Background

The European Commission Kosovo 2018 report has noted that the level of professionalism and competence, especially of judges and prosecutors, is still a matter of concern. A system where judges and prosecutors undergo an effective and systematic evaluation based on clear criteria needs to be implemented.
The Academy of Justice is responsible for delivering initial and continuous training for judges and prosecutors and their legal and administrative staff. However, the Academy of Justice has limited human resources to evaluate the impact of both its initial and continuous legal education training programs aimed at developing the capacities and competences of the legal practitioners. The training is based on the annual training curricula jointly prepared by the Judicial and Prosecutorial Councils and the Academy following a comprehensive needs assessment. However, the interinstitutional coordination among the Councils and the Academy of Justice requires further improvement to identify the training needs for the judges and prosecutors and measure the impact of the trainings.
The UNDP’s “Enhanced Access to Justice and RoL Reform in Kosovo” project aims to support the justice sector reform process. The envisioned support for the Academy of Justice aims at advancing the role of the Academy of Justice to provide the suitable training support for legal practitioners.

Objectives of Assignment
Evaluate and update the training programme and the strategic framework of the Academy of Justice.

Duties and Responsibilities

Under the overall supervision by the Project Manager, and direct cooperation with the Academy of Justice, the legal consultant is responsible for the following:

  • Evaluate the impact of the Academy of Justice’s annual training program, identify gaps, and propose recommendations to improve the upcoming training program;
  • Identify best practices and training methodologies applied in the region and other EU member states (4) and analyse the feasibility of application by the Academy of Justice;
  • Provide substantive support during the drafting of the secondary legislation to improve the functioning of the Academy;
  • Develop a dynamic plan to support the monitoring, evaluation, and reporting of the implementation of the Academy’s Strategic Plan objectives;
  • Liaise with KPC’s and KJC’s performance evaluation committees and training offices to identify judges’ and prosecutors’ performance issues, thereby including them into the Academy’s training program;
  • Analyze the revised Criminal Procedure Code with the purpose of identifying some of the key areas of training needs for legal practitioners to allow for its effective implementation.

Expected Deliverables/ Outputs

  • Evaluation analysis on the training program
  • Research analysis on the best practices and innovative training methodologies
  • Two secondary legislations
  • Dynamic plan for the monitoring, evaluation, and reporting of the implementation of the Strategic Plan objectives developed
  • Performance evaluation issues with KJC’s and KPC’s performance evaluation committees identified
  • Key areas of training needs deriving from the Criminal Procedure Code identified
  • End of Assignment report

Remuneration - Lump Sum Amount

The budget for the assignment will be presented as a lump sum.

Payment is made upon confirmation of deliverables by the Rule of Law Project Manager:
15% by the delivery, and approval of the first deliverable;
10% by the delivery, and approval of the second deliverable;
15% by the delivery, and approval of the third deliverable;
15% by the delivery, and approval of the fourth deliverable;
15% by the delivery, and approval of the fifth deliverable;
15% by the delivery, and approval of the sixth deliverable;
15% by the delivery, and approval of the final deliverable.

Recommended Presentation of Offer

  • P.11 and personal CV, indicating all past experiences from similar projects, as well as the contact details (email and telephone number) of the Candidate and at least three (3) professional references;
  • Brief description of why the individual considers him/herself as the most suitable for the assignment
  • Financial Proposal that indicates the all-inclusive fixed total contract price supported by a breakdown of costs per deliverables.

Criteria for Selection of the Best Offer
Combined Scoring method – where the qualifications and the interview scoring will be weighted a max. of 70%, and combined with the price offer which will be weighted a max of 30%;

Required Skills and Experience

Education:

  • Master’s degree in law.
  • Bachelor’s degree in law and extensive experience in law.

Experience:

  • At least 5 years of relevant experience (or 7 years of relevant work experience for those with BA educational level) in the field of human rights and/or judiciary;
  • Professional experience with central level institutions and/or international institutions;
  • Previous experience in analytical research, preferably for justice institution;
  • Experience in capacity development;
  • Practical experience in legal drafting;
  • Excellent reporting and writing skills.

Language:

  • Excellent Albanian and English language skills (both written and oral). Good knowledge of Serbian will be an asset.
