UN Women is the UN Entity for Gender Equality and the Empowerment of Women, dedicated to advancing gender equality and women’s human rights globally. Since 2002, UN Women Afghanistan has been supporting the government of Afghanistan and others partner agencies with the overall goal to Eliminate Violence against Women (EVAW), promotion of women rights and gender equality. UN Women is further strengthening its EVAW Program, particularly with regards to enhancing capacity of partner agencies and provide coherent and specialized support for EVAW initiatives, implemented by both government and civil society organizations.
The role of the UN Women’s EVAW Program in Afghanistan is to support national partners – including the Ministry of Justice( MoJ), Ministry of Women’s Affairs (MoWA), key line ministries, Parliamentary bodies, and civil society organizations to support the implementation of commitments under the National Action Plan for the Women of Afghanistan (NAPWA) including support to prevention and response to violence against women, legal protection, strengthen rule of law and support women’s human rights.
UN Women works with MoJ to ensure all relevant laws/policies are gender responsive and aligned with government international commitments, particularly CEDAW. The EVAW Pillar of UN Women supports Ministry of justice Taqnin department to receive feedback and inputs from various relevant stakeholders in the drafting and amendments of various laws. Legal assistance is provided to ensure that Afghanistan laws are compliant to the international norms and standards, and to ensure that a progressive law is applied for protection of women’s and girls’ rights.
As part of the law reform process, Ministry of Justice(MOJ) initiated drafting of the Family Law through consultations with various government and non-government stakeholders across the country. The draft Family Law is in line with the articles 22 and 54 of the Constitution of Afghanistan. Total 5 regional consultations have been jointly organized by MoJ, UN Women and UNDP across Afghanistan. Following these consultations, this assignment seeks for an international consultant to review the draft Family Law, identify if gaps that contravene the national legal framework and international human rights standards, and based on the finalized Family Law, provide gender and human rights centric training to the Stage Course instructors of the Institute of the Research and Legislation (Taqnin) of Ministry of Justice, and relevant line ministries focal points.
Deberes y responsabilidades
Under direct supervision of EVAW Program Coordinator, considering the above, the Consultant will undertake the following tasks:
The areas of training subjects may include but not limited toa) understanding key concepts like Gender, power, patriarchy; unpacking social ,cultural, economic and political institutions and how they are linked with the GEWE; gender framework analysis, violence against women as a women’s rights issue, Gender and its linkage with Violence against women, Gender in relation with international convention/treaties, Gender in relation with national laws/legislations, how to use rights based approach to gender mainstreaming, gender sensitization in law enforcement mechanisms, legislation from gender and human rights lens, Gender issues in light of sharia, integrating human rights into national law making and enforcement, the role of legislators in upholding gender equality and human rights, b) Concept of leadership and management. The training materials must be produced in English, translated in Dari and Pashtu.
The training program must be developed based on a pre-training needs assessment. The handouts must be shared in advance with UN Women for certification and must be in three languages English, Dari and Pahstu. the training must be planned in coordination with UN Women and MoJ Taqnin department.
A detailed training reports including pre-and post-assessment findings shall be shared with UN Women before ending of the contract, including annexes as required. i.e. the pre-and post-assessment tools/filled forms.
