Background

Purpose

With this acivity, the project ensures to develop a set of procedures, and an accompanying training, which will be instrumental for the BP BiH capability to efficiently identify, prevent, and counter trafficking of firearms, ammunition and explosives from and through BiH. The task of the consultant will be to provide legal council that would ensure that all of the developed procedures are legally compatible with international, EU and internal norms of BiH, and specifically the BP BiH.

Objective

The objective of this consultancy is to provide legal advice in the process of drafting and adoption of several bylaws, with a twofold aim: a) to provide legal advice on development of standard operating procedures (SOPs), and b) specifically for the adopted SOP for the Special Event Management to develop and roll out trainings to BP BiH staff on its implementation.

In close collaboration with CIAT Project Coordinator and CIAT Lead Consultant and other consultants, he/she will make sure that the bylaws and procedures developed under this project are in line with all respective laws of Bosnia and Herzegovina, harmonized with respective European Union and international standards, as well as applicable and in conformity with all bylaws and internal procedures of the Border Police. To achieve this, he/she will maintain close cooperation with designated counterparts in the Border Police and ensure that she/he is fully aware of all relevant international, EU and internal legal norms, against which the content of the procedures will be examined and further developed.

The consultant will be responsible to: 1) provide legal advice and ensure the legal compatibility in the process of development and adoption of five (5) bylaws, 2) assist the formation and facilitate the performance of the Working Group for the development of the SOP on Special Event Management, and 3) develop and deliver up to 10 trainings on SOP on Special Event Management. 

Provide legal advice and ensure the legal compatibility in the process of development and adoption of five (5) bylaws

The consultant will be responsible to provide legal advice and ensure the legal compatibility in the process of development and adoption of the:

  • SOP on data collection and tasking coordination related to firearms, ammunition and explosives;
  • SOP on risk analysis and risk profiling methodology at strategic, operational and tactical level;
  • SOP on Special Event Management;
  • SOP on tracing of firearms, ammunition and explosives;
  • SOP on investigation of firearms, ammunition and explosives.

Assist the formation and facilitate the performance of the Working Group for the development of the SOP on Special Event Management

For this purpose, he/she will help the formation of the Working Group on the Special Events Management and participate actively in its work. The Working Group will be formed by the Ministry of Security and will include Border Police and other state institutions in an effort to codify the actions and the procedures the BP BiH frontliners must undertake and follow in the event of high risk situations which might occur at a border crossing. Special attention needs to be given to the fact that the actions and procedures need to be aligned with the EU standards and in conformity with all bylaws and internal procedures of the Border Police.

Given the fact that there are no codified procedures in the BP BiH on Special Event Management the selected consultant will play a crucial role in encouring the Working Group towards the objectives of reaching the agreement on issues including but not limited to:

  • Coordinated inter-agency response cooperation in a particular crisis situation;
  • Better use of specialised resources of all relevant institutions in the times of crisis; and
  • Improved tasking and coordination led by the Border Police.

All of the agreed steps and resources the consultant shall describe and codify in a draft SOP on Special Event Management that s/he will present to the BP BiH Management for their consideration and further adoption. 

Develop and deliver up to 10 trainings on SOP on Special Event Management

In agreement with the BP BiH management and CIAT Project Coordinator, and under the supervision of CIAT Lead Consultant, the selected consultant shall develop a training material for the SOP for the Special Event Management for the BP BIH staff.

The draft material will be presented to BP BiH management and CIAT Project Coordinator for their consideration and clearance. Pursuant to the endorsement obtained from the project management and in agreement with the BP BiH the consultant will roll out trainings to the BP staff and make sure the knowledge is properly transmitted to the frontliners concerned, thereby reducing safety and security risks.

Background Information

The consultancy will take place under the recently initiated Countering Illicit Arms Trafficking in Bosnia and Herzegovina – CIAT Project, funded by the Federal Republic of Germany and implemented by UNDP, aimed at further strengthening of BP BiH to efficiently identify, prevent, and counter trafficking of firearms, ammunition and explosives in BiH through increased technical capacities.
Within its project work plan and national strategic framework of BiH regulating this area, the CIAT project will assist the selected institutions and agencies in their continuous specialized training on border checks for all types of cross-border traffic, establishment of an efficient border surveillance as a quality filter for cross-border crime, implementation of joint specialized trainings, as well as contribution to the implementation of specific Small Arms Light Weapons (SALW) Strategy and the Action Plan activities.
The Project key output is as follows: BP BiH capacitated to efficiently identify, prevent, and counter trafficking of firearms, ammunition and explosives from and through BiH. 

The main activities and expected results are as follows:

  • Capacity of BiH front-liners increased;
  • Capacity Development of BP BiH in Countering Illicit Arms Trafficking;
  • Increased Technical Capacity for Detection, including provision of specialized equipment procedures and training.

This intervention and envisaged Project results and activities are especially important to effectively combat crime in general and firearms trafficking in BiH in particular, in which BiH authorities need to be assisted at. To address these challenges the selected consultant will provide the necessary legal guidance in the development of procedures as well as lead the development of the procedure the BP BiH lacks on special events management, upon the development of which the trainings will be rolled out accordingly.

Duties and Responsibilities

Within this consultancy, the selected candidate will carry out the following duties under the supervision of the CIAT Project Coordinator and under the overall guidance of CIAT Lead Consultant:

  • Task 1: Provide legal advice and ensure the legal compatibility in the development of SOP on on data collection and tasking coordination related to firearms, ammunition and explosives;
  • Task 2: Provide legal advice and ensure the legal compatibility in the development of SOP on risk analysis and risk profiling methodology at strategic, operational and tactical level;
  • Task 3: Actively contribute to the formation of the Working Group on Special Events Management and participate in its work;
  • Task 4: Develop the SOP on Special Event Management;
  • Task 5: Deliver trainings to 300 BP staff on Special Events Management;
  • Task 6: Provide legal advice and ensure the legal compatibility in the development of SOP on tracing of firearms, ammunition and explosives;
  • Task 7: Provide legal advice and ensure the legal compatibility in the development of SOP on investigation of firearms, ammunition and explosives;

  • Deliver trainings to 300 BP staff on Special Events Management - 30 June 2018.

Required Skills and Experience

Education:

  • Universitiy degree in law.

Experience: 

  • At least seven years of experience in leading development of legislation on arms and weapons in the course of EU accession process.
  • Experience in inter-institutional coordination of legislative activities on arms and weapons in the course of EU accession process.

Language Requirements: 

  • Proficiency in the local languages and the ability to work in English.

 EVALUATION

Individual consultants will be evaluated based on the following methodology:

Cumulative analysis
When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:
a) responsive/compliant/acceptable, and
b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.
