1. Summary

1. Background of the Myanmar Legislature

The Constitution of the Republic of the Union of Myanmar (the Constitution) came into force in 2008.  Chapter 4 of the Constitution establishes the Union Legislature or Pyidaungsu Hluttaw comprising two Hluttaws that are generally equal in status:

• The Pyithu Hluttaw (People’s Assembly) formed with representatives elected based on township as well as population and representatives being the Defence Services Personnel nominated by the Commander-in-Chief of the Defence Services. Section 109 provides that the Pyithu Hluttaw will have a maximum of 440 representatives with not more than 330 elected representatives and 110 nominated, as prescribed above;
• The Amyotha Hluttaw (Nationalities Assembly) formed with representatives elected in equal numbers from Regions and States and representatives being the Defence Services Personnel nominated by the Commander-in-Chief of the Defence Services. Section 141 provides that the Amyotha Hluttaw will have a maximum of 224 representatives with 168 representatives elected in an equal number of 12 representatives from each Region or State inclusive of relevant Union territories and 1 representative from each Self-Administered Division or Self-Administered Zone and 56 nominated, as prescribed above.

The term of the Union Hluttaw is 5 years from the day of the first session of the Pyithu Hluttaw. Following the Myanmar election held on 8 November 2015, newly elected MPs were sworn in as Members of the Pyithu Hluttaw on Monday 1 February 2016, and of the Amyotha Hluttaw on Wednesday 3 February 2016.

1. Background of the UNDP Myanmar Programme

The UNDP Country Programme (2013-17) supports the Government of Myanmar in its objective to achieve democratic transformation and poverty reduction in the country. As part of the Democratic Governance pillar of this programme UNDP and the IPU have developed a parliamentary strengthening component which includes a long-term, multi-faceted approach to capacity building. It covers capacity building for the Parliamentarians, the Parliamentary Administration as well as for the Regional/State Parliaments.

The UNDP Output for Parliamentary Strengthening is designed to assist the Hluttaw to meet its strategic objectives in the areas of:

• Strategic Planning
• Learning Centre – training and capacity building
• Information and Communication Technology and Information Management
• Parliamentary Committees
• Parliamentary Procedures, and legislative and oversight processes
• Outreach
• Support to Region and State Hluttaws

Meeting objectives across the UNDP support programme involves assistance to ensure effective creation, handling and dissemination of information. Strong documentation and dissemination of key programme documents supports the timely delivery of programme work, enables clear communication between UNDP and IPU and the Hluttaw and is key to ensuring approval and scheduling of activities. Interpretation and translation support is central for the delivery of successful programme activities. Effective knowledge management also promotes improved organisational learning within both the Hluttaw and the UNDP/IPU Parliamentary Support Programme.

Effective knowledge management in this context contributes to building sustained institutional strength:

• ICT, records management and core parliamentary record keeping. In 2017, the Hluttaw will launch the intranet and integrated website. This will require support to the Hluttaw to collect and prepare documentation for publication. The Hluttaw has requested support to develop English language versions of parliamentary documents including Agendas and Business Papers. These documents play a key role in promoting public access to information and informing the public of the work of the Hluttaw.

• Learning. Ensuring sustainability of Learning Centre programmes for MPs and staff. Capacity building activities require the development, management and dissemination of learning material, knowledge products and training guidelines in Myanmar and English. This supports the effective delivery of activities and helps ensure sustainability of training. In 2017 priorities are Training of Trainers programmes for Hluttaw staff and training programmes to develop the capacity in the Hluttaw to manage and administer the Learning Centre. Both programmes necessitate the delivery of effective knowledge products in English and Myanmar to ensure sustained results.

• International Relations. Developing skills of Hluttaw staff in interpretation and translation. A cadre of 36 Hluttaw staff were trained through the Learning Centre in 2016 to develop the language skills necessary to support international engagements of the Hluttaw. This group will now be supported to develop skills in interpretation and translation to ensure the Hluttaw develops internal capacity to engage with international support programmes and support activities across all areas of the UNDP/IPU AWP, helping ensure sustainability of UNDP support to the Hluttaw.
