Background

The Sawasya II programme: Promoting the Rule of Law in Palestine represents the primary programmatic vehicle of the United Nations for advancing the rule of law, integrity, gender justice and human rights in Palestine for the period 2018-2022. Bringing together the main UN entities mandated and invested in these areas in an integrated programme framework (three years, with provision for a further two optional years), Sawasya II seeks to elevate the state building enterprise for a progressively functioning and increasingly inclusive State of Palestine that respects, protects and fulfils human rights and gender equality, and promotes development, peace and security.

The UNDP /UNOWMEN/ UNICEF Sawasya II Programme is working with the Ministry of Justice, Attorney General Office, Bar Association, other government institutions, national human rights institutions and civil society organizations, focusing on the promotion of peaceful and inclusive societies for sustainable development, provision of access to justice for all, and the realization of effective, accountable and inclusive institutions at all levels (SDG 16), and on achieving gender equality and empowerment for women and girls (SDG 5).

For this purpose, the programme is seeking to establish a pool of experts in order to give a quick response to the specific needs. The purpose of this roster is to provide Sawasya with the opportunity to hire an Individual or Team of Individuals at short notice, for the provision of consultancy services, through the Individual Contract (IC) modality.

Duties and Responsibilities

Through an on-going close cooperation intended to better cater for and service the needs of UNDP/PAPP Sawasya II Programme, to advance the rule of law, integrity, gender justice and human rights in Palestine, UNDP is developing Sawasya Programme Experts Roster.

The Roster consists of a repository of qualified experts, who express their interest in supporting UNDP with its rule of law related needs.

The aim of this advertisement exercise is to populate a roster of experts who would be available to provide support on an ad-hoc basis under consultancy contracts.

The consultants are expected to provide services as per the thematic areas set forth below. However, context-specific duties and responsibilities will be detailed in specific Terms of Reference for each assignment.

Competencies

Experts will need to demonstrate professional experience and extensive knowledge in the rule of law as well as expertise in at least one (preferably multiple) of the thematic areas listed below:

Group 1

Required Education: At least a university degree in the field of law, criminal law, gender studies or any other related field.

 

  • Required Output: Support national committee on harmonization of laws with international human rights & anti-corruption standards

1)National Consultant on Political advocacy with institutional leadership in collaboration with Prime Minister Office

Required Experience:

  • At least (10) years of experience working with justice sector institutions, preferably in Palestine or the MENA region
  • Proven experience in coordination on the political level with institutional leadership

2)National Consultant on Legal Harmonization and review from a gender perspective

Required Experience:

  • At least (10) years of experience working with justice sector institutions, preferably in Palestine or the MENA region
  • Proven experience in drafting of laws or legislation
  • Proven experience in developing gender analysis of laws and legislations and it’s compatibility with Human right treaties.

3)National/international consultant on legal review from gender perspective

  • Required Output: Engage relevant institutions and Civil Society Organizations in revising key rule of law legislations in order to strengthen the independence of Rule of Law institutions

4)National Consultant on Judicial Authority Law, Judiciary inspection

Required Experience:

  • At least (10) years of experience working with justice sector institutions, preferably in Palestine or the MENA region
  • Proven experience in reviewing and drafting of laws or legislation

 

  • Required Output: Support Human Rights Unit and judicial institutions' inspection mechanisms

5)National/International Consultant on Court Monitoring

6)National Consultant on Complaint System to support the Attorney General Office/High Judicial Council to set up a complaint processing mechanism

7)National Consultant on Prison Monitoring to support the Human Rights Unit at the Attorney General Office in prison monitoring

Required Qualifications for the three above consultancies:

  • At least (10) years of experience working with justice sector institutions, preferably in Palestine or the MENA region
  • At least (3) years of experience in monitoring places of detention
  • At least (3) years of experience in monitoring courts
  • At least one (1) year experience in dealing with complaints related to justice sector institutions and detention in Palestine
  • Proven one (1) year of experience in field of research & needs assessment

8)National Consultant on Human Rights Mainstreaming. Strategic planning exercise with selected team of judges and planning unit staff to identify entry for human rights mainstreaming in High Judicial Council planning and policy (Human Rights Unit or focal point).

