Background

Purpose

The UNDP requires technical expertise for Provision of support and legal advice for all activities of strategic gathering for disbursement loans via Energy Efficiency Revolving Fund of Republika Srpska, and provision of further assistance in development of internal procedures for Revolving Fund of Republika Srpska.

Objective

The objective of this assignment is to provide technical support in order to: i) Provide support and legal advice for all activities of strategic gathering for disbursement loans via Energy Efficiency Revolving Fund of Republika Srpska; ii) Provide further assistance in development of internal procedures for Revolving Fund of Republika Srpska, iii) Provide support to Lead Consultant with legal advice in FBiH and RS.

Background Information

During the past three years UNDP has made a significant improvement in promotion of Energy Efficiency. The focus was the introduction of energy efficiency in the public sector across Bosnia and Herzegovina by implementation of replicable energy efficiency pilot projects and introducing EMIS (Energy Management Information System) into more than 600 public buildings. The programme has been designed to achieve CO2 emission reduction, preservation of limited resources, fund and budget savings, reallocation of funds, better quality of life, employment opportunities – “green jobs”, increase capacities on local level for absorption of new funds, increase awareness and create understanding for energy efficiency and its resulting benefits.

Part of the UNDP’s Green Economic Development programme’s efforts is to enhance the energy efficiency and renewable energy sources recognized as single most powerful and cost-effective way to achieve goals of increased security of energy supply and climate change mitigation. Therefore, it is a main pillar of energy strategies worldwide therefore energy efficiency is a strategic priority for UNDP in BiH and priority for the next programming cycle.

UNDP will contribute in achievement of the project goals related to implementation of the project “Green Economic Development - GED” also by contributing to the further development of environmental legislation and the harmonization of laws, by-laws and regulations between the two entities (FBiH and RS) in accordance with environmental related EU directives in the area of air, waste, water and soil (to be further confirmed by relevant ministries).

Duties and Responsibilities

National Legal Expert will provide technical support and legal advice for all activities of strategic gathering for disbursement loans via Energy Efficiency Revolving Fund of Republika Srpska; provide further assistance in development of internal procedures for Revolving Fund of Republika Srpska; and provide support to Lead Consultant with legal advice in FBiH and RS. All activities would be carried in collaboration with the UNDP Country Office (CO) in BiH.

More specifically, the national Legal consultant will be entrusted with the following tasks:

  • Provision of support and legal advice for all activities of strategic gathering for disbursement loans via Energy Efficiency Revolving Fund of Republika Srpska;
  • Further assistance in development of internal procedures for Revolving Fund of Republika Srpska;
  • Assist and provide expertise consultancy on law, by-law and regulation development in the area of Energy environment and banking agencies in BiH;
  • Conduct consultation meetings with relevant Environmental Fund of Republika Srpska representatives as well as in FBiH;
  • Provide continuous response to deliverables status to Project Team Leader/Coordinator.

Estimated number of consultancy days: forty (40).

Deliverables and timelines

The consultant is responsible for the following deliverables:

  • Provision of support to Lead Consultant with legal advice in FBiH and RS; Provision of support and legal advice for all activities of strategic gathering for disbursement loans via Energy Efficiency Revolving Fund of Republika Srpska; Further assistance in development of internal procedures for Revolving Fund of Republika Srpska; -  by 28th Feb 2018;

Required Skills and Experience

Education: 

  • B.Sc. degree in Law;
  • Bar exam and/or Attorney at Law would be considered an asset.

Experience:

  • More than 7 years of professional experience in development of legal and policy documents in Energy and Banking;
  • Strong background in Energy projects;
  • Strong knowledge of banking sector, energy industry and general business sectors in BiH;
  • Senior expert working experience and references;
  • Experience with the EU environmental acquis;
  • Experience in the legal and institutional set up in energy and banking sector in the region and Bosnia and Herzegovina;
  • National experience in the relevant area of expertise (e.g. participation in policy, legislative or regulatory development);
  • Experience in policy formulation and experience working in a regulatory agency or agencies; 

Language Requirements: 

  • Excellent knowledge of local and English language.

EVALUATION

Individual consultants will be evaluated based on the following methodology:

Cumulative analysis
When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:
a) responsive/compliant/acceptable, and
b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

  • * Technical Criteria weight-70%
  • * Financial Criteria weight- 30%
