Antecedentes

The 'Strengthening government capacities to implement commitments undertaken under the UN convention on Rights of Persons with Disabilities (CRPD)' project shall last at least until the end of 2019. The objective of the project is to improve enabling environment for Persons with Disabilities (PwD) in Georgia to ensure their full and effective participation in society on an equal basis with others. This objective shall be achieved through the following set of activities: the project shall provide a technical support to the development of the national legislative framework on PwD (statutes, by-laws, technical regulations); It shall be concerned with strengthening capacities of local PwD council(s) to plan local social services in selected municipality(ies) in a manner compliant to the CRPD; Strengthening the capacities of the judiciary to interpret Georgian legislation in light of CRPD commitments shall also be attempted; finally, promoting an increased participation of Civil Society Organizations (CSOs) and Disabled Persons Organizations (DPOs) in monitoring the CRPD implementation should also be ensured.
In terms of the results to be achieved, the legislative framework incorporating general principles of CRPD into Georgian Legislation should be drafted and agreed with the Government; At least one local PwD Council needs assessment should be conducted using innovative approaches; concept of local social services should be developed for at least one municipality. Also, judges need to have understanding of CRPD while the CSOs/DPOs shall actively participate in monitoring of CRPD implementation through Public Defender's Consultative Council.

Objectives:
One of the objectives of the project is to support improvement of enabling environment for Persons with Disabilities (PwD) in Georgia to ensure their full and effective participation in society on an equal basis with others.
The UN convention on Rights of Persons with Disabilities (CRPD) without its Optional Protocol, was ratified by the Parliament of Georgia on December 26, 2013 by the Decree N1888-RS. Convention entered into force on April 12, 2014.
Article 29 of UN CRPD obliges state parties to guarantee to persons with disabilities political rights and the opportunity to enjoy them on an equal basis with others. Participation in political and public life is essential for people with disabilities’ voices to be heard. Without a meaningful contribution at key stages of decision-making, disability will continue to be forgotten on the political and development agenda, priorities of people with disabilities to remain unheard, and subsequently the realisation of all their human rights will be jeopardized. The very implementation of the UNCRPD is conditioned by participation of people with disabilities in political and public life.
The project decided to study on the one hand how Georgian legislation is harmonized with CRPD and guarantees full participation of PwDs in political and public life and on the other hand, how persons with disabilities are involved in decision making process in local and regional level.

Deberes y responsabilidades

The overall goal of the assignment is to study how participation of PwDs in political and public life is guaranteed on legislative and practical level. The findings will enable to see thorough picture and will be beneficial for governmental stakeholders and all key actors working on the rights of PwDs to tackle problems based on evidences.

Under the direct supervision of the Programme Coordinator the Consultant is expected to:

Study legislative framework of Georgia how participation of PwDs in political and public life is guaranteed, assess its compliance with the CRPD and develop relevant recommendations;
Research how persons with disabilities are involved in decision making process in local and regional level through interviews and focus group meetings; and develop relevant recommendations.

Habilidades y experiencia requeridas

Academic Qualifications:

Master’s degree in social sciences, law, human rights and/or international law or other related fields (Minimum qualification requirement – 10 points).

Experience:

At least 7-year professional experience in human rights (minimum qualification requirement: seven years - 20 points, experience in working on rights of persons with disabilities - additional 10 points);
At least 3-year experience in research and analysis (Minimum qualification requirement - 10);
Demonstrated experience in rights of persons with disabilities and UN treaty bodies;
Experience in consultancy assignments related rights of PwDs will be a strong asset

Language Requirements:

Excellent English and Georgian skills (both written and verbal);

Evaluation:

Individual Expert will be evaluated based on cumulative analysis method:

Offerors will be evaluated against combination of technical and financial criteria. Maximum obtainable score is 100, out of which the total score for technical criteria equals to 70 (desk review: 50 points and interview: 20 points) and for financial criteria – to 30;
Offerors not meeting any of minimum qualification requirements will be automatically disqualified. Only offerors obtaining minimum 35 points as a result of the desk review will be considered as qualified offerors and invited for the interview;
Offerors passing 70% threshold of maximum obtainable scores as a result of interview, i.e. obtain minimum 14 points, will be shortlisted and requested to provide financial proposal.

Financial Proposal - Lump sum contract:

The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in instalments or upon completion of the entire contract). Payments are made based on delivery. The delivery has to be accepted and approved by the Project team prior to any payment. In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount based on deliverables.
Maximum 30 points will be assigned to the lowest price offer. All other price offers will be scored using the formula (inverse proportion): Financial score X = 30* the lowest price offer/suggested price offer x.

Deliverables:

A report on how participation of PwDs in political and public life is guaranteed on legislative and practical level and develop relevant recommendations. (in Georgian Language);

Management arrangements:

UNDP PCU with a support of the PDO will assist the consultant in acquiring relevant documentation, data and evidence and facilitate organization of meetings that are necessary for the implementation of the assignment under this ToR.
UNDP will cover the costs for the venue and interpretation of the trainings/workshop. The relevant institutions will ensure participation of the staff/training participants.

Payment modality:

Payment shall be made in line with the contract based upon output, i.e. upon delivery of the services specified in the TOR approved by the Programme Coordinator.
