Background

Despite the legal and organizational reforms in the rule of law sector, Kosovo have not managed to ensure the protection of human rights pursuant to international standards. The effective implementation and enforcement of human rights legislation still remains a challenge. Judges are bound to observe the European Court for Human Rights jurisprudence, and the Law on protection against discrimination when interpreting human rights and fundamental freedoms. However, analysis of judicial practice in Kosovo shows that judges are not fully prepared for practical implementation of the approaches and positions of the European Court for Human Rights.
Overall, the “Enhanced Access to Justice and Rule of Law Reform in Kosovo” project aims to support the justice sector reform and improve access to justice, with a focus on disadvantaged and marginalized groups, and promote human rights standards for all. More specifically and in light with the above noted issues, and the need to further strengthen the protection and promotion of human rights, the project, in cooperation with Ombudsperson aims to develop a database with the purpose of increasing the quality of legal reasoning and court decisions in reference to the application of the ECHR and other international instruments.

Objectives of Assignment
Link the fundamental rights and freedoms under the Chapter II of the Kosovo Constitution with the corresponding Kosovo Laws and provisions in force, the international agreements instruments, and the case law of the ECHR.

Duties and Responsibilities

Under the overall supervision of the Project Manager, and direct cooperation with Ombudsperson, the legal officers are responsible for the following duties and responsibility:

1. Link the fundamental rights and freedoms under the Chapter II of the Kosovo Constitution with relevant:

  • Laws and legal provisions in force in Kosovo;
  • International Instruments which are directly applicable in Kosovo;
  • Case law of the European Court of Human Rights;
  • 17 Sustainable Development Goals (goals and targets);

2. Input the results in the digital human rights database.

Expected Deliverables/ Outputs

  • Link articles 23 to 32 of the Kosovo Constitutional Fundamental Rights and Freedoms with the corresponding Kosovo Laws and provisions in force, International agreements /Instruments, and the case law of the ECHR.
  • Link articles 33 to 42 of the Kosovo Constitutional Fundamental Rights and Freedoms with the corresponding Kosovo Laws and provisions in force, International agreements /Instruments, and the case law of the ECHR.
  • Link articles 43 to 52 of the Kosovo Constitutional Fundamental Rights and Freedoms with the corresponding Kosovo Laws and provisions in force, International agreements /Instruments, and the case law of the ECHR.
  • Link articles 53-58 of the Kosovo Constitutional Fundamental Rights and Freedoms with the corresponding Kosovo Laws and provisions in force, International agreements /Instruments, and the case law of the ECHR.
  • All Articles must be linked with corresponding SDGs and related indicators
  • The findings are inserted in the database
  • Periodic reports as requested by the Project Manager

Remuneration - Lump Sum Amount
The budget for the assignment will be presented as a lump sum.
Payment is made upon confirmation of deliverables by the Rule of Law Project Manager:
16% by the delivery, and approval of the first deliverable;
16% by the delivery, and approval of the second deliverable;
16% by the delivery, and approval of the third deliverable;
16% by the delivery, and approval of the fourth deliverable;
16% by the delivery, and approval of the fifth deliverable;
20% by the delivery, and approval of the final deliverable.

Recommended Presentation of Offer

  • Letter of Confirmation of Interest and Availability;

  • Brief description of why the individual considers him/herself as the most suitable for the assignment

Criteria for Selection of the Best Offer

Combined Scoring method – Combined Scoring method – where the qualifications and the interview scoring will be weighted a max. of 70%, and combined with the price offer which will be weighted a max of 30%.

Required Skills and Experience

Education:

  • Master’s degree in law.

Experience:

  • At least 7 years of relevant experience in field of human rights, judiciary, public administration, preferably with the central level institutions and/or international institutions;
  • Excellent knowledge of applicable laws and regulations;
  • Experience in academic research and legal analysis;
  • Experience in analysing and reconciling large data sets;
  • Experience with modern communication and information management technologies;

Language:

  • Excellent Albanian and English language skills (both written and oral). Good knowledge of Serbian will be an asset.
