UNDP Afghanistan Mission Statement:

UNDP supports stabilization, state-building, governance and development priorities in Afghanistan. UNDP support, in partnership with the Government, the United Nations system, the donor community and other development stakeholders, has contributed to institutional development efforts leading to positive impact on the lives of Afghan citizens. Over the years UNDP support has spanned such milestone efforts as the adoption of the Constitution; Presidential, Parliamentary and Provincial Council elections; institutional development through capacity-building to the legislative, the judicial and executive arms of the state, and key ministries, Government agencies and commissions at the national and subnational levels. UNDP has played a key role in the management of the Law and Order Trust Fund, which supports the Government in developing and maintaining the national police force and in efforts to stabilize the internal security environment. Major demobilization, disarmament and rehabilitation and area-based livelihoods and reconstruction programmes have taken place nationwide. UNDP Programmes in Afghanistan have benefited from the very active support of donors. UNDP Afghanistan is committed to the highest standards of transparency and accountability and works in close coordination with the United Nations Assistance Mission in Afghanistan and the UN system to maximize the impact of its development efforts on the ground.

Organizational context:

The United Nations Development Programme (UNDP) is committed to augmenting the capacity of the Government of the Islamic Republic of Afghanistan’s (GIROA) to administer rule of law and improve security for all Afghan citizens.  As the lead rule of law institution in the country, improving the ability of the Ministry of Interior Affairs (MOIA) to fulfill its mandate remains critical to the overall stability of Afghanistan and its people.  As the UN’s primary development agency, and a longstanding development partner to GIROA’s rule of law and security sector, UNDP Afghanistan plays a leading role in facilitating reform and development of MOIA.  The MOIA & Police Development (MPD) project, principle objectives are to (1) improve MOIA’s ability to lead and manage reform, (2) ensure efficiency improvements in key police service functions and (3) improve public confidence in the police force through accountability and democratic policing standards and approaches.  These objectives are programmed under two components of the MPD project, Institutional Development and Police Professionalization.

The MPD project utilizes global expertise from within the UN system, private sector firms as well as newly established South-South Cooperation Frameworks to deliver highly contextual and relevant advisory support.  It works through three principle programming streams – legal/policy, institutional and individual capacity – to foster systemic and lasting change.  The project also works in close collaboration with strategic partners, including the United Nations Assistance Mission in Afghanistan (UNAMA), the North Atlantic Treaty Organization (NATO), European Union Police (EUPOL) and German Police Project Team (GPPT), to deliver upon these common objectives.

Proposed task

The Human Rights Due Diligence Policy (HRDDP) on United Nations Support to Non-UN Security Forces sets out principles and measures that UN entities should take to ensure that any support that they may provide to non-United Nations forces is consistent with the purposes and principles as set out in the Charter of the United Nations and with its responsibility to respect, promote, and encourage adherence to international humanitarian, human rights, and refugee law. (http://www.ohchr.org)

In this context, the UNDP/MPD support to the Ministry of Interior Affairs has direct links with implementation of the HRDDP.  The MPD is closely working with the Afghan National Police Academy (ANPA), Staff College, Training General Command (TGC), and ten regional training centers to provide technical support towards professionalization of the Afghan police force where human rights are respected and due diligence is followed when performing police duties and responsibilities. Most of the time, violation of human rights has occurred at the hands of police officers and security forces.  Respecting human rights and fulfilling obligations under human rights conventions is crucial for police officers and Afghan security forces. To this end, MPD hopes to design a human rights pilot curriculum for command staff and to deliver five courses to ANP personnel. 

Duties and Responsibilities

Scope of Work and Deliverables:

The overall objective of this assignment is to conduct a desk review of available training manuals on human rights and policing, including police human rights manuals from the United Nations Human Rights Office of the High Commission (OHCHR) and from the EUPOL Human Rights and Islamic Values curriculum, in order to determine contextualization needs for Afghanistan. To this end, the consultant will review the existing curricular materials, training needs assessments on human rights, and training manuals, and design a human rights manual for command staff (Colonel, Lieutenant Colonel, Major). In designing the human rights training manual, the consultant will consider the religious and cultural context of Afghanistan and take a harmonizing approach vis-a-vis human rights education and faith based outlooks. The national consultant will work closely with the ANPA, MOIA, staff college, TGC, and other stakeholders in designing the curriculum.

In accordance with the overall objective of the project and under the supervision of the Chief Technical Advisor and the Portfolio Manager, the Consultant will develop a Dari-language training manual on human rights for police personnel (command staff) with a detailed methodology, conduct a five-day training of trainers (ToT), in Dari and Pashto, on human rights and policing; and provide additional specialist advice and expertise on human rights and law enforcement as needed. UNDP is looking for a consultant to provide high level technical expertise for this assignment.