Required Qualifications:

  • At least (10) years of experience working with justice sector institutions, preferably in Palestine or the MENA region
  • At least (3) years of experience in working human right Organization in Palestine
  • At least one (1) year experience in working on human right treaties mainstreaming
  • Proven one (1) year of experience in field of research & needs assessment

 

  • Required Output: Support human rights-based development of technical and organizational capacities at the family courts (and PMF) to improve outcomes of the family law system (incl. vis-à-vis alimony, custody, marriage, divorce

9)International Consultant to Support the development of the bylaw and Standard Operating Procedures of the Supreme Judge Department inspection department including evaluation methodology and criteria

Required Qualifications:

  • At least (10) years of relevant experience working with the justice sector preferably in Palestine or the MENA region
  • At least (3) years of experience in strengthening judicial inspection functions
  • At least one (1) experience working with the family law court system in Palestine or in the MENA region

12)National Consultant on Female Judges Empowerment: Support professional peer groups of women working in the justice sector and facilitate career development opportunities/mentoring schemes

Required Qualifications:

  • At least (10) years of experience working with justice sector institutions, preferably in Palestine or the MENA region
  • At least (5) years in working in women empowerment and gender equality using mentoring schemes.

13)National/International Consultant on Female Lawyers Empowerment: Support professional peer groups of women working in the Law profession and facilitate career development opportunities/mentoring schemes

  • At least (10) years of experience working with law firms, preferably in Palestine or the MENA region
  • At least (5) years in working in women empowerment and gender equality using mentoring schemes
  • Proven experience in developing modules to address gender bias in the legal profession

Required Qualifications:

  • A degree in law or public administration
  • At least (5) years of experience in drafting policy directions preferably in the justice sector or other related sector

18)National/International Consultant to Support Legal Clinics in Palestinian Universities in West Bank and Gaza

Required Qualifications:

  • At least (5) years of experience working with Legal clinics in Universities, preferably in the MENA region
  • At least (2) previous experiences in the field of research, or preparation of law schools need assessments
  • Proven experience in designing and further developing university legal clinic models or designs.

Required Qualifications:

  • At least (10) years of progressive experience of legal/policy issues in the Occupied Palestinian territory including East Jerusalem
  • At least (3) previous experiences working on Alternative Dispute Resolution mechanisms (mediation, conciliation, arbitration) and drafting laws.

20)International Consultant to Train judges on Arbitration

Required Qualifications:

  • At least (5) years of progressive experience on Alternative Dispute Resolution, legal/policy issues
  • At least (5) years of experience working on Alternative Dispute Resolution mechanisms and mainly training on arbitration.

Required Qualifications:

  • At least (10) years of experience working with justice sector institutions, preferably in Palestine or the MENA region
  • Proven experience in facilitating trainings on access to justice in the promotion and protection of human rights; combatting torture and ill-treatment; freedom of expressions; crime scenes and respect of human rights while investigating crimes.
  • Previous experience in targeting judicial actors in fragile contexts.
  • Proven experience in the field of legal research & capacity to undertake needs assessment of judicial actors
  • Ability to develop quantitative and qualitative tools to assess the effectiveness and impact of human rights trainings for judicial actors.

 

22)International Consultant on Transitional Justice Mechanisms

Required Qualifications:

  • At least (10) years of professional experience in the field of transitional justice.
  • At least (5) years of specialization in provision of technical advice to countries emerging from conflict in relation to the pursuit of justice, accountability measures, reparations and institutional reform, with elaboration on transitional justice models of Germany, South Africa, Tunisia, Northern Ireland, Nepal, Sri Lanka and/or Latin America.
  • Proven experience in supporting community-based transitional justice processes.
  • Experience in legal, human rights, constitutional and/or transitional justice issues in Palestine and/or the MENA region.

Required Education: Advanced university degree (Master’s degree or equivalent degree) in business administration/management, public administration, economic, security sector reform/management, international relations or related fields is required.

