Background

The United Nations Support Mission in Libya (UNSMIL) is tasked with assisting the Libyan authorities in restoring public security and the rule of law, promoting inclusive political dialogue and national reconciliation, and in assisting them to embark on the drafting of a new constitution and on laying the foundation for elections.  In accordance with its mandate UNSMIL will assist Libyan authorities and institutions resulting from the Libyan Political Agreement (LPA), through technical advice and assistance to conduct a participatory, transparent, fair, inclusive and nationally owned and led reconciliation process.

In line with its mandate, the priorities laid down in its work plan and in keeping with the provisions of the LPA, UNSMIL and UNDP will support stakeholders to come up with a reference document with options for developing a national reconciliation strategy. The document would inform future strategy and planning purposes in matters related to national reconciliation, as part of the 18 months Peacebuilding Fund supported project.

The process will be in line with the UN guiding principles on transitional justice, which include transparency, inclusiveness, accountability, and respect for local customs. The UN institutional support on reconciliation is thus focused on strengthening national efforts, including through capacity-building workshops and sharing of comparative experiences, in order to conceptualize and design an inclusive and comprehensive national reconciliation strategy for Libya. It also relies on local dialogue processes that can pave the way for meaningful reconciliation between communities in conflict.

As national ownership and independence is critical to the success of any reconciliation process, and in follow-up to the February 2018 meetings with representatives from Ghadames and Awal, and the agreed roadmap for reconciliation in Ghadames, UNSMIL and UNDP propose to reinforce the capacities of the committees for reconciliation established by both parties to monitor the implementation of the roadmap.

The training will focus on providing members of the committee concrete techniques to document and safeguard human rights violations, as well as to evaluate damages in order to suggest adapted collective and individual reparations measures.

 

Duties and Responsibilities

OBJECTIVES OF THE CONSULTANCY

The consultant will provide advice and practical support to UNSMIL and UNDP in their task of assisting the Libyan authorities, local actors and civil society organizations to design a strategy and implement a national reconciliation process ensuring a nationally owned and led process emphasizing participation, inclusiveness, accountability and transparency.

RESPONSIBILITIES

Reporting to UNSMIL/PAD and the UNDP Project Manager, the expert will assist the mission in its task of providing technical assistance on the national reconciliation process, through a capacity building session organized in Tunis on 2-5 May 2018.

The international consultant will provide guidance to the national expert also recruited, to ensure cooperation and collaboration.

The expert’s technical assistance outputs will be expected to adhere to the UN Secretary General’s Guidance Note on Transitional Justice, which emphasizes that UN support in the area of reconciliation should promote transparent, inclusive, participatory and nationally owned and led processes appropriate to the local context of Ghadames conflict in particular.

The consultant should prepare all outputs and modules ahead of the training, in coordination with the national expert, taking into consideration how the national reconciliation process can not only result in a legitimate institutional framework but also how it can, more generally, promote truth-seeking and accountability in Libya from a comprehensive legal, political and social perspective.

EXPECTED PRODUCTS

Specifically, the expert/trainer will provide the following outputs:

  • Preparing modules for the 3 days workshop (including PowerPoint presentations and background materials, booklets, etc.) and suggesting the main elements of the agenda focusing on the legal aspects of documenting violations, and international criminal law;
  • Coordinating with the national consultant in preparing and presenting various modules;
  • Full attendance, facilitation of working group and participation to the training organized in Tunis on 2-5 May 2018;
  • Assisting UNSMIL and UNDP in continuing its support to the reconciliation process in Ghadames and implementing the roadmap.

Required Skills and Experience

Academic Qualification:

  • Advanced university degree (Master’s degree or equivalent) in law, public policy, political science, administration or related field.

Experience and other Skills:

  • A minimum of 7 years of experience in post-conflict reconciliation, human rights and refugee law, with a focus on human rights, transitional justice, criminal law, public law, international humanitarian law, or other topics related;
  • Experience working in the Middle East and North Africa as well as in a global context is preferred;
  • Technical knowledge in developing training modules on documenting human rights violations and reparations;
  • Proven advisory and advocacy experience and track record of engaging with national stakeholders regarding human rights protection, transitional justice, reparations, reconciliation or topics related;
  • Proven intellectual and practical capacity to understand and interpret national and local development and political issues, particularly in recovery situation/post crisis settings;
  • Track records of facilitation and training skills;
  • Proven records of writing and researching skills;
  • Excellent drafting and formulation skills;
  • Previous experience in Libya is an asset.

Languages:

  • Fluency (both spoken and written) in English and Arabic
