Antecedentes

UN Women is the UN Entity for Gender Equality and the Empowerment of Women, dedicated to advancing gender equality and women’s human rights globally. Since 2002, UN Women Afghanistan has been supporting the government of Afghanistan and others partner agencies with the overall goal to Eliminate Violence against Women (EVAW), promotion of women rights and gender equality. UN Women is further strengthening its EVAW Program, particularly with regards to enhancing capacity of partner agencies and provide coherent and specialized support for EVAW initiatives, implemented by both government and civil society organizations.

The role of the UN Women’s EVAW Program in Afghanistan is to support national partners – including the Ministry of Justice( MoJ),  Ministry of Women’s Affairs (MoWA), key line ministries, Parliamentary bodies, and civil society organizations to support the implementation of commitments under the National Action Plan for the Women of Afghanistan (NAPWA) including support to prevention and response to violence against women, legal protection, strengthen rule of law and support women’s human rights.

UN Women works with MoJ to ensure all relevant laws/policies are gender responsive and aligned with government international commitments, particularly CEDAW.  The EVAW Pillar of UN Women supports Ministry of justice Taqnin department to receive feedback and inputs from various relevant stakeholders in the drafting and amendments of various laws. Legal assistance is provided to ensure that Afghanistan laws are compliant to the international norms and standards, and to ensure that a progressive law is applied for protection of women’s and girls’ rights.

As part of the law reform process, Ministry of Justice(MOJ) initiated drafting of the Family Law through consultations with various government and non-government stakeholders across the country. The draft Family Law is in line with the articles 22 and 54 of the Constitution of Afghanistan. Total 5 regional consultations have been jointly organized by MoJ, UN Women and UNDP across Afghanistan. Following these consultations, this assignment seeks for an international consultant to review the draft Family Law, identify if gaps that contravene the national legal framework and international human rights standards, and based on the finalized Family Law, provide gender and human rights centric training to the Stage Course instructors of the Institute of the Research and Legislation (Taqnin) of Ministry of Justice, and relevant line ministries focal points.


Deberes y responsabilidades

Under direct supervision of EVAW Program Coordinator, considering the above, the Consultant will undertake the following tasks:

  • Produce legal technical analytical paper of the family law provisions in line with relevant national laws, CEDAW, and Islamic provisions; this technical analytical paper should be developed based on a desk review in close consultation with MoJ Taqnin department and UN Women Afghanistan Country Office. A list of legal documents and laws to be prepared and agreed between MoJ, UNW and Consultant before review;
  • Present the endorsed legal technical paper to the national conference: A national conference is planned to share the compilation of recommendations from the 5 regional conferences. The consultant is expected to present the technical paper at the national level conference;
  •  MOJ-Taqnin department trained in gender responsive family law development in line with Sharia, national and internal normative framework: number of trainings to be conducted to the MOJ Taqnin department in how to do gender analysis of the laws, particularly in family law drafting process to be coached by possibly giving specific assignments for review of specific laws etc... a capacity development plan to be develop based a capacity assessment).
  • Develop training materials to build the capacity of MoJ legislation department Stage trainers on Gender & human rights, national and international frameworks

The areas of training subjects may include but not limited toa) understanding key concepts like Gender, power, patriarchy; unpacking social ,cultural, economic and political institutions and how they are linked with the GEWE;  gender  framework analysis, violence against women as a women’s rights issue, Gender and its linkage with Violence against women, Gender in relation with international convention/treaties, Gender in relation with national laws/legislations, how to use rights based approach to gender mainstreaming, gender sensitization in law enforcement mechanisms, legislation from gender and human rights lens, Gender issues in light of sharia, integrating human rights into national law making and enforcement, the role of legislators in upholding gender equality and human rights, b) Concept of leadership and management. The training materials must be produced in English, translated in Dari and Pashtu.

  • Conduct Trainings (2-3 days) for the taqnin stage trainers

The training program must be developed based on a pre-training needs assessment. The handouts must be shared in advance with UN Women for certification and must be in three languages English, Dari and Pahstu. the training must be planned in coordination with UN Women and MoJ Taqnin department.

  • Produce a final detailed report of the training and consultancy.

A detailed training reports including pre-and post-assessment findings shall be shared with UN Women before ending of the contract, including annexes as required. i.e. the pre-and post-assessment tools/filled forms.

Deliverables:

  • Produce legal technical paper of the family law provisions analysis in line with relevant national laws, CEDAW, and Islamic provisions as result of desk review. within 07 working days (home based);
  • Present the finalized land endorsed legal technical paper to the national conference within 02 working days (Kabul, Afghanistan);
  • MOJ-Taqnin department trained, mentored and coached in gender responsive family law development 3 working days for live training and coaching throughout the consultancy (Kabul Afghanistan);
  • Training materials and handouts developed including (Training plan, design, methodology), PowerPoint presentations; within (05 working days); home based
  • Training conducted and findings of the impacts of the training is shared based on Pre-and post-assessment tools three working days (Kabul)
  • Final consultancy report produced 2 working days, (homebased)

Administrative arrangement:

  • The Consultant will be based in UN Women Afghanistan Country Office and if required will stay in MOJ-Taqnin departmen, Kabul;
  • The consultant shall be provided with applicable DSA for Kabul Afghanistan for the duration of stay in Kabul to cover the cost of accommodation and other related expenses;
  • The consultant shall be covered for travel related expenses: (Cost of one round trip economic class air fare by most direct and least costly route from home country to Kabul and back to home country as per UN Women rules and regulations);
  • Accommodation:  The consultants shall be accommodated in UN cleared accommodation which will be fully paid by consultant. UN Women ACO administration team will assist in making necessary arrangements;
  • Transportation: The consultant shall be provided with transportation via armored vehicle for pick and drop for official purposes under UN security regulations;
  • Security:  The consultant shall fall within the security arrangements of the UN in general and UN Women in particular, and will be supported accordingly;
  • The contract payments will be based on the submission of quality deliverables certified by the EVAW Program Coordinator in the ACO.

Habilidades y experiencia requeridas

Education:

  • Master’s Degree or Doctorate in Law, Gender studies, international human rights law with a minimum of 6 years of experience in legal research, legal technical briefs, comparative analysis academia and/or legal practice and trainings.

Experience:

  • Experience in the field of Islamic/shari’a law and gender justice;
  • Sound knowledge of national, regional and international standards on women’s rights and related instruments;
  • Experience in developing similar training manual and materials
  • Proven of good tracking record on similar job and assignments
  • Experience in working with senior governmental or non-governmental officials
  • Proven evidence (i.e. publications) in relevant issues a strong asset.
  • Familiarity with current debates and research on Gender in Islam.

Language Requirements:

  • Professional fluency in written and spoken English.
  • Knowledge of Dari and /or Pashto an asset