23)International /National Consultant for evidence-based assessment/evaluation of Rule of Law Programmes

Required Qualifications:

  • Master’s degree in the field of community security, conflict prevention, peace building and reconciliation, governance, inclusive participation, gender mainstreaming and human rights promotion
  • At least (10-15) years of professional experience in areas of democratic governance, rule of law, access to justice international human rights law or international relations, regional development, gender equality and child justice
  • At least (5) of years of experience with managing, implementing or assessing multi-annual UN rule of law programmes and/or in conducting gender responsive assessments, evaluation or audits
  • At least (5) years of experience in evaluating or assessing multi-donor development programmes, with at least (2) years of experience managing, monitoring, or evaluating gender justice/child justice/rule of law/justice reform programmes
  • At least (5) years of experience in conducting evaluations of national human rights institutions or government and international aid organizations
  • Direct experience with civil service capacity building is an added advantage
  • Excellent writing skills with a strong background in report drafting.

  • Knowledge of the government strategic planning framework and budget development practice.
  • Delivery of two similar trainings to the government employees.
  • Knowledge and previous work with the justice sector in the area of gender planning is a plus.

 

29)IC for Trainer on developing budget of performance and programs

Required Qualifications:

  • Advance university degree in Economy or related fields
  • At least (10) years of experience in providing advice, including training, on budgeting to the government
  • Proven record of developing two training courses in budget of performance programs
  • Knowledge of the government strategic planning framework and budget development practice
  • previous work with the justice sector in the area of planning is a plus.

 

30)IC for Trainer on project proposals writing

Required Qualifications:

  • Advance university degree in management or international cooperation and development
  • At least (10) years of experience in institutional development and or project management preferable with an international organization.
  • Proven experience in writing/appraisal of EU projects or other major donor working in Palestine
  • Proven record in mentoring and/or training PA staff on strategic planning, project management, monitoring and evaluation, and proposal writing.

 

31)IC for Trainer on action plans development and managerial reporting

Required Qualifications:

  • Advance university degree in Business administration or related fields
  • At least (10) years of experience in providing training on project management
  • Proven record of developing at least two training courses on project management and preferably on reporting.

 

32)IC for Trainer on SDGs

Required Qualifications:

  • Master university degree in the field of Business Administration, Political Science, International Relations or any other related field with 4 years of experience, or a bachelor’s degree in the same fields with 6 years of experience can accepted in lieu of a Master’s degree
  • At least (4) years of professional work experience in related fields; proven record of delivering training on SDGs, MDGs, or similar issues;
  • work experience in good governance or implementation and monitoring of  SDGs; specific knowledge of SDG16 is a plus
  • Proven experience in coordination role, research, writing of work plans, and monitoring indictors;

44)National Consultant to Customize MIZAN for the work of the Attorney General Office/HJC judicial inspection

Required Qualifications

  • At least (10) years of experience in network design, installation and troubleshooting projects for medium-to-large firms/institutions
  • At least one (1) previous professional experience in developing and implementing networking systems, security programs, protocols and maintenance of existing systems
  • In-depth knowledge of data communications and network experience of operating systems and tools
  • Certificates in Networking and Security management is an advantage
  • At least one (1) experience of human right background would be an asset.

Specific Terms of Reference will dictate the scope of work and the selection of experts from the vetted roster for each of the assignments.

The hired consultants will report to UNDP, seek approval/acceptance of outputs as specified in the contract.

Duration of the Work:

Each assignment will vary in duration. The expected duration will be specified in the Terms of Reference for each individual assignment.

Location of the Work:

The location of the work will vary. The location will be specified in the Terms of Reference.

Eligibility:

Applicants currently holding non-consultancy contracts (i.e., FTA, Service Contracts etc.) with UN Agencies are not eligible to apply for this roster.

Application Procedure:

Technical Proposal:

  • Statement of why the individual considers her/himself suitable for the roster, indicating which thematic areas below the individual can demonstrate specialized expertise. Applicants may select multiple thematic areas; when doing so, a brief summary of relevant experience per subject area should be included. Applicant is required to fill-in Offeror’s Application Form (see Annex II).

