Background

The objective of the project “Catalyzing Environmental Finance for Low-carbon Urban Development” is to leverage investment for transformational shift towards low-carbon urban development in Bosnia and Herzegovina thereby promoting safer, cleaner, and healthier cities and reducing urban GHG emissions. To enable this transformational shift, the project will facilitate implementation of technically and economically feasible low-carbon solutions in key urban sectors, and promote their wider uptake by municipalities and private sector via dedicated financial mechanism established within the national environmental finance framework. The project will also accelerate the implementation of a policy and regulatory framework supportive of low-carbon investment in cities.

To this end, the project will facilitate investment in technically and economically feasible low-carbon solutions in key urban sectors, and then promote their wider uptake by municipalities and the private sector via dedicated financial mechanism and funding windows established within the environmental finance frameworks in BiH, as well as by accelerating implementation of a favorable policy and regulatory framework at the entity and national levels. The project will facilitate the transformation of the market for low-carbon urban solutions by creating and expanding opportunities for businesses such as ESCOs and waste management companies to get involved in the provision of low-carbon services and products in cities.

The purpose of the position is to develop the bylaw under Article 42, paragraphs 3 and 5 of the Law on Energy Efficiency of Federation of Bosnia and Herzegovina. It will be prescribed the way energy services for public sector are contracted, obligations of both energy service provider and purchaser, content of the energy service contract, and budgetary monitoring of he energy service for its purchaser from the public sector.

Provisions of the bylaw will refer to budgetary and non-budgetary users of the entity budget, cantonal and municipal budgets, and to providers of the energy services and Environmental Protection Fund of Federation of Bosnia and Herzegovina.

National consultant will communicate and agree details with representatives of the Ministry of Energy, Mining and Industry of Federation of Bosnia and Herzegovina, Ministry of Finance of Federation of Bosnia and Herzegovina and Environmental Fund of Federation of Bosnia and Herzegovina.

Duties and Responsibilities

National consultant for development of the bylaw under the Law on Energy Efficiency of Federation of Bosnia and Herzegovina will develop the bylaw under Article 42, paragraphs 3 and 5 of the Law on Energy Efficiency of Federation of Bosnia and Herzegovina to prescribe the way energy services for public sector are contracted, obligations of both, energy service provider and purchaser, content of the energy service contract, and budgetary monitoring of the energy service for its purchaser from the public sector.

Consultant will use the results of existing analyses and studies to address the need for development of the bylaw, focusing on following aspects:

  • Providing thorough analysis of the praxis for energy service contracting in neighboring countries;
  • Use these experiences to formulate the bylaw containing, but not limiting to the following chapters:
    • Content of the Contract on Energy Performance;
    • Implementation of the Contract on Energy Performance; and
    • Monitoring of the implementation of the Contract on Energy Performance.

It is envisaged that the level of effort for these tasks will not exceed 45 expert days including potential field visits to relevant institutions across BiH, as needed. The assignment will not require presence in the UNDP premises. The assignment will include regular consultation/clarification meetings in the UNDP Sarajevo office or premises of the Ministry of Energy, Mining and Industry of Federation of BiH, Ministry of Finance of Federation of BiH and Environmental Protection Fund of Federation of BiH.

Deliverables and timelines

The consultant is responsible for the following deliverables:

  1. Detailed plan for accomplishment of tasks of this ToR (sub-chapter Scope of work) and thorough analysis of existing analyses and studies to address the need for development of the bylaw and providing thorough analysis of the praxis for energy service contracting in neighboring countries developed and submitted to UNDP - 7 days, March 05, 2019, 15%;
  2. Preparation of the bylaw under the Energy Efficiency Law in Federation of Bosnia and Herzegovina: Prepared and submitted draft version of the bylaw in close cooperation with the Ministry of Energy, Mining and Industry of Federation of Bosnia and Herzegovina, Ministry of Finance of Federation of Bosnia and Herzegovina and Environmental Fund of Federation of Bosnia and Herzegovina, containing, but not limiting to the following chapters: Content of the Contract on Energy Performance; Implementation of the Contract on Energy Performance; and  Monitoring of the implementation of the Contract on Energy Performance - 35 days, May 20, 2019, 75%;
  3. The draft version of the bylaw presented to identified stakeholders and amended as necessary with all comments and suggestions received - 3 days, June 30, 2019, 10%;

Required Skills and Experience

Academic Qualifications/Education:

  • Masters’ degree or equivalent in an appropriate subject (technical background with excellent knowledge of financial mechanism in energy sector);
  • PhD would be considered an asset.

Experience:

  • At least 10 years of experience in conducting research and providing consultancy services related to energy sector and financial mechanisms for the sector;
  • Proven experience in analysis of institutional and management arrangements in energy sector in Bosnia and Herzegovina;
  • Experience in data collection and thorough identification of documents for at least 2 different projects (experience from B&H preferred);
  • Experience working with multilateral organizations and the UN system preferred.

Languages Requirements:

  • Knowledge of local languages and English (excellent writing, editing and communication skills) demonstrated in submitted one-page local and English segment of any relevant study/publication/written document compiled in order to assess language skills.

Technical  criteria:

  • Criteria A: Methodology (document which contains brief explanation on approach to conduct the work) - Weight: 40%, Maximum points: 40;
  • Criteria B: Strong analytical skills, ability to conceptualize and write concisely and clearly - Weight: 20%, Maximum points: 20;
  • Criteria C: Knowledge of local languages and English (excellent writing, editing and communication skills) demonstrated in submitted one-page local and English segment of any relevant study/publication/written document compiled in order to assess language skills - Weight:10%, Maximum points: 10;
  • Criteria D: Ratings based on shortlisting criteria (Academic qualifications/education; Relevant professional experience; Work experience with UN Agencies) - Weight: 30%, Maximum points: 30;

Financial criteria:

  • Price offer from candidate (lump sum offers in BAM, calculated using prevailing UN exchange rate) - Weight: 30%, Maximum points: 30;

EVALUATION

Individual consultants will be evaluated based on the following methodology:

Cumulative analysis

When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:
a) responsive/compliant/acceptable, and
b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

  • * Technical Criteria weight-70%
  • * Financial Criteria weight- 30%

Only candidates obtaining a minimum of 49 points for technical criteria assessment would be considered for the Financial Evaluation.
