Antecedentes

The Integrity Cities Activity is aimed at combating and preventing corruption at the local level through developing and establishing mechanisms to ensure transparency and accountability, engaging CSOs and citizens in oversight of the local government, strengthening civil society to sustain this engagement, and supporting investigative journalists to enhance accountability in municipalities.

The activity is a component of the EU Anti-Corruption Initiative (EUACI), funded by the EU and Denmark Ministry of Foreign Affairs (DMFA) and otherwise implemented by DANIDA. This activity is implemented by UNDP Ukraine in the framework of DMFA-funded “Civil Society for Enhanced Democracy and Human Rights in Ukraine” Project (CSDR Project), will be an integral part of UNDP’s Democratic Governance Programme and comprises of three outputs:

  • Output 1 – Targeted local administrations create environment for reducing corruption risks through comprehensive corruption risks assessments and developed Municipal Integrity Plans;
  • Output 2 – City administrations in Zhytomyr, Nikopol’ and Chervonohrad have capacities to establish sound and transparent procedures and apply innovative solutions to ensure better public access to municipality-owned information and a high-quality services provision and integrate the corruption risk assessment into their strategic policy planning processes
  • Output 3 – City administrations’ employees, women and men, have the capacities and skills to conduct the corruption risk assessment as part of their strategic policy planning processes, and awareness of the civil society and citizens on the procedures and tools as well as the capacity to monitor local administration’s activities is strengthened.

These elements of the Integrity Cities Component of EUACI will be directly implemented by UNDP in framework of CSDR Project in close coordination with the core EUACI team to ensure coherent and effective implementation of the methodology already developed on establishing Integrity Cities, as well as ensuring all visibility and attribution requirements.

MAIN OBJECTIVES OF THE ASSIGNMENT

The overall goal of the assignment is to conduct corruption risk assessment of Zhytomyr, Nikopol’ and Chervonohrad Municipalities, developing report with recommendations and municipal integrity plans to minimize identified corruption risks in 4 thematic areas - in the Sphere of Land Issues, in the Sphere of Municipal Property Management, in the Sphere of Public Procurement and in the Sphere of Urban Development and Architecture. The incumbent will be responsible for conducting corruption risk assessments based on developed finalized Methodology and will work in close collaboration with the Key Corruption Risk Assessment Expert, with 3 other experts and the CSDR team.

DESCRIPTION OF RESPONSIBILITIES / SCOPE OF WORK

Under direct supervision of the UNDP Civil Society Project Coordinator, the incumbents will be responsible for:

  • Conducting corruption risk assessment following the methodology provided by the project;
  • Developing reports and recommendations based on conducted corruption risks assessment in Zhytomyr, Nikopol’ and Chervonohrad;
  • Reviewing developed municipal integrity plans for Zhytomyr, Nikopol’ and Chervonohrad;
  • Contributing to organization and participating in the public presentation of the corruption risk assessment reports and integrities plans;
  • Participating in at least 3 meetings with the working groups/representatives of Zhytomyr, Nikopol’ and Chervonohrad Municipalities and update Corruption Risk Assessment Report.

UNDP will provide payments upon provision of deliverables duly certified by UNDP in accordance with the table above. UNDP will be the ultimate authority to control the quality of work results and assess the Contractor’s performance during the assignment.

Payments are made in three tranches as per the Schedule of payments indicated in the table above.

monitoring/REPORTING requirements

UNDP Civil Society Project Coordinator will supervise the work of the Expert on Corruption Risk Assessment through regular in person and e-mail/or telephone / Skype communication. Upon completion of the task, the deliverables will be checked by the CSDR project team. The final report in Ukrainian shall be submitted electronically to UNDP not later than 29 February 2020 in addition to documents within deliverables. UNDP will be the ultimate authority to control the quality and evaluate the work. No reports, documents, communications should be published or distributed to third parties without prior approval of UNDP. Should any travel be needed for the assignment which is not envisaged at this stage, the related costs will be covered additionally, therefore, the incumbent should not include this cost in his/her financial proposal.

Habilidades y experiencia requeridas

EXPERIENCE AND MINIMUM QUALIFICATIONS REQUIREMENTS

Common requirements to all applicants:

  • University degree (at least Masters’/Specialist degree) in Law, Social Sciences or related field;
  • At least 3 years of expertise in drafting legal documents;
  • Excellent knowledge of Ukrainian/Russian; knowledge of English is an asset.

Specific requirements to the candidates:

Expert #1 in the Sphere of Land Issues:  

  • At least 4 years of working experience in state sector, academia or CSO focused on land issues;

Expert #2 in the Sphere of Municipal Property Management:

  • At least 4 years of working experience in state sector, academia or CSO focused on municipal property management;

Expert #3 in the Sphere of Public Procurement:

  • At least 4 years of working experience in state sector, academia or CSO focused on public procurement;

Expert #4 in the Sphere of Urban Development and Architecture:

  • At least 4 years of working experience in state sector, academia or CSO focused on urban development and architecture.

Financial proposal.

FINANCIAL PROPOSAL

Lump sum contract

The financial proposal shall specify the cost of professional services of the Expert on Corruption Risk Assessment as a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables. Payments are based upon output, i.e. upon delivery of the services specified in the ToR.  In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount.  

Travel costs

Should any travel be necessary in connection to this TOR, UNDP will reimburse the expenses based on the duly authorized travel details, including travel and per diems. In general, UNDP should not accept travel costs exceeding those of an economy class ticket. Should the IC wish to travel on a higher class he/she should do so using their own resources. In the case of unforeseeable travel, payment of travel costs including tickets, lodging and terminal expenses should be agreed upon, between the respective business unit and Individual Consultant, prior to travel and will be reimbursed.

EVALUATION CRITERIA

Educational background – 15 points max:

  • 15 pts – PhD in Law, Social Sciences or related field;
  • 12 pts – Master/Specialist Degree.

Relevant professional expertise in drafting legal documents25 points maximum:

  • 25 pts – more than 3 years;
  • 17 pts – 3 years.

Work experience in the respective specific thematic area – 20 points maximum:

  • 20 pts – more than 4 years;
  • 12 pts – 4 years.

Language skills - 10 points max:

  • 10 pts – excellent knowledge of Ukrainian/Russian; knowledge of English;
  • 8 pts - excellent knowledge of Ukrainian/Russian.

EVALUATION METHOD

Cumulative analysis

Contract award shall be made to the incumbent whose offer has been evaluated and determined as:

a) responsive/compliant/acceptable, and

b) having received the cumulative highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

* Technical Criteria weight: 70%

* Financial Criteria weight: 30%

Only candidates obtaining a minimum 70% from the maximum available technical score (49 points) would be considered for the Financial Evaluation.

The maximum number of points assigned to the financial proposal is allocated to the lowest price proposal and will equal to 30. All other price proposals will be evaluated and assigned points, as per below formula:

30 points [max points available for financial part] x [lowest of all evaluated offered prices among responsive offers] / [evaluated price].

The proposal obtaining the overall cumulatively highest score after adding the score of the technical proposal and the financial proposal will be considered as the most compliant offer.