Financial Proposal:

Applicants are instructed to submit their financial proposals in US Dollars for this consultancy using the financial proposal template?by the deadline of the application.

Financial proposals must indicate a daily fee, that will act as ceiling fee for the services of consultants for each assignment engaged. The daily fee in the financial proposal must consider the various expenses the applicant expects to incur during contract, including:

  • The daily professional fee
  • Communications, utilities and consumables
  • Life, health and any other insurance
  • Any other relevant expenses, if any, related to the performance of services under the contract

All other additional expenses (including transport, living expenses and risks and inconveniences related to work under hardship and hazardous conditions, when applicable) will be added at UNDP request in the secondary bidding stage. Once pre-selected roster consultants have been contacted for confirmation of availability and interest, TOR for the assignment will be shared and consultants will  be  asked  to  provide  a  specific  financial   proposal   for   competitive   purposes that   includes all costs of   travel,    living    allowances    and risks    / security    fees (whenever  applicable) commensurable at the duty station and duration of the assignment. UNDP normally use economy class;

  • The fees provided by each applicant during the application stage will be the maximum professional daily fees to be quoted for each call-off assignment under this Roster.
  • If an Offeror is employed by an organization/company/institution, and she/he expects her/his employer to charge a management fee in the process of releasing her/him to UNDP under a Reimbursable Loan Agreement (RLA), the Offeror must indicate at this point, and ensure that all such costs are duly incorporated in the financial proposal submitted to UNDP;

Evaluation, selection criteria and process

Criteria for Selection of ICs

All applicants will be initially screened against the minimum requirements as specified above. Only those applicants who meet the minimum level of education, relevant years of experience requirements will be longlisted and considered for the technical evaluation.

The technical evaluation will include a desk review.

Each Expert listed in the Roster will be categorized into (1) of (3) possible categories/bands. The criterion for classification of the Experts is as follows:

  • Band 1; Minimum (4) years relevant professional experience in the relevant group
  • Band 2; Minimum (10) years relevant professional experience in the relevant group
  • Band 3; Minimum (15) years relevant professional experience in the relevant group

Financial evaluation:

Financial proposals must indicate a daily fee, that will act as ceiling fee for the services of consultant.

The cost for air travel and living cost for international consultants should NOT be included in the daily rate. Travel cost will be borne by UNDP if such travel will be required.

Award will be made based on Pass/Fail method

Only consultants whose offer has been evaluated and determined as responsive / compliant / acceptable; and are in compliance with criteria above, will be included in the Sawasya Programme Roster. UNDP reserve the right to identify the number of the consultants to be included in the roster/each assignment.

Several successful individuals will be selected and placed on the Roster for a period of three years. It is to be noted that inclusion in the roster does not guarantee a contract during the period of three years. UNDP reserves the right to update its roster as deemed necessary.

Upon receipt of the corresponding ToR, and when several listed experts fully match the ToR a secondary bidding exercise will take place; the shortlisted experts will be requested to submit methodology and workplan (as deemed necessary), confirm availability, and a financial offer based on the provided ToR  within a stipulated deadline. The daily rate in the financial offer shall not exceed the one which was originally submitted by the expert.

The selection shall be made based on the lowest financial proposal including the time frame across the selected experts. In the event of a single expert being qualified and/or available, no secondary bidding will be required.

Financial commitments will only be established each time a Contract for the specific services/TOR for IC is committed.

Payment will be made upon submission of a certificate of payment request, indicating outputs achieved and days worked; Payments will be made as specified in the actual contract upon confirmation of UNDP on delivering against the contract obligations in a satisfactory manner.

Procurement Unit will ensure performance feedback is provided by Sawasya Programme upon completion of each assignment by the Rostered Experts. Retention/continuation of Experts on the Roster would be underpinned on performance.

Experts will be removed from the Roster in following situations:

  • If the individual informs UNDP of his/her decision to be excluded from the Roster
  • If UNDP has obtained negative performance feedback
