Antecedentes

The UN Joint Programme for Gender Equality (UNJP) is the second phase of an intervention implemented from 20 November 2015 until 31 December 2020 jointly by UNDP, UNFPA and UN Women with the generous support of the Government of Sweden. The Programme continues to respond directly to the women’s rights and gender equality commitments undertaken by the Government of Georgia (GoG) on the international and national levels upscaling the results achieved by the first phase of the UNJP implemented in the period of 1 December 2011-30 April 2015.

The Joint Programme addresses gender inequality in a coherent and comprehensive manner, covering a wide range of issues, such as political and economic empowerment of women, reducing violence against women and girls and promotion of women’s sexual and reproductive health and rights. Therefore, three UN agencies have unified efforts towards the achievement of its goals and objectives. 

The overall goal of the project is to promote gender equality and women’s empowerment by means of strengthening capacities of government at both central and local levels and across the executive, legislative and judicial branches, engaging civil society and raising public awareness about gender equality. This ambitious goal will be achieved by realization of the following outcomes:

  • Enhanced women’s political and economic empowerment (led by UNDP);
  • Enabling environment to eliminate violence against women and girls, especially sexual and domestic violence,   created in Georgia (led by UN Women);
  • Advanced gender equality and reproductive rights, including for the most vulnerable women, adolescents and youth (led by UNFPA).

The project exercises a holistic approach by simultaneously targeting three interrelated levels (national, local and grassroots) and applying multi-tiered programming approaches:

To achieve the outcomes of the project, UNJP partners with the Gender Equality Council of the Parliament of Georgia (hereinafter “the GEC”). The GEC has approached UNJP with the request to support it in further enhancement and finalization of the Gender Equality Concept as well as to lend support in revision and finetuning of the 2010 Law of Georgia on Gender Equality (hereinafter “GE Law”) informed with the GEC baseline study on Gender Equality in Georgia: Barriers and Recommendations (2018), international best practices and Georgia’s national and international commitments in the area of gender equality and women’s empowerment.

The draft of Gender Equality Concept is already in place and it has been widely shared with MPs, government, civil society and development partners. Thus, the task here is to consolidate and reflect comments shared by these stakeholders together with the GEC members who have the final say and ownership of the document. Similar participatory process and engagement of all relevant stakeholders is foreseen also in the revision process of the GE Law.

In order to ensure finalization of the Gender Equality Concept and to facilitate efficient working process towards preparation of the amendments to the GE Law, UNJP will recruit a National Consultant – Legal expert who will work closely with the GEC and its support staff. The National Consultant will be supported by and is expected to work in a team with International Consultant - Legal Expert to be also hired by the UNJP with regards to the preparation of the GE Law amendments’.

Deberes y responsabilidades

Duties and responsibilities of the National Consultant are:

  • To incorporate the comments received so far to the draft GE Concept, align it with Georgia’s national and international commitments in the area of GEWE and finalize it together with the GEC in coordination with UNJP partners;
  • Under the leadership and guidance of the GEC and UNJP, take part in drafting a roadmap of participatory process of preparation of amendments to GE Law. This includes engagement of  the executive branch of the government / the Inter-Agency Commission on Gender Equality, Violence against Women and Domestic Violence and the GEC’s civil society advisory council (jointly with International Consultant) in the process of finalizing the roadmap  
  • Based on recommendations of the baseline study “Gender Equality in Georgia: Barriers and Recommendations” outline key revisions/changes necessary to the GE Law. Furthermore, ensure that proposed changes to the law are in line with international best practices and Georgia’s international and national commitments in the area of gender equality (jointly with International Consultant) and finalize it in cooperation with UNJP partners prior to presenting for further scrutiny to the GEC;
  • To present the draft revisions/amendments to the GE Law at all stages with relevant partners and stakeholder from the GEC, government (Inter-Agency Commission) and civil society (GEC Advisory Council) and collect and reflect on the remarks and suggestions expressed through this consultation process (jointly with International Consultant);
  • To develop the final draft amendments to the GE Law and present these to the GEC and UNJP (jointly with International Consultant);
  • To develop explanatory notes to the draft amendments (jointly with International Consultant);
  • To participate in relevant Parliamentary Committee hearings of the draft GE Law amendments;
  • At all times, while implementing duties and responsibilities spelled out in this ToR liaise with International Consultant who will serve as a resource person to ensure high quality of all deliverables;
  • At all times, perform duties and responsibilities spelled out in this ToR in close communication with the GEC and UNJP partners (leadership and staff);
  • To perform other duties as necessary in relation to the package of GE Law amendments (such as further research, data collection, inquiries, etc.

Deliverables

  • GE Concept finalized together with GEC with technical support and inputs from UNJP partners as necessary (10 working days) - by 5 October 2018;

  • The roadmap of preparation of GE Law amendments prepared together with the GEC, UNJP and the International Consultant;(2 working days) – by 20 September 2018;
  • At least three consultations (initial to inform about the process and brainstorm on key areas from revision; second to present international best practices and elaborate on the areas to be amended further and third to present zero draft of the amendments) held with the engagement of all stakeholders around the GE Law amendments’ (10 working days) -  by 31 October 2018;
  • First draft amendments (reflecting comments from the consultation process) to the GE Law along with explanatory note elaborated in cooperation with International Consultant and presented to the GEC and UNJP (15 working days) - by 30 November 2018;
  • Final draft amendments to the GE Law (reflecting also comments received through international expertise) along with the explanatory note elaborated and submitted to the UNJP and the GEC for initiation (10 working days) - by 28 February 2019;
  • Support rendered to the GEC to reflect comments received through committee and plenary hearings in the draft package as relevant (10 working days) – by 30 June 2019

Evaluation procedure:

The candidates will be evaluated in three stages: according to minimum qualification criteria; technical and financial evaluation. The candidates must possess minimum qualification criteria to be eligible for further technical evaluation.

The candidate must possess the following minimum qualification criteria to be eligible for further technical evaluation:

  1. Master’s Degree or higher in Law;
  2. At least five years of experience in legislative drafting and analysis in the area of gender equality and women’s rights;
  3. Fluency in Georgian and English

 

Technical evaluation criteria (including minimum qualifications):

  1. Master’s Degree or higher in Law (max 50 points);
  2. At least five years of experience in legislative drafting and analysis in the area of gender equality and women’s rights (max 100 points);
  3. Sound knowledge and understanding of gender equality context in Georgia (max 90 points);
  4. Sound knowledge of national and international women’s rights and gender equality related legislation and instruments (max 90 points);
  5. Proficiency in Georgian and English (20 points)

Maximum total technical score amounts to 350 points. Only candidates who have passed over the minimum qualification criteria and have accumulated at least 245 points out of maximum 350 under technical evaluation will qualify for the next stage i.e. evaluation of their financial proposals.

Evaluation of submitted financial offers will be done based on the following formula: S = Fmin / F * 150

S – score received on financial evaluation;

Fmin – the lowest financial offer out of all the submitted offers qualified over the technical evaluation round;

F – financial offer under consideration.

The winning candidate will be the candidate, who has accumulated the highest aggregated score (technical scoring + financial scoring).

 

Management arrangements:

The contractor will report to and work under direct supervision of the UNJP Component Managers and designated focal point from the GEC.

 

Financial arrangements:

Payment will be disbursed upon submission and approval of deliverables and certification by UN Women Component Manager / Programme Analyst that the services have been satisfactorily performed as specified below:

•             Deliverable 1 – 30%

•             Deliverable 2,3,4 -  40%

•             Deliverable 5, 6 -  30%
