policies are updated and improved with regards to support for overall ESCO market development. The main point to note is that Ukraine currently has laws to support ESCO market development but that there may be secondary legislation and regulations to support the development of the market. For example, the banking sector does not have any market for trading in EPCs (energy performance contracts) and the project could look at how to help create such a market. For example, the ability of municipalities to enter into long term EPCs and signed shared savings agreements needs to be further analyzed and possibly new regulations need to be introduced to facilitate such market development.

The international advisor on ESCOs in public buildings needs to work with the UNDP GEF project team to lobby the Ukrainian government on the importance of the ESCO modality in increasing energy efficiency in public buildings in Ukraine and to introduce proposals for new secondary legislation for the ESCO market development. In other countries, UNDP has successfully lobbied for the appointment (and training) of regional energy managers which is a positive step forward in the direction of improved energy management in public buildings. The international advisor on ESCOs needs to work closely with all the other actors in Ukraine who are working in the field of ESCO to determine (through gap analysis) what work needs to be undertaken in order to strengthen the ESCO market development overall.

The project has four main outcomes as follows which are as follows:

Component 1: To formulate and introduce a streamlined and comprehensive legal and regulatory framework to promote energy efficiency in public buildings through strengthening of monitoring and enforcement mechanisms.

Component 2: To promote private investment in energy efficiency in public buildings through appropriate catalytic financial incentives, including the establishment of a Financial Support Mechanism (FSM).

Component 3: To implement at least 10 pilot projects in selected public buildings to demonstrate the energy and cost-saving potential of energy efficiency measures.

Component 4: To establish an institutional basis and comprehensive nation-wide Energy Management and Information System (one single energy management system adopted for public buildings in Ukraine) to support energy efficiency in public buildings.

Of the four project components, this International Technical Advisor on ESCOs in Public Buildings is taking the lead on supporting component 2 and component 3 of the project, while providing advise on best practices on Component 1 (legislation).

The International Advisor on ESCO in public buildings will be responsible for providing technical inputs for the smooth implementation of the Project activities focusing primarily on full support for activities under component 2 and component 3 of the project. The following outcomes should be achieved under component 2 and component 3 of the project.

Outcome 2: Innovative Financing Mechanism is adopted and capacity development is provided for ESCOs to promote investment in support of Energy Efficiency in public buildings.

Support for development of a detailed action (working with IFC) on how to support the project activities through the JUICE – Joint UNDP-IFC Financial Support Mechanism;
Gap analysis of existing work on ESCO market development in Ukraine, looking at what other donors are doing, clearly explaining barriers and why market does not work properly yet, with recommendations on steps to overcome barriers;
Development of recommendations on financial incentives scheme to support ESCO market mechanism, including analysis of all options such as (i) tax breaks (ii) partial or full loan guarantees (iii) development of a secondary market for trading in EPCs, (iv) other financial incentives aimed at supporting ESCO market development;
Development of detailed terms of reference for ‘ESCO HELP Desk’ and recommendations on how to fund and sustain the HELP Desk and where it should be based and who should operate it over the project life time as well as recommendations on how the HELP desk can continue to operate and be financially sustainable once the project ends;
Support for training and capacity building activities related to the financial support mechanism and/or the ESCO Help desk including participating in workshops, seminars, conferences, and/or training events;

Outcome 3: Pilot projects in selected public buildings which demonstrate energy and cost-saving potential of new energy efficient measures.

Assistance with selection of cities for participation in the project based upon clear and transparent selection criteria;
Prepare detailed terms of reference for carrying out energy audits in at least 10 cities with city partners that are committed to providing co-financing for implementation of demonstration projects, following the completion of audits (this work links with output 1.3 and will be carried out in close collaboration with the international advisor on energy monitoring and energy management, with the main goal to be to link the audits to ESCO type investments);
Detailed review of completed energy audits and assistance in the finalized selection of demonstration projects;
Participating in capacity building and training activities related to the implementation of the pilot EPC demonstration projects. This includes developed and published public awareness raising materials and completed nation-wide awareness and information campaign advocating the benefits of ESCO approaches.

Under component 3 the key outcome is to ensure that the demonstration projects are carried out using the ESCO and EPC modality. The project targets the signing of at least 10 EPCs in 10 cities throughout Ukraine. The cities will be selected at the start of the assignment. Travel to the selected cities may be required as part of mission travel.

Deberes y responsabilidades

The international CTA on ESCO will have the following duties and outputs to be achieved:

Support to either a draft new law on energy efficiency in buildings or amendments to other relevant legislation which covers energy efficiency in buildings and includes minimum energy performance standards and long-term budgetary commitment. This includes support for preparation of supporting documents such as background papers, gap analyses and/or analysis of international best practice in the area of energy-efficiency in public buildings.
Discussion document of the work of other donors and review of international best practice relating to ESCO market development.
Development of recommendations on financial incentives scheme to support ESCO market mechanism, including analysis of all options such as (i) tax breaks (ii) partial or full loan guarantees (iii) development of a secondary market for trading in EPCs, (iv) other financial incentives aimed at supporting ESCO market development
Detailed ToR for the establishment of the ESCO Help Desk. Training for staff who will be part of the ESCO Help Desk and back-up and support for Help Desk inquiries. Preparation of Sustainability plan for the help desk
Preparation of the detailed terms of reference for the energy audits to be carried out under the project (in close collaboration with the international advisor on energy audits and energy management)
Review of the completed energy audits
Developed and published public awareness raising materials and completed nation-wide awareness and information campaign advocating the benefits of ESCO approaches.