To achieve the objective, he or she will work together with the portfolio manager to produce the following:

  • Conduct an in-depth review of the Constitution of Afghanistan and all available training materials, manuals, laws, policies, action plans on human tights, and ratified UN human rights conventions including concluding observations received by Afghanistan;

  • Develop a training manual, in Dari, on human rights mechanisms for command staff of the police. The manual should include a detailed methodology for conducting trainings; therefore, it should cover or include the objectives of the manual, a facilitator's guide, session plans, case studies, training materials, a list of resources, and suggested literature;

The manual should include, but not be limited to, the following topics;

  • The United Nations Human Rights Mechanisms and Conventions;

  • Afghanistan’s UN Human Rights Obligations;

  • Concept of Rule of Law and Respect for Human Rights for Police;

  • Human Rights and Law Enforcement;

  • The Right to Fair Trail; Police Investigations, Non-discrimination in Law Enforcement, Arrest, Detention, the use of Force and Firearms, Civil Disorder, States of Emergency and Armed Conflict, Protection of Juveniles, the human rights of women, Refugees, etc,;

  • Role of Police in The Promotion and Protection Human Rights and the Human Rights Due Diligence Policy;

  • Rights based approach with the faith based approach to policing.

Expected Outputs/Deliverables; estimated time to complete and payment percentage:

Deliverable 1: Desk review   

Conducting the desk review of available training materials, circular on human rights for police training laws, policies, and action plans on human rights; (10 working days; 15%)

Deliverable 2: Desk review completion   

Completing the desk review, documentation and completion of collecting materials; (15 working days; 15%)

Deliverable 3: Designing of the human rights training manual     

Reviewing/designing the HR curricular with the support of two source documents, namely, United Nations Human Rights Office of the High Commission (OHCHR) and EUPOL Human Rights and Islamic Values curriculum and translation and adapted into Dari; (40 working days; 30%)

Deliverable 4: Presenting the final training manual to the MOIA and getting approval of MOIA      

After completion of reviewing all manuals, the consultant will present the final manual to the MOIA; (20 working days; 10%)

Deliverable 5: Delivery of the human rights training      

Conducting the two-pilot training for selected command staff, and reviewing and recommending changes for the 2018 courses on human rights; (47 working day;  30%)

Payment Modality: 

Payments under the contract shall be delivery based and be made on receipt of the specific milestone reports indicated above, and including a timesheet per UNDP procurement formats for individual contractors. These shall be as indicated in the table above, and shall be made upon approval by the relevant MPD managers. The draft of the training manual will be reviewed by the UNDP MPD Management. Upon receipt of final comments, the consultant shall finalize the manual for formal acceptance by UNDP, at which point the final payment shall be released.

Required Skills and Experience

Academic Qualifications:

  • Master’s degree in Public Policy, Political Science, International Development, Criminal Justice, Social Science, Law or any other areas relevant to the post.

Experience:

  • A minimum of 7 years of work experience in International Development;

  • Experience in training, education and police professionalization;

  • At least 7 years of working experience in capacity and institution building in the area of human rights, rule of law and access to justice;

  • Experience in development of training manuals, guidebooks in the area of human rights for police, lawyers, and justice administration;

  • Demonstrated experience in writing of training manuals or similar documents in English.

Language:

  • Excellent written and spoken English, Dari/Pashtun.

Working Arrangements

Institutional Arrangements:

The consultant will bear the expenses of his/her own phone bills, local transportation, and will need to bring his/her own computer. Therefore, these expenses should be included in the daily fee. The consultant will work under the supervision of the CTA of the police professionalization component through the portfolio manager and will closely liaise/interact/collaborate with the Technical Specialist on female police training. The consultant is expected to work in the designated location as specified in the “Duration of Work” section below.

Price Proposal and Schedule of Payments:

The contractor shall submit a price proposal as below:

  • Daily Fee – Daily Fee – The consultant shall propose a daily fee which should be inclusive of his/her professional fee, local communication and transportation costs. The number of working days for which the daily fee shall be payable under the contract is 132 working days

 The total professional fee, shall be converted into a lump-sum contract and payments under the contract shall be made on submission and acceptance of deliverables by end-user under the contract in accordance with the abovementioned schedule of payment.

Evaluation Method and Criteria:

Individual consultants will be evaluated based on the following methodology:

Cumulative analysis

The award of the contract shall be made to the individual consultant whose offer has been evaluated and determined as:

  • Responsive/compliant/acceptable, and

  • Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

* Technical Criteria weight 70%

* Financial Criteria weight 30%

Only candidates obtaining a minimum of 49 points (70% of the total technical points) would be considered for the Financial Evaluation.

Technical Proposal (30 marks)

  • Technical Approach & Methodology (20 marks)– This explain the understanding of the objectives of the assignment, approach to the services, methodology for carrying out the activities and obtaining the expected output, and the degree of detail of such output. The Applicant should also explain the methodologies proposed to adopt and highlight the compatibility of those methodologies with the proposed approach;
  • Work Plan (10 marks) – The Applicant should propose the main activities of the assignment, their content and duration, phasing and interrelations, milestones (including interim approvals by the Client), and delivery dates. The proposed work plan should be consistent with the technical approach and methodology, showing understanding of the TOR and ability to translate them into a feasible working plan (Proven by 1 writing sample).