Mission 1: Assisting in drafting/revising of Project Workplan related to components 2 and 3, Assistance with drafting of ToR for other key expert positions related to components 2 and 3. Interviews with all existing ESCOs or so called ESCOs in Ukraine. Gap Analysis in terms of what other donors are supporting and what is required in related to ESCO market development in Ukraine. Support for pilot demonstration city selection. Support for developing terms of reference for energy audits for demonstration projects.

Mission 2: Discussions with key stakeholders regarding financial incentives to support ESCO market development including key report on recommendations on financial incentives scheme to support ESCO market mechanism, including analysis of all options such as (i) tax breaks (ii) partial or full loan guarantees (iii) development of a secondary market for trading in EPCs, (iv) other financial incentives aimed at supporting ESCO market development.

Mission 3: Support International Consultant on Energy Management and Energy Monitoring with draft government decision that there will be in Ukraine a fully capacitated state agency (SAEEES) with a responsibility to monitor and enforce the energy savings and CO2 emission reductions in public buildings. Develop terms of reference for ‘ESCO Help Desk’, most likely to be located within this fully capacitated state agency. Work to support implementation of financial support mechanism.

Mission 4: Detailed review of all completed energy audits complete with full recommendations regarding project implementation. Work to support implementation of financial support mechanism, working closely with the IFC.

Mission 5: Finalization of all relevant reports. Capacity building training and support to all key stakeholders on EPC contracts, including ESCOs, municipal and government officials, and companies interested in becoming ESCOs. Participation in relevant workshops, conferences, seminars, and training activities.

Monitoring / Reporting Requirements

All reports prepared by the international Chief Technical Advisor should be submitted to the UNDP Project Manager and to UNDP Ukraine.

Habilidades y experiencia requeridas

University degree (At least Master’s degree), in a energy, engineering, architecture discipline or other relevant subject sphere;
Minimum of 12 years of professional working experience on energy-efficiency and sustainable energy;
At least 5-years experience on building energy efficiency consultancy;
At least 5 years experience working with ESCO projects or ESCO analysis working either in the public or private sectors;
Experience working with public organizations and international organizations would be an asset;
Proven ability to draft, edit and produce written proposals and result focused reports based on the samples provided (min 5 samples);
Experience on development or implementation of international projects in CIS region (min involved in two projects);
Understanding of GEF policies and procedures would be an asset;
Fluency in English is mandatory, working knowledge of Russian would be strong asset.

Documents to be provided

Cover letter and confirmation of interest indicating clearly when, if selected, the international consultant would be available to start work and including a brief description of approach to work/technical proposal of why the individual considers him/herself as the most suitable for the assignment, and a proposed methodology on how they will approach and complete the assignment (maximum 2-3 pages). Supplemented by at least 5 samples of reports.
Financial Proposal that indicates the all-inclusive fixed total contract price and all other travel related costs (such as flight ticket, per diem, etc), supported by a breakdown of costs, as per Annex I template attached to the Letter of Confirmation of Interest template.
CV/P-11

The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in installments or upon completion of the entire contract). Payments are based upon output, i.e. upon delivery of the services specified in the TOR. In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount (including travel, per diems, and number of anticipated working days).

Payment will be released in 4 equal semi-annual instalments each after presenting a report and approval on a Project board meeting.

Evaluation

UNDP will use a two-stage procedure to assess applications with. Technical proposals will be assessed prior to any commercial proposals. The Technical proposals will be assessed based on compliance with the Terms of Reference. The following criteria will be rated as indicated below:

Educational background (Advanced University degree, Masters or preferably a PhD, in Energy, Engineering, Architecture or related field) – 10 points max; (PhD related to Energy/Engineering - 9 points, PhD related to other relevant topic -7 points, Masters related to Energy/Engineering - 5 points, Masters related to other relevant topic - 3 points. If specialization was specifically on energy efficiency in buildings, then +1 point.);
At least 5-years experience on building energy efficiency consultancy – 20 points max; (5 points for at least 5 years with +1 point for each additional year. Max 20 points);
At least 5 years experience working with ESCO projects or ESCO analysis working either in the public or private sectors – 20 points max; (10 points for at least 5 years with +2 point for each additional year. Max 20 points);
Experience on development or implementation of international projects in CIS region (min involved in two projects) – 10 points; (Min 5 points, with +1 point for each additional project, up to 10 points);
Fluency in both English and Russian – 10 points.

Maximum available technical (education, experience and competencies) score – 70 points.

Maximum available financial score – 30 points.

Evaluation method - Cumulative analysis

The Contract shall be awarded to the Applicant whose offer has been evaluated and determined as:
A) responsive/compliant/acceptable, and
B) having received the cumulative highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.
* Technical Criteria weight: 70%
* Financial Criteria weight: 30%

Only the candidates received minimum 70% of maximum available technical score shall be admitted to the Financial Evaluation.
The maximum number of points assigned to the financial proposal is allocated to the lowest price proposal and will equal to 30. All other price proposals will be evaluated and assigned points, as per below formula:
30 points [max points available for financial proposal] x [lowest of all evaluated offered prices among responsive offers] / [evaluated price].
The proposal obtaining the overall cumulatively highest score after adding the score of the technical proposal and the financial proposal will be considered as the most compliant offer and will be awarded a contract.
